A RESOLUTION, BY A FOUR -FIFTHS (4/5THS)
AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY
COMMISSION, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDING THAT
EMERGENCY CIRCUMSTANCES EXISTED AND
AUTHORIZING AN INCREASE, IN AN AMOUNT NOT TO
EXCEED $11,000.00, IN THE CONTRACT WITH TREE
ADVISORS CONSULTING AND CONTRACTING, A
DIVISION OF EARTH ADVISORS, INC. FOR THE
PROVISION OF SERVICES RELATED TO THE
PREPARATION OF A TREE DAMAGE ASSESSMENT
SURVEY AND THE SUPERVISION OF TREE TRIMMING
WORK AND STRUCTURAL REPAIR OF DAMAGED TREES
IN CITY PARKS; ALLOCATING FUNDS THEREFOR FROM
FUNDS AS PREVIOUSLY APPROPRIATED BY CAPITAL
IMPROVEMENTS PROJECTS ORDINANCE NO. 11337,
PROJECT NO. 331392, ENTITLED "PARK TREES
CORRECTIVE TRIMMING/PRUNING", FOR SAID
INCREASE.
WHEREAS, the City of Miami ("City") accepted a grant from
the State of Florida entitled "Hurricane Andrew Urban
Reforestation Grant" which did not require local matching funds;
and
WHEREAS, based upon the acceptance of said grant, the City
entered into a professional services agreement on February 28,
1996 between the City of Miami and Tree Advisors, Consulting and
Contracting, a Division of Earth Advisors, Inc., in the amount of
$19,100.00, for the preparation of a tree damage assessment
survey and the supervision of "Park Trees Corrective
Trimming/Pruning" (Capital Improvements Project No. 331392); and

WHEREAS, additional work related to field supervision of
contractors performing corrective trimming by certified arborist
became necessary; and
WHEREAS, because of the May 30, 1997 State of Florida
deadline submission date for all expenses to be paid by said
grant, the City Manager made a finding that emergency
circumstances existed and authorized that Tree Advisors
Consulting and Contracting
, perform said work which increased the
agreement costs (based upon rates established in Section II,

Paragraph B.5, of said agreement, in an approximate amount of
$11,000.00, thereby increasing said contract from $19,100.00 to
$30,100.00; and
WHEREAS, funds to cover said increase are available from
Capital Improvements Project No. 331392, as previously
appropriated by the State of Florida Hurricane Andrew Urban
Reforestation Grant;

j NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY

i OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the

Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4/5ths) affirmative vote of
the members of the City Commission, the City Manager's finding
that emergency circumstances existed and authorizing an increase,
in an amount not to exceed $11,000.00, for the contract with Tree
Advisors, Consulting and Contracting, a Division of Earth

Advisors, Inc., for the provision of services related to the
preparation of a tree damage assessment survey and the
supervision of tree trimming work and structural repairs of
damaged trees in City parks, is hereby ratified, approved and
confirmed, with funds therefor hereby allocated from funds as
previously appropriated by Capital Improvements Projects
Ordinance No. 11337, Project No. 331392, entitled "Park Trees
Corrective Trimming/Pruning", for said increase.
Section 3. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached Resolution
authorizing an amendment, in a form acceptable to the City Attorney, to an agreement
dated February 28, 1996 between the City of Miami and Tree Advisors Consulting and
Contracting, a Division of Earth Advisors, Inc. This amendment authorizes an increase in
an amount not to exceed $11,000.00 from $19,100.00 to $30,100.00 for services related
to the preparation of a tree damage assessment survey and the supervision of tree
trimming work and structural repairs of damaged trees in city parks. The Resolution also
allocates funds for said purpose from funds previously appropriated by Capital
Improvement Project No. 331392, entitled "Park Tree Corrective Trimming/Prunning"
which was fully funded by a State of Florida Hurricane Andrew Urban Reforestation
Grant.
BACKGROUND:
The Department of Parks and Recreation received a Hurricane Andrew Urban
Reforestation Grant from the State of Florida for "Structural Repair of Damaged Trees in
City Parks" in the amount of $100,000,00. The City then entered into a professional
services agreement on February 28, 1996 with Tree Advisors Consulting and Contracting,
a Division of Earth Advisors, Inc., to prepare a citywide tree damage assessment and to
supervise the corrective trimming/prunning of damaged trees. Section III, paragraph B.5
of this agreement provides for the performing of additional services by Tree Advisors,
Consulting and Contracting, a Division of Earth Advisors, Inc. The recommended
increase needs to cover costs related to field supervision of contractors performing the
corrective trimming by a certified arborist. The State grant requires that a certified
arborist supervise all tree trimming and prunning.
Funds are available from monies previously appropriated to the project in the City's
Capital Improvement Appropriation Ordinance No. 11337, Project No. 331392 "Park
Tree Corrective Trimming/Prunning". This work was funded by a State of Florida
Hurricane Andrew Urban Reforestation Grant that did not require any matching
funds from the City of Miami.
