HomeMy WebLinkAboutR-97-0536J-97-513 07/17/97 RESOLUTION NO. 97- 536 A RESOLUTION DESIGNATING THE MIAMI BROWNFIELDS REDEVELOPMENT PROJECT AS A CATEGORY "B" PROJECT FOR THE. PURPOSE OF ACQUIRING PROFESSIONAL ENVIRONMENTAL ENGINEERING AND CONSULTING SERVICES; APPOINTING A CERTIFICATION COMMITTEE OF NOT LESS THAN THREE MEMBERS WHOSE PROFESSIONAL EXPERTISE IS IN THE AREA OF ENGINEERING, AND APPOINTING JACK LUFT, DIRECTOR OF PLANNING AND DEVELOPMENT OR HIS DESIGNEE, AS CHAIRPERSON OF THE COMPETITIVE SELECTION COMMITTEE, ALL IN ACCORDANCE CITY OF MIAMI CODE SECTION 18-81 AND FLORIDA STATUTES CHAPTER 287. WHEREAS, pursuant to Resolution No. 96-710, the City accepted a grant in the amount of $100,000, from the U.S. Environmental Protection Agency ("EPA") for a Regional Brownfields Demonstration Project for the purpose of rehabilitating certain parcels of land in the Wynwood area to make them suitable for commercial/industrial development; and WHEREAS, the State of Florida adopted the Brownfields Redevelopment Act ("Act") during its last session to, in part, provide similar incentives in Florida for the rehabilitation and economic redevelopment of brownfields; and WHEREAS, the Act provides grants in the amount of $500,000.00 to each EPA Demonstration Project approved prior to May 1, 1997, including that of the City of Miami; and CONMMSICH METING OF JUL 2 4 1997 Resolution No. 97- 536 WHEREAS, a major focus of the City's Project will be to provide environmental site ,assessments to determine the steps necessary to overcome the environmental obstacles limiting redevelopment; and WHEREAS, work under this project will include, but is not limited to: Phase I Environmental Site Assessments ("ESA"); Phase II ESA activities including surface and subsurface soil and groundwater sampling, permanent monitor well installations, surveying, subsurface geophysics, and laboratory analysis; Risk Based Corrective Action; site remediation activities including drum removal and disposal, soil excavation and disposal, free - product removal and disposal and groundwater treatment; and Final Phase I and II ESA Reports; and WHEREAS, such work will require professional consulting services in the field of environmental engineering; and WHEREAS, Section 18-81 of the Code of the City of Miami provides regulations for the acquisition of professional services; and WHEREAS, the City Manager recommends that the City of Miami Brownfields Redevelopment Project be designated a Category "B" Project in accordance with said provisions of the City Code; and WHEREAS, City Code Section 18-81 also requires that the City Commission establish a certification committee of not less than three members; and WHEREAS, the recommendations for appointment of professional engineers to the certification committee are: James Kay, Len Helmers, and Wilbur Mayorga; and - 2 - 97- 536 WHEREAS, the City Manager recommends that Jack Luft, Director of Planning and Development, or his designee, be appointed as Chairperson of the competitive selection committee; and WHEREAS, the City Manager will conduct a competitive selection process as required and return to the City Commission at a later date with the results of said process; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City of Miami Brownfields Redevelopment Project is hereby designated a Category "B" Project for the acquisition of professional environmental engineering and consulting services in accordance with the provisions of City of Miami Code Section 18-81 and Florida Statutes Chapter 287. Section 3. The following individuals are hereby named to the certification committee for said project: James Kay, P.E., Len Helmers, P.E., and Wilbur Mayorga, P.E. Section 4. Jack Luft, Director of the Department of Planning and Development, or his designee, is hereby appointed as Chairperson of the competitive selection committee for said project. Section 5. BACKGROUND The Department of Planning and Development has prepared the attached Resolution. Pursuant to Resolution 96-710, the City accepted a grant of $100,000 from `the U.S. Environmental Protection Agency ("EPA") for a Regional Brownfields Demonstration Project for the purpose of rehabilitating certain parcels of land in the Wynwood area making them suitable for commercial/industrial development. In the. State of Florida's Brownfields Redevelopment Act of 1997, the Legislature determined that it would be beneficial to provide incentives in Florida, similar to those of the U.S. EPA Brownfield Demonstration Projects for the rehabilitation and redevelopment of brownfields. Specifically, the State has authorized grants in the amount of $500,000 per pilot for each EPA brownfield pilot project approved prior to May 1, 1997. A major focus of the City project will be to determine the extent and steps necessary to overcome the environmental obstacles limiting redevelopment of property in Wynwood and surrounding areas. To accomplish this project, the City requires professional environmental engineering and consulting services. Necessary work will include, but is not limited to: Phase I Environmental Site Assessment (ESA); Phase II ESA Activities including surface and subsurface soil and groundwater sampling, permanent monitor well installations, surveying, subsurface geophysics, and laboratory analysis; Risk Based Corrective Action; site remediation activities, including, drum removal and disposal, soil excavation and disposal, free -product removal and disposal, and groundwater treatment; and Final Phase I and II ESA Reports. In accordance with the provisions of City Code Section 18-81, the City must designate the (Miami Brownfields Redevelopment Project) a category `B" project for the acquisition of the required professional services. The committee must be comprised of not less thanthree members with qualifications in the field(s) involved, which shall certify the qualifications of professionals responding to the Request for Qualifications ("RFQ"). Recommendations for the certification committee members are James Kay, P.E., Len Helmers, P.E., and Wilbur Mayorga, P.E. The City Commission must also appoint the Chairperson of the competitive selection committee and the City Manager recommends that Jack Luft, Director of Planning and Development, or designee, be named Chair. With the approval of the attached legislation, the Administration will conduct the prescribed competitive selection process and will later request the City Commission to approve .the names of the most qualified providers in rank order and to authorize contract negotiations. 536
