AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY
COMMISSION, AFTER A DULY ADVERTISED PUBLIC
HEARING,. RATIFYING, APPROVING AND CONFIRMING
THE CITY MANAGER'S FINDING OF SOLE SOURCE,
WAIVING THE REQUIREMENTS FOR COMPETITIVE
SEALED BIDDING PROCEDURES AND APPROVING THE
ACQUISITION OF COMPUTER SOFTWARE
MAINTENANCE AND SUPPORT SERVICES FROM
ATTACHMATE, THE SOLE SOURCE PROVIDER, FOR
THE.INFORMATION TECHNOLOGY DEPARTMENT, AT A
FIRST YEAR COST NOT TO EXCEED $29,000, WITH
THE OPTION TO EXTEND FOR TWO (2) ADDITIONAL
ONE (1) YEAR PERIODS, WITH YEARLY MAINTENANCE
COST INCREASES NOT TO EXCEED 4% PER UNIT;
ALLOCATING FUNDS THEREFOR FROM ACCOUNT NO.
001000.261301.6.670; AUTHORIZING THE CITY
MANAGER TO INSTRUCT THE CHIEF PROCUREMENT
OFFICER TO ISSUE PURCHASE ORDER(S) FOR SAID
PURPOSE.
WHEREAS, terminal emulation is required for PC connectivity to the mainframe and is
provided by InfoConnect and Cadet.; and
WHEREAS, the Netwizard allows us to remotely install new software releases to multiple
PC's simultaneously, thus saving limited City resources; and
WHEREAS, InfoConnect, Cadet and Netwizard are proprietary products provided by
Attachmate; and
WHEREAS, to maintain PC connectivity and up-to-date software releases, it is necessary
to receive product support from Attachmate, the sole source provider; and

Resolution NO.
WHEREAS, the City Manager and the Chief Procurement Officer recommend that the
requirement for competitive formal sealed bidding procedures be waived and the procurement
from Attachmate be approved for an initial one (1) year period with the option to extend for
two (2) additional one (1) year periods, with yearly maintenance cost increases, based on total
number of units covered, not to exceed 4 percent;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in the
Section.
Section 2. By a four4ifths (4/5ths) affirmative vote of the members of the City
Commission, after a duly advertised public hearing, ratifying, approving, and confirming the
City Manager's finding of sole source, waiving the requirements for competitive sealed
bidding procedures, and approving the acquisition of computer software maintenance and
support services from Attachmate, the sole source provider, for the Information Technology
Department, at a first year cost not to exceed $29,000, with the option to extend for two (2)
additional one (1) year periods, with yearly maintenance cost increases not to exceed 4% per
unit, with funds therefor hereby allocated from Account No. 00 1000. 261301.6.670.
Section 3. The City Manager is hereby authorized to instruct the Chief Procurement
Officer to issue purchase order(s) for said services.
Section 4. This Resolution shall become effective immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the attached resolution by
a four -fifths (4/5ths) affirmative vote of the members of the City Commission, after a
duly advertised public hearing, ratifying, approving and confirming the City Manager's
Finding of Sole Source, waiving the requirements for competitive sealed bids and
authorizing the acquisition of maintenance and support services from Attachmate, a non -
local vendor, at a proposed initial cost not to exceed $29,000 for the first year. The
option to extend the product support for two (2) additional one (1) year periods with
yearly maintenance unit cost increases based on total number of licenses covered and cost
increase per license limited to no more than 4% per year is also respectfully

The Information Technology Department has determined that terminal emulation is
required for PC connectivity to the mainframe. This terminal emulation is provided by
Attachmate through it's proprietary products of InfoConnect, Cadet and Netwizard. In
order to maintain PC connectivity and up-to-date software releases, it is necessary to
receive product support from Attachmate, as such service is proprietary and can only be
obtained from Attachmate.

An investigation was conducted to determine whether Attachmate, a non-minority/non-local vendor located at 8230
Montgomery Road, Cincinnati, Ohio 45236 is'the sole source provider for the continuation of existing software -related
maintenance and support service for the City's Department of Information Technology currently being provided by
Attachmate. The department is seeking the extension of this service for one (1) year, with the option to extend for two (2)
additional one (1) year periods.
Contact was made with Mr. Aldo Stancato, Director of the Department of Information Technology. According to Mr.
Stancato, Attachmate remains a sole source provider for the provision of software -related maintenance and support services
on its own proprietary products, such as InfoConnect, Cadet, and Netwizard, which is utilized by the City. Terminal
emulation is required for PC connectivity to the mainframe, and this terminal emulation is solely provided via these
proprietary products. Attachmate has been a consistent leader in providing the highest level of support to its customers for
more than 14 years, and the City remains satisfied with the Attachmate product and recommends the continuation of
software -related maintenance and support services.
Additionally, contact with Attachmate revealed that Attachmate does not use resellers for these services, as it would be up to
the reseller to keep .the customer updated with any new release. As a result, these services are sold directly from Attachmate,
thereby allowing the customers to receive new software releases as part of this service.
The proposed cost for Attachmate software maintenance and support services is not to exceed $29,000.00 for the initial year.
This initial cost includes the maintenance on all of the current licenses purchased for the City of Miami, and funding is
available from Account Code No. 001000.261301.6.670. Any increase in the cost of maintenance is contingent on the; total
number of licenses for the year, and the per unit cost shall not to exceed 4% in any one year. All increases are subject to
negotiation with the City for approval of any requested increases. There shall be no increase in said cost during the initial
year of this agreement.
Therefore, I am recommending that the requirements for competitive bidding be waived and the above findings be approved:
that Attachmate, a non-minority/non-local vendor located at 8230 Montgomery Road, Cincinnati, Ohio 45236, is the sole
source provider for the continuation of the existing software -related maintenance and support services to the City's
Department of Information Technology.

The City of Miami purchased Attachmate's terminal emulation software under
Resolution 97-396 on June 9, 1997 for the purpose of allowing PC's to connect to the
mainframe and exchange data between the mainframe and the microcomputers. In
addition, Attachment's Netwizard product allows us to remotely install software to
multiple PC's simultaneously.
For more than 14 years, Attachmate has been a consistent leader in providing the highest
level of support to its customers. In order to continue to operate from the PC platform
with these products, it is requested that authorization be provided to purchase .
maintenance and support services from Attachmate for their products. This maintenance
is proprietary and can be obtained only from Attachmate.
The annual cost for maintenance is based on the number of licenses of the above
referenced products.. The initial cost not to exceed $29,000 for the first year includes
maintenance on all the current licenses purchased for the City of Miami. We are also
requesting an option to extend the maintenance for two (2) additional one (1) year periods
to cover the current number of licenses, as well as any additional licenses. The cost of
maintenance is dependent on the total number of licenses for the year with the unit cost
not to exceed 4% in any one year. Funding is available from Account Code No.
001000.2613 01.6.670.

Dear Aldo,
I am respectfully submitting pricing for Upgrade Maintenance and Support for the current
installation base of InfoConnect software.
According to our records the City of Miami has 375 copies of Cadet/STS without
Filexpress, ~
82 copies of Cadet/STS with Filexpress, 50 copies of full Infoconnect with Filexpress.
To summarize the conference call, Attachmate will replace the 500 copies of Netwizazd
the city already has for the current version that supports Netwizard as a service with NT
3.51/4.0 (Netwizard version 4.0) when it is available to ship.
Also, we will put the current install base of Cadet on upgrade maintenance to make sure
that the city stays current without having to pay the initial upgrade charge.
The cost to put Cadet/OTS on maintenance will be $31.50 a copy.
The cost for putting the 50 copies of full blown Infoconnect with Filexpress is $74.25 a
copy.
The cost for putting Netwizard Plus on maintenance is $9.90 a copy. (part #
127533.UM 1 C).
The supportware. information is enclosed for you to choose. Attachmate offers Enhanced,
Enhanced Plus and Elite. The cost for Enhanced is $1995 annually. The cost for
Enhanced Plus is $5000 annually and the cost for Elite is $20,000 annually. Please look
over the back of the brochure to see what is included in each plan.

Another issue we discussed was regarding Windows 95. While on upgrade maintenance,
if there is an operating change (i.e. Dos to Windows, Win 3.1 to Win 95) there is a small
upgrade fee. If you are currently on upgrade maintenance you would receive the normal
discount for upgrading plus another 15% off. You would receive all upgrades for the
products in the same family. Example: if you are on Win 3.1 you would receive all
upgrades for Windows 3.1, not Windows 95. That is the small upgrade fee.

NOTICE TO THE PUBLIC
A public hearing will be held by the Commission of the
City of Miami, Florida, on Tuesday, September 9, 1997, at
9:00 AM, in the City Commission Chambers at City Hall,
3500 Pan American Drive, Miami, Florida, for the purpose
of considering a waiver of the requirement of obtaining
sealed competitive bids for the maintenance and support
services of InfoConnect, Cadet and Netwizard programs for
the City of Miami solely created and offered by Attachmate
at a proposed initial cost not to exceed $29,000.
Inquiries from other potential sources of supply who feel
that they might be able to satisfy the City's requirements in
this acquisition may contact. Aldo Stancato, Information

All interested persons are invited to appear and may be
heard concerning such proposed waiver and purchase. The
hearing will be held at the time and place specified above.
Should any person desire to appeal any decision of the City
Commission with respect to any matter considered at this

the proceeding is made, including all testimony and
evidence upon which any appeal may be based.
