HomeMy WebLinkAboutR-97-0401J-97-349 6/2197 RESOLUTION NO.9 401 A RESOLUTION BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT AN EMERGENCY NEED EXISTED, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND ACCEPTING THE BID OF ADVANTA FINANCIAL CORPORATION FOR THE LEASE/PURCHASE OF AN ICE MACHINE FOR THE DEPARTMENT OF SOLID WASTE; ALLOCATING FUNDS THEREFOR, IN THE AMOUNT OF $7370.84 FROM THE SOLID WASTE DEPARTMENT FY '97 BUDGET, INDEX CODE 421101-840; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR SAID MACHINE. WHEREAS, the City Manager determined an emergency need existed for the replacement of an ice machine at the Solid Waste Department Building; and WHEREAS, informal quotes were secured to determine the current price and availability of said machine; and WHEREAS, Advanta Financial Corper5tion was the only company capable of providing an ice machine on site within days; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Ratifying, approving and confirming, by a 4/5ths affirmative vote of the members of the City Commission, the City Manager's finding that an emergency need existed, waiving the requirements for competitive sealed bids and accepting the bid of Advanta Financial Corporation for the lease/purchase of an ice machine for the Department of Solid Waste, with funds therefor hereby allocated, in the amount of $7,370.84, from the Solid Waste Department FY '97 Budget, Index Code 421101-840. Section 3. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for said machine. Section 4. This Resolution shall become effective immediately upon its adoption. Advanta Financial Corporation provided the machine with a lease -purchase option agreement, on an emergency basis. BACKGROUND In August of 1996, an ice machine, required to provide ice for solid waste workers in the field every day, was determined to be irreparable by the Division of Property Maintenance. A final, short-term, repair was made by Airko Mechanical Maintenance in September, but the unit failed shortly afterwards. The Department was then required to purchase ice on a daily basis to meet the employee need. It was therefore determined that it would be more economical to purchase a machine. Informal quotes were secured to determine the current price and availability of said machine. Advanta Financial Corporation was the only company capable of providing an ice machine on site within days through a Lease/Purchase Option Agreement on an emergency basis at a total cost of $7,370.84. The remaining contract balance is $5,543.81. The company, Advanta Public Finance, is a non -local, non -minority vendor located at 11850 S. Election Drive, Drape, UT 84020.
