A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE A PERMIT AGREEMENT, IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, WITH METRO-DADE COUNTY FOR
THE LEASING OF 494 SQUARE FEET OF OFFICE SPACE
LOCATED AT CULMER NEIGHBORHOOD SERVICE CENTER,
1600 N.W. 3RD AVENUE,. MIAMI, FLORIDA, FOR THE
OVERTOWN NEIGHBORHOOD PARTNERSHIPS PROGRAM
(ONP), FOR A TERM OF SIX (6) MONTHS AT A RATE OF
$11.00 PER SQUARE FOOT, FOR A MONTHLY RENT OF
$452.83, AND A TOTAL SIX MONTH AMOUNT OF
$2717.00; ALLOCATING FUNDS THEREFOR FROM THE
ONP'S BUDGET, INDEX CODE NO. 450243, PROJECT NO.
145005.
WHEREAS, THE City of Miami's Overtown Neighborhood Partnerships Program
(ONP) is in need of space at a central location from which it may operate; and
WHEREAS, a move from ONP's current location at the historic D.A. Dorsey House
would prove to be more costly and interfere with the smooth delivery of services to the
community; and
WHEREAS, funds are available from the ONP budget, Index Code No. 450243,
Project No. 145005, to pay for said space at the Metro -Dade Culmer Service Center;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized' to execute a permit
agreement, in a form acceptable to the City Attorney, with Metro -Dade County, for the
leasing of 494 square feet of office space located at Culmer Neighborhood Service Center,
1600 N.W. 3rd Avenue, Miami, Florida, for the Overtown Neighborhood Partnerships
Program, for a term of six (6) months, at a rate of $1 1.00 per square foot, for a monthly
rent of $452.83, and a total six (6) month amount of $2,717.00, including utilities, with
funds therefor hereby allocated from the ONP budget, Index Code No. 450243, Project
NO. 145005.
Section 3. This Resolution shall become effective immediately upon its adoption.

RECOMMENDATION:
The Administration respectfidly. recommends that the City Commission adopt the attached resolution,
authorizing the City Manager to execute a Permit Agreement in a form acceptable to the City Attorney,
between the City of Miami and Metro -Dade County for the purpose of leasing 484 square feet of office
space at the Culmer Neighborhood Service Center, for a term of six (6) months, to begin upon
execution by both parties, at a rental rate of $11.23 per square foot for a monthly rent of $452.83, and a
total amount of $2,717.00. This office space would be occupied by the Overtown Neighborhood
Partnerships Program (ONP), a Division under the Community Development Department. ONP will
initiate the process with Metro -Dade to secure a long-term (annual) lease during this 6-month permit
agreement.
BACKGROUND:
The Overtown Neighborhood Partnerships_ Program's (ONP) offices have been located at the historic
D.A. Dorsey House (250 N.W. 9' Street) since becoming a City of Miami entity in January, 1996. The
Black Archives History and Research Foundation of South Florida, Inc. is the lessor of this property.
In the agreement between the City of Miami and Miami Dade Community College Medical Campus,
Miami -Dade agreed to pay the Black Archives History and Research Foundation of South Florida, Inc.
the monthly lease amount of $750.00 until March 31, 1997, the official expiration date of the lease.
Thereto, it would be the City's responsibility to meet this monthly lease agreement. Since April 1,
1997, the Black Archives History and Research Foundation of South Florida, Inc. has allowed ONP to
reside in the Dorsey House until ONP either renegotiated a lease agreement with the Black Archives or
selected another office location.
ONP has selected another office location that meets its budget, provides greater accessibility to
residents and partners, and is located in an area that provides better security. In addition, the amount of
space provided at ONP's current office location far exceeds the needs of ONP's two (2) person staff.
This new location is in the Metro -Dade Culmer Neighborhood Service Center, located at 1600 N.W. 3ra
Avenue.

The approval of this six (6) month "Permit Agreement" will grant us an opportunity to meet our short-
term needs and assess our long term needs as it relates to office space and location.

financial obligations. When I took this matter before the board's Historic Overtown
Folklife Committee, the members were concerned that we would never recover the

Unless I can show our board a method of recovering expenses during this period, the

Dear Mr. Davis:
Thank you for responding to our letter regarding the occupancy of the D.A. Dorsey House at 250
N.W. 9' Street by the Overtown Neighborhood Partnerships Division of the City of Miami's
Community Development Department.
Please understand that our desire was not to create a dilemma for you. Therefore, we are willing
for the period retroactive to April 1, 1997 through June 30, 1997, to pay either the current
$750.00 monthly lease payment or the known operating expenses. In your letter to us, those
expenses totaled $510.00 as a monthly average. It is understood that the operating expenses can
fluctuate; therefore, our obligation would be to pay less than or more than $510.00 monthly, but
not to exceed $750.00 monthly, in operating expenses.

Our preference would be the lesser of the two (operating expenses) with one stipulation. For
internal justification, we will need a copy of the actual billing statement for each expense item.
In this interim, please provide us with a new lease agreement effective July 1, 1997, by May 5',
1997. This will allow us time to prepare the legislation to go before the City Commission for
approval on June 12, 1997..
We are currently working to provide payment to you on, a monthly basis. Yet, if we cannot get a
release in these dollars immediately, please allow us to pay you the total three (3) month amount
before June 30, 1997.

On March 31, 1997, the lease agreement between the Black Archives Historic Research
Foundation and Miami Dade Community College (MDCC) will expire. The Historic
D.A. Dorsey House is the leased property where the Overtown Neighborhood
Partnerships Program (ONP) offices,reside.
As a result, ONP will be without a place to continue its business effective April 1, 1997.
It was the intent of the Overtown Neighborhood Partnerships Program (ONP) to continue
occupying office space at the D.A. Dorsey House indefinitely. Yet, due to circumstances
that are beyond our control, we were delayed in securing the approval of the City
Commission to pursue a new lease agreement with the Black Archives History And
Research Foundation.
Therefore, we are submitting to you this request (per the verbal agreement .with Mr.
Arthor Jackson of my staff) for your permission to allow the Overtown Neighborhood
Partnerships Program to continue occupying the D.A. Dorsey House from April 1, 1997
through June 30, 1997, free of any financial obligations. I am hopeful that before June 30,
1997, the Overtown Neighborhood Partnerships Program will have appropriate approvals
to proceed with securing a lease to continue its business.

Dear Dorothy:
It was good seeing you the other night at the Over town Neighborhood Partnership meeting at the
Culmer Center. It was exciting to listen to the community involvement and meet several of the
partners who will be involved in the ONP project. As you are aware Miami -Dade currently leases
the Dorsey House located at 250 N.W• 9th Street for office space for the ONP project. As part
of Miami-Dade's continuing commitment to this project, the college intends to continue renting
this facility for the ONP project through the end of the lease agreement on March 31, 1997. The
college will continue to pay $750 per month as stated in our lease agreement through that period
of time. The college does not wish to enter into another lease agreement at the end of this current
agreement. The college will be vacating the premises.
I would suggest that you speak with Mr. Arthur Jackson from the City of Miami who is currently
the Director of the ONP project to determine the City's intention for use of the space after the
Miami -Dade lease ends on March 31, 1997.
