RESOLUTION NO. 9 7- 326
A RESOLUTION APPOINTING CERTAIN MEMBERS OF
THE MIAMI CITY COMMISSION TO SERVE AS
CHAIRPERSONS AND MEMBERS ON VARIOUS CITY
TRUSTS, AUTHORITIES AND AGENCIES FOR TERMS AS
DESIGNATED HEREIN.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The following members of the Miami City
Commission are hereby appointed to serve as Chairpersons on the
herein designated City trusts, authorities, or agencies for terms
beginning June 1, 1997 and expiring May 31, 1998:

In accordance with provisions of City Code Section 2-35 ("Term of commissioner as member of
any authority, board or committee; annual review"), the appointment of each City Commissioner
currently a member of any authority, board or committee shall be reviewed annually by the City
Commission, such review to take place on or before the anniversary date of such appointment.
The above -cited Code section further states that each Commissioner be considered for
appointment before any one Commissioner shall have served a consecutive term; however,
there shall be no prohibition against any Commissioner being reappointed to serve consecutive
terms.
I shall present to the City Commission a report prepared by the City Clerk on this subject for the
Commission's review and consideration "at a meeting no later than 30 days before June 1st,"
which means it would be in order for the City Commission to consider this issue at the
Commission meeting presently scheduled for May 8, 1997.
Attached hereto, in keeping with requirements under the above -cited Code section, please find
an updated list of City Commissioners presently serving as a member of any
authority/board/committee, as well as the terms) of office presently being served by them.

recommended the guidelines which were later formalized by Ordinance 10764, which created the Coconut Grove Standing Festival Committee, Ord.
10764 also provided one City Commissioner may be an ex-officio nonvoting member of said committee and Commissioner Plummer served in that
capacity from 5-9-91 to November 1991. Since then, said position has been vacant.

heads of the departments affected to prepare
necessary memoranda, data or reports. In the
event a copy of each resolution or ordinance is not
furnished within the required five days, the pro-
posed resolution or ordinance may be heard by
the city commission provided that the city com-
mission unanimously deems such resolution or
ordinance to be of an emergency nature. The
number of nonscheduled items is limited to two
that each commissioner and the mayor may in-
troduce for consideration by the city commission
at any city commission meeting and 8:00 p.m. or
at the conclusion of the regular scheduled agenda,
whichever occurs first, is designated as the time
that such nonscheduled items shall be intro-
duced.
(fl All notices of all intentions to ask questions,
together with a copy of such questions, shall be
given to the city manager five days before each
regular meeting. In all questions of policy pre-
sented to the city commission by the city manager
or any departmental head, notice thereof, to-
gether with a copy of questions supported by
memorandum setting forth the rules of action by
the city commission, shall be filed three days
before the meeting and given to each member of
the city commission.
(g) All ordinances shall be read by title only
prior to passage. All resolutions shall be briefly
described upon a printed agenda, which agenda
shall be furnished the members of the city com-
mission five days before each city commission
meeting.
(h) Unless further time to speak is granted by
the chairperson of the city commission, any per-
son addressing the commission shall limit his or
her address to two minutes.
(i) Unless impractical to do so, all portions of
the agenda shall be scheduled to be heard at 9:00
a.m. on the date of the city commission meeting.
The agenda portion entitled "consent agenda"
shall be scheduled among the initial items for
commission consideration.
Q) Nothing in this section shall prohibit the
mayor from calling special meetings at any time
he may deem proper for the consideration of any
business of public import and without complying
with the provisions of this section.

Sec. 2-34. Vice -mayor.
(a) A member of the city commission shall be
elected to an office hereby created and hereby
designated "vice -mayor." The election of a vice -
mayor shall be by resolution and be held at the
regular city commission meetings on the first
Wednesday in November. The term of office for
vice -mayor shall be one year or until a vice -mayor
is elected.
(b) All of the powers and duties of the mayor
under the Charter, this Code or other ordinances
of the city shall be performed by the vice -mayor
during the absence or disability of the mayor.

Sec. 2.35. Term of commissioner as member
of any authority, board or commit-
tee; annual review.
(a) In accordance with the provisions of law
and with the provisions of this section, the ap-
pointment of each city commissioner currently
serving as a member of any authority, board or
committee created by resolution or ordinance shall
be subject to the review of the city commission on
an annual basis commencing June 1, 1990, such
review to take place on or before the anniversary
date of such appointment. It is the intent of the
city commission that each commissioner be con-
sidered for appointment to an authority, board or
committee before any one commissioner shall
have served a consecutive term; however, there
shall be no prohibition against any commissioner
from being reappointed to serve consecutive terms.
(b) The city clerk is hereby directed to take
necessary steps to implement the provisions of

paragraph (a) hereof by forthwith providing the
city commission and city manager with informa-
tion concerning the affected authority, boards or
committees in regard to the length of past service
by those city commissioners so serving thereon. In
each succeeding year and not later than 60 days
before the first day of the month set forth in
paragraph (a) above, the city manager shall present
the city commission with a report on this subject
for commission review and consideration at a city
commission meeting scheduled to take place no
later than 30 days before the first day of the
month set forth in paragraph (a) above.

Sec. 2.86. Powers and duties in general.
The city manager shall be appointed pursuant
to and shall have the powers and duties enumer-
ated in the laws of the state, the city Charter, this
Code and other city ordinances.

Sec. 2-87. Assistant city manager and admin-
istrative assistant to the city man-
ager —Positions created.
The offices and positions of assistant city man-
ager and of administrative assistant to the city
manager are hereby created and established.

DIVISION 3. CITY ATTORNEYt
Sec. 2.111. Supervision and control of attor-
neys employed by city.
All attorneys at law retained or employed by
the city, regardless of the nature or kind of service
performed or the title or designation under which
they render legal service for the city, are hereby
placed under the direct supervision and control of
the law department.

Sec. 2-112. Charter amendments, method of
drafting; approval by city com-
mission; submission to elector-
ate.
(a) The city attorney shall draft, with the as-
sistance of any individual the city attorney deems
necessary, a Charter amendment within 120 days
after the city commission adopts a resolution
directing the city attorney to prepare such amend-
ment or after the certification of a petition of ten
percent of the qualified electors of the City of
Miami requesting such amendment.
(b) The Charter amendment drafted by the city
attorney shall be approved in final form by the
city commission in a resolution calling for a spe-
cial election upon the amendment. The resolution
calling for the special election shall include the
text of the amendment draft approved by the city
commission, and such draft shall be deemed sub-
mitted to the electorate by the adoption of said
resolution.
