A RESOLUTION, WITH ATTACHMENT (S), AFFIRMING
THE DECISION OF THE ZONING BOARD THEREBY
GRANTING A SPECIAL EXCEPTION FROM THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA,
ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT
REGULATIONS, TO PERMIT A COMMUNITY BASED
RESIDENTIAL FACILITY, ADULT CONGREGATE LIVING
FACILITY, FOR FORTY-SIX (46) RESIDENTS, WITH
A REDUCTION IN THE REQUIRED PARKING SPACES;
ZONED R-3 MULTIFAMILY MEDIUM -DENSITY
RESIDENTIAL, FOR THE PROPERTY LOCATED AT
APPROXIMATELY 2333 NORTHWEST 22ND AVENUE,
MIAMI, FLORIDA; MIAMI, FLORIDA, SUBJECT TO
(1) FINAL APPROVAL OF THE ARCHITECTURAL PLANS
BY THE DEPARTMENT OF PLANNING AND
DEVELOPMENT, (2) A TIME LIMITATION OF TWELVE
(12) MONTHS IN WHICH A BUILDING PERMIT MUST
BE OBTAINED, AND (3) THE SUBMITTAL OF A
COVENANT, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY.
WHEREAS, the Miami Zoning Board at its meeting of
July 7, 1997, Item No. 7, adopted Resolution No. ZB 73-97 by a
six to zero (6-0) vote, granting a special exception requiring
City Commission approval as hereinafter set forth; and
WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, requires City Commission approval
of the special exception as hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter, finds the application for special exception does

as amended, and deems it advisable and in the best interest of
the general welfare of the City of Miami and its inhabitants to

Attorney; -
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The decision of the Zoning Board to grant a
Special Exception from Ordinance No. 11000, as amended, the
Zoning Ordinance of the City of Miami, Florida, Article 4,
Section 401, Schedule of District Regulations, to permit a
community based residential facility, adult congregate living
facility, for forty-six (46) residents with a reduction of seven
(7) of the required nine (9) parking spaces; zoned R-3
Multifamily Medium -density Residential for the property located
at approximately 2333 Northwest 22nd Avenue, Miami, Florida, more
particularly legally described in Exhibit "A" attached hereto and
made a part hereof, subject to (1) final approval of the
architectural plans as approved by the Department of Planning and
Development, (2) a time limitation of twelve (12) months in which
a building permit must be obtained, and (3) submittal of a
covenantl1, in a form acceptable to the City Attorney, is hereby
affirmed and the Special Exception is hereby granted.
l� The herein authorization is further subject to compliance
with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

Section 3. This Resolution shall become effective
immediately upon its adoption.

ANALYSIS FOR SPECIAL EXCEPTION
2333 NW 22°d Avenue.
CASE NO. 1997-0030
Pursuant to Section 401 of Ordinance 11000, as amended, the Zoning Ordinance of the
City of Miami, Florida, the subject proposal to allow a community based residential
facility with fifty (50) clients in the R-3 Multifamily Medium -Density Residential Zoning
District has been reviewed as follows:
NOTE: The Special Exception for the Community Based Residential Facility
requires City Commission approval.
Per Section 934.2.2.5., this Special Exception also encompasses a reduction of
seven (7) of the required off-street parking spaces (therefore resulting in nine
(9) spaces where sixteen (lb) are required).
This Special Exception is also subject to a covenant running with the land
providing that interior space for two residents per room shall be permitted
only if the clients are either related by blood or marriage or over the age of
eighty (80).
The following findings have been made:
• It is found that the proposed use could be beneficial to the area in providing a needed
service to the community and creating new employment opportunities.
• It is found that the design of'the proposed facility is in scale and character with the
surrounding area.
• It is found that the submitted plans depict the required landscaping and open space to
serve the residents of the proposed project; it is also found that the applicant has
adequately conserved a majority of the trees on -site, which in this particular case
involves a substantial number of mature species.
• It is found that the requested reduction in parking spaces may have an overall adverse
impact on the neighborhood and adjacent streets. This situation could be mitigated by
a reduction in the amount of clients in conjunction with a condition which specifies
that the proposed facility shall be for elderly residents only.

• It is found that pursuant to the !ittached memorandum from the Building and Zoning
Department, the proposed plans do not comply with the South Florida Building Code;
and in addition, with respects to the interior layout, the proposed facility is
overcrowded and must be reconfigured to comply with code and to provide a greater
interior recreation area for the facility residents.
Based on these findings, the Department of Planning and Development is
recommending approval of the proposed facility with the following conditions:
1. The covenant required for this project (referenced above) shall be submitted in a
form acceptable to the City Attorney prior to the issuance of any building
permits.
2. The proposed facility shall be for elderly clients only, any change to another type
of CBRF shall be subject to review and approval by the Zoning Board.
3. The proposed facility shall reduce the overall capacity of the facility from fifty
(50) residents to thirty-five (35) residents so that the proposed plans can be
reconfigured in a way which will allow for a minimum of eighty (80) square feet
(clear) per resident and a larger indoor recreation area than depicted in the
submitted plans. The final plans shall comply with applicable sections of the
South Florida Building Code and shall require review and approval by the
Planning Department prior to the issuance of any building permits.

Within the City generally, or .within certain zoning districts,
certain structures, uses, and/or occupancies specified in this
ordinance are of a nature requiring special and intensive review
to determine whether or not they should be permitted in specific
locations, and it so, the special limitations, conditions, and
safeguards which should be applied as reasonably necessary to
promote the general purposes of this Zoning Ordinance, and, in
particular, to protect adjoining properties and the neighborhood
from avoidable potentially adverse effects. It is further
intended that the expertise and judgement of the Zoning Board be
exercised in making such determinations, in accordance with the
rules, considerations and limitations relating to Special
Exceptions. (See.Article 16)
Formal public notice and hearing is mandatory for Special
Exceptions. The Zoning Board shall be solely responsible for
determinations on applications for Special Exceptions. All
applications shall be referred to the director of the Department
of Planning, Building and Zoning for his recam ations and the
director shall make any further referrals required by these
regulations.
