HomeMy WebLinkAboutR-97-0313i J-97-200 j 5/5/97 RESOLUTION NO. 9 7 - 313 A RESOLUTION, WITH ATTACHMENT(S), EXPRESSING THE CITY OF MIAMI'S DESIRE TO IMPLEMENT THE "GOOD NEIGHBOR" PROGRAM BETWEEN THE CITY OF MIAMI ("CITY") AND THE U.S. GENERAL SERVICES ADMINISTRATION ("US GSA") FOR PAYMENT OF A FEE BY US GSA TO THE CITY OF MIAMI FOR SERVICES PROVIDED FOR THE EXPRESS PURPOSE OF REVITALIZING DOWNTOWN MIAMI; AUTHORIZING THE CITY MANAGER TO ENTER INTO A MEMORANDUM OF UNDERSTANDING ("MOU"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH US GSA TO SET FORTH THE UNDERSTANDING THAT BOTH PARTIES WILL ENTER INTO NEGOTIATIONS FOR SAID PURPOSE; I AUTHORIZING AND DIRECTING THE CITY MANAGER TO NEGOTIATE A MEMORANDUM OF AGREEMENT ("MOA") WITH US GSA SETTING FORTH THE -TERMS FOR PAYMENT OF A FEE BY US GSA FOR SAID SERVICES PROVIDED BY THE CITY IN THE DOWNTOWN AREA WHERE US GSA CONTROLLED FEDERAL PROPERTIES ARE LOCATED; AND FURTHER AUTHORIZING THE CITY MANAGER TO PRESENT THE NEGOTIATED MOA, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO THE CITY COMMISSION FOR ITS REVIEW AND APPROVAL PRIOR TO ITS EXECUTION. WHEREAS, the United States General Services Administration ("US GSA") administers a recently created federal program entitled the "Good Neighbor" Program whereby the US GSA contracts directly with municipal entities for payment of a fee for services deemed necessary to revitalize downtown districts; and WHEREAS, the US GSA has implemented the Good Neighbor Program with other municipal entities across the country through the successful execution of the necessary agreements; and ATTACHMEWT(S) CONTAINED {.lTy COM USSION MEETING OF MAY Q 7 1997 Aeeolutlon No, 97- 313 WHEREAS, the location of federal buildings controlled by the US GSA in downtown Miami, comprised of approximately two million square feet of office space, creates significant impacts to the downtown area; and WHEREAS, the City of Miami ("City") is desirous of implementing the Good Neighbor Program to establish a contract with the US GSA; and WHEREAS, the City Manager is hereby authorized to enter into a Memorandum of Understanding ("MOU"), in substantially the attached form, with the US GSA that sets forth the understanding that both parties will enter into negotiations to establish an agreement for payment of a fee for services performed by the City, where feasible and appropriate, for the maintenance and cleanup, security, downtown street and sidewalk improvements and other services deemed necessary by the City for the express purpose of revitalizing Downtown Miami where US GSA controlled Federal buildings are located; and WHEREAS, subject to successful negotiations, an agreement for payment of a fee for services specifying the terms will be produced in the form of a Memorandum of Agreement ("MOA"); and WHEREAS, the MOA will be presented to the City Commission for its review and approval prior to execution; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 2 - 97- 313 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Commission hereby expresses its desire to implement the "Good Neighbor" Program between the City of Miami ("CITY") and the U.S. General Services Administration ("US GSA") for payment of a fee by US GSA to the City for I services provided for the express purpose of revitalizing Downtown Miami. Section 3. The City Manager is hereby authorized to enter into a Memorandum of Understanding ("MOU"), in substantially the attached form, with US GSA to set forth the understanding that both parties will enter into negotiations for said purpose. Section 4. The City Manager is hereby authorized and directed to negotiate a Memorandum of Agreement ("MOA") with US GSA setting forth the terms for payment of a fee by US GSA for said services provided by the City in the Downtown area where US GSA controlled Federal properties are located. - 3 - 9'7- 313 Section 5. The City Manager is hereby authorizedl1 to present the negotiated MOA, in a form acceptable to the City Attorney, to the City Commission for its review and approval prior to its execution. Section 6. The purpose of this Memorandum of Understanding between the U. S. General Services Administration (GSA) and the City of Miami, Florida, is for the parties to enter into negotiations to establish an agreement between GSA and the City in which GSA shall pay, upon request by the City and where feasible and appropriate, a fee for services provided by the City. The services provided by the City are for the sidewalk improvements program, cleaning and maintenance, security and other services deemed necessary by the City for the express purpose of revitalizing downtown Miami, Florida. Further, GSA will pay for services in areas where there is GSA -controlled space and activity. The parties agree to complete negotiations and enter into formal agreements as soon as possible. The MOA will be presented to the City Commission for its review and approval prior to execution. BACKGROUND The Department of Planning and Development has prepared the attached Resolution regarding the City's participation in a recently created federal program entitled the "Good Neighbor" program. The Good Neighbor federal program is intended to assist municipalities in area revitalization efforts through a payment plan for services provided. The U.S. GSA, as the federal agency responsible for administering the Good Neighbor program, has entered into agreements with several other municipal entities, i.e. in Tampa, Tallahassee, Birmingham, Memphis, setting forth the understanding that a contract will be negotiated for payment of a fee for services. The attached Resolution confirms the City's interest in participating in the Good Neighbor program for the payment of a fee for services. The fee would be used to revitalize downtown Miami through maintenance, security, downtown street and sidewalk improvements and other services as provided by the City. In the downtown Miami area, GSA controlled federal buildings comprise nearly two million sq.ft. of office space among six facilities. The attached Resolution further authorizes the City Manager to proceed with the process. �\4p 97- 313 1
