A RESOLUTION BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE
OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC
HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S EMERGENCY FINDING, WAIVING THE REQUIREMENTS
FOR COMPETITIVE SEALED BIDS AND APPROVING AN INCREASE
IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA AND
BILL GIVENS AND ASSOCIATES, INC., IN THE AMOUNT OF
$4,500, FOR A TOTAL OF $15,500, FOR THE CAPITAL
IMPROVEMENT PROJECT ENTITLED: "MIAMI POLICE DEPARTMENT
PARKING GARAGE STRUCTURAL REPAIRS, B-6225"; ALLOCATING
FUNDS THEREFOR FROM PROJECT NO. 312015, AS
APPROPRIATED BY THE CAPITAL IMPROVEMENTS ORDINANCE
NO. 11337, ADOPTED JANUARY 25, 1995, AS AMENDED.
WHEREAS, a contract dated August 19, 1994, exists between the City of Miami, Florida,
and Bill Givens & Associates, Inc., for the Miami Police Department parking garage structural
repairs, B-6225 ; and
WHEREAS, additional services were required to properly repair the structural cracking in the
existing police parking garage concrete structure; and
WHEREAS, the Director of Public Works and the City Manager recommend the increase in
the contract to cover the cost of the additional work; and
WHEREAS, funding, in the amount of $4,500, is available from Project No. 312015, as
appropriated by the CIP Ordinance No. 11337, adopted January 25, 1995, as amended;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.

Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City
Commission, after a duly advertised public hearing, ratifying, approving and confirming the City
Manager's emergency finding, waiving the requirements for competitive sealed bids, and approving
an increase in the contract between the City of Miami and Bill Givens & Associates, Inc., in the
amount of $4,500, for a total of $15,500, for the Capital Improvement Project entitled "Miami
Police Department Parking Garage Structural Repairs, B-6225", with funds therefor hereby allocated
from Project No. 312015, as appropriated by the Capital Improvements Ordinance No. 11337,
adopted January 25, 1995, as amended.
Section 3. This Resolution shall become effective immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the attached
Resolution authorizing an increase in the contract between Bill Givens & Associates,
Inc. (BGA) and the City of Miami for the project MIAMI POLICE DEPARTMENT (M.P.D.)
PARKING GARAGE STRUCTURAL REPAIRS, B-6225, in the amount of $4,500.00
BACKGROUND
In June 1994, the Police Headquarters Garage experienced structural failures in the
parking decks which necessitated the closing of the garage until an investigation
and interim repairs could be undertaken. The City Manager directed the Public
Works Department to proceed with repairs on an emergency basis. BGA, a
structural engineering firm with extensive experience in concrete garage repairs,
was hired to assist the Public Works Department to investigate the problems and
to help prepare construction repair plans. By Resolution No. 94-427 at the June 9,
1994 meeting, the City Commission authorized the City Manager to expend up to
$250,000 for Police Garage Repairs. Temporary interim repairs were immediately
made so that the garage could reopen, until plans could be prepared for more
extensive permanent repairs. BGA was given a contract in the amount of $11,000
to conduct their investigations and to prepare repair construction plans and
specifications.
While BGA was working on repairing the Police Garage, serious water leaks
developed in the Police Headquarters Building which threatened the City's
computer equipment and the Police communication system. BGA was requested
to include repairs and waterproofing of the Headquarters Building in their scope
of work since the repairs were of a similar nature as the Garage.
The Public Works Department prepared the construction documents and formally
bid out the repairs and exterior restoration of the Headquarters Building, Parking
Garage, and related site structures. Construction contracts for this remedial work
were awarded by the City Commission.

Increase in Contract
MPD Repairs & Restoration
The most extensive work was in the Police Garage because of the necessity to
repair the wide spread structural cracking in the beams, joists and slabs. To
properly identify and repair the structurally critical cracks, BGA's contract was
increased to make detailed inspections and mark each crack that needed special
epoxy repair. Based on the recommendations of the Public Works and Police
Departments, the City Manager approved an increase in BGA's contract by $4500.
and the work was done within the allowances in the construction contract.
The project is now completed and your formal approval is requested of an
increase in the contract with Bill Givens & Assoc., Inc. in the amount of $4500. to
close out the engineer's contract. Funding is available to cover this increase in the
Police Department's CIP Project No. 312015.

Dear Bill:
This letter is to confirm Monday's telephone conference call regarding the structural
inspections of the existing concrete cracks in the structural beams and floor slabs in the
Police Garage Building. Although the technical specifications and the pre -bid
conference indicated that the structural engineer will inspect and mark for epoxy
injection repair sample locations of the structural beam cracks, the contractor advised
us that the identification and marking of the beam cracks throughout the remainder of
the garage is beyond his expertise. He requested that the engineer mark all beam and
joist cracks requiring epoxy injection. In addition, the contractor also requested that
the structural engineer identify the floor slab cracks that require epoxy injection. The
bidding documents indicate that the engineer will only verify the amount of floor slab
cracking that has been repaired.
After reviewing this request and the existing concrete cracking situation, the Public
Works staff has decided it would be in the best interest of the project for the structural
engineer to make the decisions on which concrete cracks need repair and the type of
repair required. The repair of concrete beams, joists, and slab cracks was bid on a unit
price basis. To control repair costs, we believe the engineer should make the decisions
on the specific cracks that need to be epoxy injected.

The Director of Public Works will authorize up to $4,500.00 in additional services for
Bill Givens & Associates, Inc. to make the necessary additional inspections and mark
the concrete cracks requiring repair. In addition, your firm should confirm the
quantity of crack repairs as well as the quality of the repair work. The additional
services will be paid from an increase in your existing contract or paid by the
contractor from the cash allowances in the concrete repair contract, whichever is
appropriate.

A Public Hearing will be held by the Commission of the City of Miami, Florida, on
, 1997, at 11111 IM114, in the City Commission Chambers at City Hall, 3500 Pan
American Drive, Miami, Florida, for the purpose of hearing from any interested
parties affected by the proposed increase in the contract between the City of
Miami and Bill Givens and Associates, Inc. for the project entitled "Miami Police
Department Parking Garage Structural Repairs, B-6225.
All interested persons are invited to appear and may be heard concerning this
proposed increase in contract. Should any person desire to appeal any decision of
the City Commission with respect to any matter considered at this hearing, that
person shall ensure that a verbatim record of the proceedings is made, including
all testimony and evidence upon which any appeal may be based.
