RESOLUTION NO. 9 r r 439
A RESOLUTION EXPRESSING THE INTENT OF THE
CITY COMMISSION THAT MEMBERS OF THE BLUE
RIBBON TASK FORCE (TASK FORCE), ESTABLISHED
FOR THE PURPOSE OF ASSISTING THE CITY OF
MIAMI IN DEVELOPING RECOMMENDATIONS AND PLANS
TO IMPROVE THE BUSINESS PRACTICES OF THE
CITY'S GOVERNMENT, NOT BE PREJUDICED IN THE
CITY OF MIAMI'S CONSIDERATION AND AWARD OF
EXISTING OR FUTURE CONTRACTS AND BUSINESS
OPPORTUNITIES BY VIRTUE OF HAVING SERVED ON
SAID TASK FORCE.
WHEREAS, pursuant to Resolution No. 97-207, adopted
March 27, 1997, this Commission created the Blue Ribbon Task
Force to assist the City in developing recommendations to improve
the business practices of City government; and
WHEREAS, the Members of the Task Force represent South
Florida businesses, consulting and professional service firms,
governmental entities, health care enterprises, colleges and
universities, and other entities and are expected to contribute a
substantial amount of their time to assist the City in improving
its business practices; and
WHEREAS, a substantial number of the members of the Task
Force in their individual capacities are presently conducting
business with the City, and other members are officers, employees
or associates of business entities conducting business with the
City; and

WHEREAS, it is essential to the proper conduct and effective
operation of government that the City be able to attract
qualified citizens representing a wide spectrum of interests to
assist in performing the essential tasks of government without
creating unnecessary barriers to public service;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Members of the Task Force and the business
entities in which the Members are employed or are associated will
be treated as all other persons or business entities, as provided
by law, and will not be penalized by virtue of service on the
Task Force.
Section 3. Existing contractual relationships or other
business arrangements between Members of the Task Force in their
individual capacities or through their employment or association
with a business entity presently doing business with the City,
are not within the purview of the conflict of interest laws by
virtue of their service on the Task Force.
Section 4. Future offers to contract or to enter into
other business arrangements with the City by Members of the Task

Force in their individual capacities or by business entities in
which they are employed or associated, while they serve on the
Task Force will be considered by the Commission under the waiver
provision in accordance with applicable law.
Section 5. Offers to contract or to enter into other
business arrangements with the City by Members of the Task Force
in their individual capacities or by the business entities with
which they are employed or associated after the Task Force has
been discharged, shall be treated as any other offer without
regard to Members' service on the Task Force.
Section 6. This Resolution shall become effective
immediately upon its adoption.
