A RESOLUTION, WITH ATTACHMENTS, OFFICIALLY
ACCEPTING THE ATTACHED CITY CLERK'S
CERTIFICATION AND DECLARATION OF THE RESULTS
OF THE SPECIAL MUNICIPAL ELECTION HELD ON
SEPTEMBER 4, 1997, IN WHICH THE QUESTION AS
TO WHETHER THE CITY OF MIAMI SHALL RETAIN ITS
EXISTENCE AS A MUNICIPALITY AND NOT BE
ABOLISHED, EFFECTIVE SEPTEMBER 30, 1998, WAS
APPROVED BY THE ELECTORATE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Commission hereby officially accepts
the attached City Clerk's Certification and Declaration of the
results of the .Special Municipal Election held on September 4,
1997, in which the question as to whether the City of Miami shall
retain its existence as a municipality and not be abolished,
effective September 30, 1998, was approved by the electorate.
Section 2. This Resolution shall become effective
immediately upon its adoption.

CERTIFICATION AND DECLARATION OF RESULTS
ON THE SPECIAL ELECTION HELD ON SEPTEMBER 4, 1997

I, WALTER J. FOEMAN, City Clerk of the City of Miami, Florida, do hereby certify that all
necessary legal steps were taken in connection with the conduct of a City of Miami
Special Election held on September 4, 1997, including, though not limited to, the following
Logic and Accuracy Tests: .
On Wednesday, September 3, 1997, commencing at approximately 1 p.m., the Metro -
Dade County Supervisor of Elections had the tabulating equipment located in the
Elections Department, at the Stephen P. Clark Center, tested to ascertain that the
equipment would correctly tabulate the precinct and absentee ballot votes cast for all City
of Miami questions.
Test results were compared with the predetermined totals for each question, and pursuant
to requirements established in Section 101.5612, Florida Statutes, I witnessed and
observed the performance and results of all required tests and verified the correctness of
the program, precinct header cards and test ballots, as well as any replacement of said
materials required by and subject to said tests.
On this date, the City of Miami Canvassing Board (hereinafter referred to as "Canvassing
Board") set the time for opening of the valid absentee ballots. The Canvassing Board also
began the canvass of the presumed invalid absentee ballots cast.
On Thursday, September 4, 1997 (election day) commencing at 6 p.m. the Canvassing
Board resumed the absentee ballot canvass. At approximately 6 p.m., the Metro -Dade
County Supervisor of Elections had the tabulating equipment located in the Elections
Department at the Stephen P. Clark Center tested to ascertain that the equipment had not
been tampered with, and that it would correctly count the precinct and absentee ballot
votes cast for all City of Miami questions.

ealed boxes were appropriately identified by Metro -Dade County Elections Department
to secure the testing materials and the program microdisks, which would ensure the
inviolability of the materials in question. After the voting precincts were closed and the
ballots were in, all precinct ballots cast were counted. No ballot card was removed from or
added to any ballot card container, ballot card tray or other segregation of ballots, and no
ballot card was in any manner altered or tampered with by any person, and no person
touched any ballot cards container, ballot card tray or ballot cards except the person
authorized to do so pursuant to Section 101.5614, Florida Statutes.
At the completion of the precinct and absentee ballot count, the automatic tabulating
equipment was again tested to ascertain that the equipment correctly counted the precinct
and absentee votes cast for all City of Miami questions.

At the completion of this post -count Logic and Accuracy test; all voted ballots together with
their precinct header cards, the duplicated and the spoiled ballots were appropriately
stored in containers which were sealed and signed off by the Dade County Supervisor of
Elections and the City Clerk, under specific sealed numbers, as more fully identified in the
Logic and Accuracy Test Certificate received from the Metro -Dade County Elections
Department.
I further certify that all documents concerning these Logic and Accuracy Tests showed the
tabulating equipment to be functioning correctly and that said documents are presently in
the possession of the Supervisor of Elections of Metro -Dade County, in containers which
were sealed and signed off by the Supervisor of Elections and the City Clerk.

Mayor elected citywide who will not be a member of the City Commission, and for five
Commissioners from five districts, was approved by the electorate.

OF THE PUBLIC LOGIC AND ACCURACY TEST
OF THE TABULATION EQUIPMENT
I, the undersigned City Canvassing Board representative appointed to act during
the City of Miami Special Election on September 4, 1997, do, by my signature hereto,
certify that to the best of my knowledge:
1. On September 3, 1996, commencing at approximately 1:00 p.m., the Supervisor of
Elections had the tabulating equipment based in the Elections Department at the
Stephen P. Clark Center tested to ascertain that the equipment will correctly count
the precinct and absentee ballot votes cast for all questions.
2. The undersigned compared the test results with the predetermined totals for each
candidate and pursuant to the requirements established in Section 101.5612,
Florida Statutes, observed the performance and results of all required tests and
verified the correctness of the program, precinct header cards and test ballots, as
well as any replacement of said materials required by said tests, subject to said
tests.
3. At the completion f this public logics �d accuracy test, the verified logic and

PRE- AND POST- PRECINCT AND ABSENTEE BALLOT COUNTS
I, the undersigned City Canvassing Board representative appointed to act during
the City of Miami Special Election on September 4, 1997, do, by my signature hereto,
further certify that to the best of my knowledge:
4. On September 4, 1997, commencing at approximately 6 p.m., the Supervisor of
Elections had the tabulating equipment based in the Elections Department at the
Stephen P. Clark Center tested to ascertain that the equipment will correctly count
the precinct and absentee ballot votes cast for all questions.

Certification, in my presence and sight, no ballot card was removed from or added to
any ballot card container, ballot card tray or other segregation of ballots, and no
ballot card was in any manner altered or tampered with by any person, and no
person touched any ballot card container, ballot card tray or ballot card, except a
person authorized to do so pursuant to Section 101.5614, Florida Statutes.
6. At the completion of the precinct and absentee ballot counts, the automatic
tabulating equipment was again tested to ascertain that the equipment correctly
counted the precinct and absentee votes cast for all questions.
7. At the completion of this post -count logic and -accuracy test, all voted ballots with

The City of Miami Special Election (in connection with question
regarding whether the City of Miami shall continue to exist) was

Declaration of Official Results of said election at the meeting
presently scheduled for September 9, 1997.
Our office will be delivering to you, prior to the Commission
meeting, copies of pertinent documents as follows:
(1) City Clerk's Certification and Declaration of Official
results of City of the Miami Special election held on
September 4, 1997;
(2) A Certification from the Metro -Dade County Supervisor of
Elections in connection with the County's Logic and Accuracy
Tests;
(3) A computer printout of the complete precinct -by -precinct
breakdown showing the results of said elections, and
(4) A proposed Resolution officially accepting the City Clerk's
