HomeMy WebLinkAboutR-97-0537J-97-520 7/21/97 RESOLUTION NO. 9 7— 537 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE NEGOTIATED AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN AN AMOUNT NOT TO EXCEED $696,000 WITH SPILLIS, CANDELLA & PARTNERS, TO PROVIDE PROFESSIONAL AVIATION PLANNING SERVICES AS PART 1 AND ARCHITECTURAL, ENGINEERING SERVICES AS PART 2, FOR THE WATSON ISLAND AVIATION and VISITORS CENTER PROJECT, WITH PART 2 OF THE AGREEMENT BEING CONTINGENT UPON THE RECEIPT OF A $352,500 CONTRIBUTION FROM THE GREATER MIAMI CONVENTION AND VISITORS BUREAU; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID CONTRIBUTION . FROM THE GREATER MIAMI CONVENTION AND VISITORS BUREAU UPON RECEIPT AND TO EXECUTE THE NECESSARY DOCUMENTS FOR SAID ACCEPTANCE; ALLOCATING FUNDS THEREFOR FROM CAPITAL IMPROVEMENT PROJECT NO. 344101, ENTITLED "WATSON ISLAND AVIATION and VISITORS CENTER PROJECT". WHEREAS, on February 29, 1996, the City Commission; pursuant to Resolution No. 96-129,,approved the continuation of the Joint Participation Agreement with the State of Florida Department of Transportation, authorizing the City Manager to accept additional funds in the amount of $352,500, for design and construction documents for the Watson Island Aviation and Visitors Project; and WHEREAS, on April 25, 1996, the City Commission, pursuant to Resolution No. 96-281, directed the City Manager to negotiate an CM COMUSSION TING OF JUL 2 4 1997 R,801ution No. 3'� interlocal agreement for the purpose of developing a regional visitors center and associated uses; and WHEREAS, the City of Miami, pursuant to Resolution No. 97-402 adopted June 9, 1997, designated as a Category IBI Project, the acquisition of planning and design services, including preparation of construction documents and construction administration, for the Watson Island Aviation Center Project; and WHEREAS, the selection procedures were performed in accordance with the Consultants Competitive Negotiation Act as defined in F.S. Section 287.055 and City of Miami Ordinance No. 9572 which appears as Section 18.81 of the Code of the City of Miami; and WHEREAS, on July 10, 1997, the City Commission, pursuant to Resolution No. 97-476, approved the findings of the Consultant Selection Committee as to the most qualified teams, in rank order, to provide the required professional services for the Watson Island Aviation Center Project; and WHEREAS, Resolution No. 97-476 further authorized the City Manager to undertake negotiations with the most qualified teams in rank order until he arrives at an agreement which is competitive and reasonable; and WHEREAS, an agreement between the City of Miami and Spillis, Candella and Partners, has been negotiated in a fair and reasonable manner and is in the best interest of the parties and provides for compensation to the firm for professional services in the total amount of $696,000; and - 2 - 97- 537 WHEREAS, said agreement consists of professional aviation planning feasibility services as with fees of $85,000, as Part 1 of the agreement and architectural, engineering services as Part 2 of the agreement, totaling $696,000, with fees including Reimbursable Expenses totaling $7,500, and Contingency totaling $20,000; and WHEREAS, funds in the total amount of $715,500, are available from the Capital Improvement Project entitled "Watson Island Aviation and Visitors Center Facility," Project No. 344101, as follows: $352,500 `as a grant from the Florida Department of Transportation, $10,500 form Special Revenue Fund No. 110059, and $352,500 as a contribution from the Greater Miami Convention and Visitors Bureau as the" required.match from the Florida Department of Transportation Grant; and WHEREAS, the funding agreement with the Greater Miami Convention and Visitors Bureau is being negotiated and it will be necessary for the City Manager to accept said funds and execute the negotiated agreement upon receipt; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fullly set forth in this Section. - 3 - Section 2. The City Manager is hereby authorized1l to execute a negotiated Agreement in a form acceptable to the City Manager, in an amount not to exceed $696,000, with the firm of Spillis, Candella and Partners, for the Watson Island Aviation and Visitors Center Project, to provide professional aviation planning services as Part 1 of the agreement, and professional architectural and engineering services (design, preparation of construction documents and construction administration) as Part 2 of the agreement, with Part 2 of the agreement being contingent upon the receipt of a $352,500 contribution from the Greater Miami Convention and Visitors Bureau. Section 3. The City Manager is" hereby authorizedl/ to accept said contribution from the Greater Miami Convention and Visitors Bureau upon receipt and execute the necessary documents, in a form acceptable to the City Attorney, for said acceptance. Section 4. Funds in an amount not to exceed $696,000 from Capital Improvement Project No. 344101, entitled "Watson Island Aviation and visitors Center Project", are hereby allocated. Section 5. This Resolution shall become effective immediately upon its adoption. 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. - 4 - E • PASSED AND ADOPTED this 24th ATTEST. Authorization to Execute Agreement /Watson Island Aviation Center Project REFERENCES: Resolution; Agreement ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached Resolution authorizing the City Manager to execute the negotiated agreement, in a form acceptable to the city attorney, in an amount not to exceed $ 696,000 with Spillis, Candella & Partners. The Agreement is to provide professional aviation planning services as part 1 and architectural, engineering services as part 2, for the Watson Island Aviation & Visitors Center Project. The part 2 of the contract is contingent upon the receipt of a $352,500 contribution from the Greater Miami Convention And Visitors Bureau. Additionally, the legislation would authorize the City Manager to accept the contribution from Greater Miami Convention and Visitors Bureau upon receipt and to execute the necessary documents for said acceptance. This Resolution will allocate funds from the Capital Improvement Project No. 334401, entitled "Watson Island Aviation & Visitors Center Project" to fund the project. BACKGROUND: The Department of Planning and Development, with the City Manager, has negotiated an agreement between the City of Miami and Spillis, Candella & Partners for' professional architectural, engineering and aviation planning services for the Watson Island Aviation Center Project, including design, feasibility planning, and construction documents and administration. On June 9, 1997 by .Resolution No. 97-402, the City Commission designated this as a Category B Project, for the acquisition of architectural, engineering and aviation planning services. The selection procedures were performed in accordance with the consultants competitive selection process as defined in Section 18.81 of the Code of the City of Miami and in F.S. Chapter 287. Later, Resolution No. 97-476, adopted July 10, 1997, approved the findings of the Competitive Selection Committee as to the most qualified teams, in rank order, to provide the required professional services. As further directed by that Resolution, the City Manager conducted negotiations with the most qualified team to arrive at an agreement, which is competitive and reasonable. The agreement stipulates that Spillis, Candella & Partners will provide all required professional services for a fee not to exceed $696,000. The contract is broken into 2 parts. The 97 - 537 1 Honorable Mayor and Members of the City Commission Page Two first part is the aviation feasibility plan at a fee of $85,000 and the part 2 is architectural & engineering services with a fee of $611,000. Funding of $715,500 is available to cover the cost of these services from the new Capital Improvement Project entitled "Watson Island Aviation & Visitors Center Facility", established by Ordinance, adopted July 24, 1997, and identified as Project No. 334401. The continuation of the contract part 2 is subject to the receipt a $350,000 contribution from the Greater Miami Convention and Visitors Bureau. At this time we also request that the City Manager be authorized to accept said funds upon receipt so that the project may continue uninterrupted. Attachments: Proposed Resolution 2' 7- 537
