A RESOLUTION, AFTER A DULY ADVERTISED PUBLIC
HEARING, AUTHORIZING AN INCREASE IN AN AMOUNT
NOT TO EXCEED $12,048.34, IN THE CONTRACT
DATED MARCH 28, 1995, WITH BRANCHING OUT,
INC., FOR THE "ABOVE -GROUND TANK
INSTALLATIONS, PHASE TWO, PROJECT B-5579 (Y) ";
ALLOCATING FUNDS THEREFOR FROM CAPITAL
IMPROVEMENT PROJECT NO. 311009, ENTITLED
"REMOVAL OF UNDERGROUND TANK", PREVIOUSLY
APPROPRIATED BY CAPITAL IMPROVEMENT ORDINANCE
NO. 11337, AS AMENDED, FOR SAID INCREASE.
WHEREAS, a contract dated March 28, 1995 exists, between the
City of Miami, Florida, and Branching Out, Inc., for the "Above
Ground Tank Installations, Phase Two Project, B-5579(Y); and
WHEREAS, said contract was authorized pursuant to Resolution
No. 94-842, adopted November 17, 1994; and
WHEREAS, additional control valves for seven tank
installations, and the disposal of nineteen (19) drums of tank
sludge were required; and
WHEREAS, an increase in the contract in an amount not to
exceed $12,048.34 is required to cover the cost of the extra
work; and
WHEREAS, funds to cover said increase are available from
funds previously appropriated by Capital Improvement Ordinance
No. 11336, as amended, for Project No. 311009, entitled "Removal
of Underground Tank";

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. After a duly advertised public: hearing, an
increase in an amount not to exceed $12,048.34, with Branching
Out, Inc., in the contract dated March 28, 1995, for the "Above -
Ground Tank Installations, Phase Two, Project B-5579(Y)" is
hereby authorized, with funds therefor hereby allocated from
funds previously appropriated by Capital Improvement Ordinance
No. 11337, as amended, for Capital Improvement Project
No. 311009, entitled "Removal of Underground Tank".
Section 3. This Resolution shall become effective
immediately upon its adoption.

ENCLOSURES:
It is respectfully recommended that the City Commission adopt the attached
Resolution, after a duly advertised public hearing, for an increase in the amount
of $12,048.34, from $235,378.00 to $247,426.34 in the contract with Branching
Out, Inc., dated March 28, 1995 for the Above -Ground Tank Installations, Phase
Two, Project B-5579(Y).
BACKGROUND:
On March 28,1995, after a formal competitive bidding process, the City of Miami
and Branching Out, Inc., entered into a contract for the Above -Ground Tank
Installations, Phase Two, Project B-5579(Y), Capital Improvement Project No.
311009 "Removal of Underground Tanks".
The project' -an
o ginal scope of work consisted of the removal, testing and
disposal of and rground fuel tanks at various locations citywide and surface
restoration in t e area of the construction. At specified sites, nine (9) above-
ground tanks and associated dispensing equipment were installed. At seven (7)
of the new tank locations, the associated day tanks required the installations of
solenoid and isolation valves. Additionally, resulting from the work there were
nineteen (19) drums of tank sludge that had to be disposed of in a manner
approved by DERM. The cost of this additional work requires an increase in the
contract of $12,048.34. Funds are available from Capital Improvement Project
No. 311009 "Removal of Underground Tanks" to cover the cost of the extra
work.

NOTICE OF THE PUBLIC
A public hearing will be held by the Commission of the City of Miami, Florida, on June 12,
1997, at a.m. in the City Commission Chambers at City Hall, 3500 Pan American Drive,
Miami, Florida, for the purpose of hearing any objections from any interested parties -affected by an
increase in the contract between Branching Out, Inc., and the City of Miami in an amount not to
exceed $12,048.34 for the Above -Ground Tank Installations, Phase Two Project B-5579(Y), C.I.P.
No. 311009.
All interested persons are invited to appear and may be heard concerning these items.
Should any person desire to appeal any decision of the City Commission with respect to any
matter considered at this hearing, that person shall ensure that a verbatim record, of the
proceeding is made, including all testimony and evidence upon which any appeal may be based.
