RESOLUTION NO. 9 % — 436
A RESOLUTION RELATED TO THE 10TH ANNUAL
AMERICA'S BIRTHDAY BASH TO BE CONDUCTED BY
THE BAYFRONT PARK MANAGEMENT TRUST (THE
"TRUST") ON JULY 4, 1997, AT THE MILDRED AND
CLAUDE PEPPER BAYFRONT PARK; ESTABLISHING AN
AREA PROHIBITED TO RETAIL PEDDLERS DURING THE
PERIOD OF THE EVENT; AUTHORIZING THE TRUST TO
NEGOTIATE SPONSORSHIPS, ISSUE CONCESSION
PERMITS, RECEIVE ALL REVENUES DERIVED FROM
THE CONCESSION ACTIVITIES, AND PERFORM ALL
OTHER APPROPRIATE FUNCTIONS ON BEHALF OF THE
CITY FOR SAID EVENT, SUBJECT TO AND
CONTINGENT UPON THE TRUST'S COMPLIANCE WITH
SUCH CONDITIONS AND LIMITATIONS AS MAY BE
PRESCRIBED BY THE CITY OF MIAMI, INCLUDING
OBTAINING INSURANCE TO PROTECT THE CITY IN AN
AMOUNT AND FORM AS PRESCRIBED BY THE CITY
MANAGER OR HIS DESIGNEE.
WHEREAS, the Bayfront Park Management Trust (the "Trust") is
planning its loth Annual Birthday Bash to be held at the Mildred
and Claude Pepper Bayfront Park ("Bayfront Park") on July 4,
1997; and
WHEREAS, said event has grown to be one of the largest
Fourth of July Celebrations in the Southeastern United States,
boasting attendance numbers of over 100,000; and
WHEREAS, the event will be free and open to the public and
totally representative of Miami's multi -ethnic community; and
WHEREAS, the City Code, Chapter 39, Article II, specifically
provides, inter alia, that Street Vending Franchises in the

Downtown Miami Special Vending District may be displaced during
designated special events occurring in the area; and
WHEREAS, the Trust has traditionally managed this event for
the City by requesting sponsorships, issuing permits, etc. and
has received all revenues derived therefrom for the benefit of

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
IPreamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The following specified area is hereby
prohibited to retail peddlers during the loth Annual America's
Birthday Bash, from Friday, July 4, 1997 at 6:00 A.M. to
Saturday, July 5, 1997 at 6:00 A.M.:
Southeast 2nd Street to Northeast 5th Street, from
Biscayne Boulevard to Northeast 2n Avenue.
Section 4. Pursuant to the provisions of City Code
Sections 39-28 and 39-33(5)c-6, all retail peddlers' occupational
licenses issued under the provisions of Chapters 31 and 39 of the
City Code, as amended, shall not be valid from Friday, July 4,
1997 at 6:00 A.M. to Saturday, July 5, 1997 at 6:00 A.M. on the
above designated streets and on all intersecting streets for two
blocks in all directions (Designated Area). In the Designated
Area, only business entities duly licensed by the City through
the Trust specifically for this event shall be permitted to

advertise their products, sell their products, or distribute free
samples to the public.
Section 5. The Trust is hereby authorized to negotiate
sponsorships, issue concession permits and perform all other
appropriate functions on behalf of the City for the event and
receive all revenues derived from the concession activities to be
applied for the benefit of Bayfront Park.
Section 6. The aforementioned authorizations are hereby
subject to and contingent upon the Trust's compliance with any
and all conditions and limitations as may be prescribed by the
Administration of the City of Miami, including obtaining
insurance to protect the City in the amount and form as
prescribed by the City Manager or his designee.
Section 7. This Resolution shall become effective
immediately upon its adoption.
PASSED AND ADOPTED this 26th day of June 1997.
