A RESOLUTION, BY A FOUR -FIFTHS (4/5THS)
AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY
COMMISSION, AFTER A DULY ADVERTISED PUBLIC
HEARING, RATIFYING, APPROVING AND CONFIRMING
THE CITY MANAGER'S FINDING OF SOLE SOURCE;
WAIVING THE REQUIREMENTS .FOR COMPETITIVE
BIDDING PROCEDURES AND APPROVING THE
ACQUISITION OF TWO (2) LIFEPAK 11 DIAGNOSTIC
CARDIAC MONITORS AND 13
DEFIBRILLATORS/PACEMAKERS FROM PHYSIO CONTROL
CORPORATION FOR THE DEPARTMENT OF FIRE -
RESCUE; ALLOCATING FUNDS THEREFOR, IN THE
AMOUNT OF $105,075.00, FROM DADE COUNTY EMS
GRANTS PROJECT NO. 104011; AUTHORIZING THE
CITY MANAGER TO INSTRUCT THE CHIEF
PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER
FOR SAID ACQUISITION.
WHEREAS, two cardiac monitors will enable two Miami Fire -
Rescue units currently using less sophisticated equipment to have
12 lead capability and to provide the same standard of care as
the rest of the fleets; and
WHEREAS, the 13 defibrillators/pacemakers will work in
conjunction with existing monitors that have twelve lead
capability; and
WHEREAS, said purchase will allow the monitoring,
defibrillation and pacing of patients suffering from extreme
cardiac distress or cardiac arrest; and

WHEREAS, the purchase of two LifePak 11 Diagnostic Cardiac
Monitors and 13 Defibrillators/Pacemakers are fully compatible
with the LifePak equipment currently in use by the Department of
Fire -Rescue; and
WHEREAS, the City Manager and the Chief Procurement Officer
recommend that the requirements for competitive bidding
procedures be waived and the procurement of said equipment from
Physio Control Corporation as the sole source provider be
approved; and
WHEREAS, funds for said acquisition, in the amount not to
exceed $105,075.00, are available from Dade County EMS Grants
Project No. 104011;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4/5ths) affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, the City Managers finding of sole source is
hereby ratified, approved and confirmed, the requirement for
competitive bidding procedures is hereby waived and the
acquisition of two LifePak 11 Diagnostic Cardiac Monitors and 13
Defibrillators/Pacemakers from Physio Control Corporation for the

Department of Fire -Rescue is hereby approved, with funds
therefor, in an amount not to exceed $105,075.00, hereby
allocated from Dade County EMS Grants Project No. 104011.
Section 3. The City Manager is hereby authorized to
instruct the Chief Procurement Officer to issue a purchase order
for said acquisition.
Section 4. This Resolution shall become effective
immediately upon its adoption.

It is recommended that an Award of Bid be made and a Resolution be passed,
permitting the Department of Fire -Rescue to purchase LIFEPAK 11 Diagnostic
Cardiac Monitors and Defibrillators/Pacemakers from Physio Control Corporation, a
non-local/publicly owned, sole source vendor located at 11811 Willow Road NE,
Redmond, WA 98073, in the amount of $105,075.00. Funds for this purchase will be
allocated from the Department of Fire -Rescue EMS County Grant, Project No.
104011.
BACKGROUND:
The two Cardiac Monitors will enable two Miami Fire -Rescue units currently using
less sophisticated equipment to have 12 lead capacity and provide the same standard of
care as the rest of the fleet. The 13 Defibrillator/Pacemakers will work in conjunction
with existing monitors that have twelve lead capability and will allow the monitoring,
defibrillation and pacing of patients suffering from extreme cardiac distress or cardiac
arrest.

An investigation was conducted by staff in order to determine whether Physio Control Corporation, a non-minority/non -
local vendor located at 11811 Willow Road NE, Redmond, Wa. 98073, is the sole source provider for the acquisition of
LIFEPAK 11 Diagnostic Cardiac Monitors, and Defibrillators/Pacemakers for the Department of Fire -Rescue.
The City of Miami has been purchasing various medical equipment from Physio Control Corporation as a sole source
provider since at least 1984, and has maintained a sole source maintenance and service agreement with that firm to maintain
said equipment during this period of time. The Department of Fire -Rescue is now seeking to purchase 2 LIFEPAK 11
Diagnostic Cardiac Monitors, and 13 Defibrillators/Pacemakers. The two (2) Cardiac Monitors will enable two Fire -Rescue
units currently using less sophisticated equipment to have 12 lead capacity and to provide the same standard of care as the
rest of the fleet. The 13 Defibrillators/Pacemakers will work in conjunction with the existing monitors that have 12 lead
capability, and will allow the monitoring, defibrillation, and pacing of patients suffering from extreme cardiac distress or
cardiac arrest. The purchase of these new items will work in conjunction with the equipment previously acquired from
Physio Control as a sole source.
According to Physio Control, they are the manufacturer and sole source provider for the LIFEPAK 11 Diagnostic Cardiac
Monitor, and the LIFEPAK I 1 Defibrillator/Pacemaker. No other defibrillator/pacemaker is compatible with the LIFEPAK
I 1 Diagnostic cardiac monitor which is currently being used by the Department of Fire -Rescue. As a result, Physio Control is
the sole source provider for the acquisition of these additional items as they are fully compatible with the existing equipment
being used by the department for many years.
The proposed cost for the acquisition of 2 LIFEPAK l l Diagnostic Cardiac Monitors, and 13 Defibrillators/Pacemakers is in
the amount of $105,075.00. Funds for the purchase of these items will be allocated from the Department of Fire-R.escue
EMS County Grant, Project No. 104011.
Therefore, I am recommending that the requirements for competitive bidding be waived and the above findings be approved:
that Physio Control Corporation, a non-minority/non local vendor located at 11811 Willow Road NE, Redmond, Wa. 98073
is the sole source provider for the provision of LIFEPAK 11 Diagnostic Cardiac Monitors, and Defibrillators/Pacemakers, on
behalf of the Department of Fire -Rescue.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the Commission of the City of Miami, Florida on
, 1997 at 9:00 a.m. in the Commission Chambers at
City Hall, 3500 Pan American.Drive, Miami, Florida for the purpose of considering a
waiver of the requirements of obtaining sealed bids for the engagement of Physio
Control Corporation, subject to a finding of sole source by the Chief Procurement
Officer, confirmed by the City Manager, to purchase 2 LifePak 11 Diagnostic Cardiac
Monitors and 13 Defibrillators/Pacemakers for the Department of Fire -Rescue at a
total proposed cost of $105,075.00.
All interested persons are invited to appear and may be heard concerning this matter.
Should any person desire to appeal any decision of the City Commission with respect
to any matter considered at this hearing, that person shall ensure that a verbatim
