A RESOLUTION APPROVING, IN PRINCIPLE, THE USE
OF CITY -OWNED PROPERTY, KNOWN AS THE FORMER
PIONEER CLUB SITE AND/OR THE FUTURE LATIN
QUARTER SPECIALTY CENTER SITE, MORE
PARTICULARLY DESCRIBED HEREIN, BY BENSIDOUN
USA, INC. FOR THE PURPOSE OF CONDUCTING A
TEMPORARY OPEN-AIR PUBLIC MARKET ON A TRIAL
BASIS FOR A PERIOD OF ONE YEAR; FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE A
REVOCABLE LICENSE FOR SUCH PURPOSE TO BE
PRESENTED TO THE CITY COMMISSION FOR
APPROVAL, MODIFICATION OR REJECTION.
WHEREAS, the City of Miami owns certain real estate,
formerly occupied by the Pioneer Club, which contains
approximately 0.72 acres and is located at 250 NW North River
Drive, Miami, Florida, and another parcel of real estate
presently identified as the future home of the Latin Quarter
Specialty Center Site, which contains approximately 36,900 square
feet and is located at 1433-75 SW Eighth Street Miami, Florida;
and
WHEREAS, although said properties are the subject of future
redevelopment, they are presently underutilized and will continue
as such for more than one year; and

WHEREAS, Bensidoun USA, Inc., a large public market operator
in France, has approached the City and offered to conduct a
temporary, open air market at the properties 2 to 4 days per
week, on a trial basis; and
WHEREAS, the City Manager and the Director of the Department
of Planning and Development recommend that the City analyze
Bensidoun's proposal as a source of potential revenue to the
City; and
WHEREAS, in determining the most appropriate site or sites
for the proposed market, the input of local area merchants will
be considered;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are incorporated herein as if fully
set forth in this Section.
Section 2. The use of City -owned real property known as the
former Pioneer Club located at 250 NW North River Drive, Miami,
Florida, consisting of approximately 0.72 acres, and/or the
parcel presently identified as the future home of the Latin
Quarter Specialty Center Site located at 1433-75 SW Eighth Street
Miami, Florida, consisting of approximately 36,900 square feet by
Bensidoun USA, Inc. for the purpose of conducting a temporary
open-air public market on a trial basis for a period of
approximately one year, is hereby approved in principle.

Section 3. The City Manager is hereby authorized to
negotiate a Revocable License, or other form of agreement
acceptable to the City Attorney, to be presented to the City
Commission for approval, modification or rejection.
Section 4. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the attached Resolution
approving, in principle, the use of the City -owned property known the former Pioneer
Club, and/or the future Latin Quarter Specialty Center site, by Bensidoun USA, Inc. for
the purpose of conducting a temporary open-air public market on a trial basis for one
year. (Final approval of the sites would rest with the City Commission after meetings with
area merchant associations.) The legislation would further authorize the City Manager to
negotiate and prepare a revocable license to be issued to said . corporation upon
subsequent authorization of the City Commission.
The Department of Planning and Development has prepared the attached documentation.
The City owns two underutilized parcels of land: the former Pioneer Club property, located
at 250 NW North River Drive, and the future Latin Quarter Specialty Center site, located
at 1433-75 SW Eighth Street. Although both properties are the subject of future
redevelopment plans, they are presently unused and will continue as such for some time
while development plans are finalized and potential developers and financing are
identified. Bensidoun USA, Inc., a large public market operator in France, has
approached the City and offered to conduct temporary, open air markets on both
properties regularly, 2 to 4 days per week, on a trial basis.
The City Manager and the Director of Planning and Development recommend that this
use be explored as potential revenue to the City. In determining the most appropriate
site or sites for the proposed market, the input of local area merchants will be
considered, through meetings scheduled with the Latin Chamber of Commerce and
other affected associations and individuals. With your authorization, we would
commence negotiations to receive a fair return for the use of the property, along with all
necessary safeguards to protect the health and welfare of residents. The resulting
Revocable License, or other appropriate legal instrument, would then be submitted for
final approval of the City Commission.
At a later date, we may return to the City Commission for consideration of other sites for
this purpose. Should such markets become successful, we would conduct a competitive
process to identify one or more market operators to enter into long-term agreements for
use of City property.
