WHEREAS, the City and Tony Molina, Inc. entered intro a lease agreement,
on September 29, 1977, as aniended (the "Lease") and a Revocable Permit, dated
February .49, 1986 (the "Permit,"), whereby Tony Molina, Inc. agreed to pay to the
City monthly rent, f'or the use of certain City -owned real property located at, 650
Curtiss Parkway, Miami Springs, Florida; and
WHEREAS, Tony Molina, [lie. failed to pay t:he monthly rant; clue to the City
under the terms of the ],ease f'or the months of September, October, November and
December, 1996 and March, 1997 and the monthly fees due to the Ci .y under the
i.erms of t:ho Permit; f'or the months of July, August., Sopt.ember, October anti
November, 1996 and March, 1.997; and
WHEREAS, Tony Molina, Inc. has been providing janitorial services to the
public rest,rooms within the Miami Springs Golf' Course Clubhouse since March,
1996, which is a City of Miami responsibility;

CITY OF MIAM1, FLORIDA:
Section 1. The rr.cit,als and lin(lings contained in the Preamble to this
Resolution are hereby adopted by reference t,heret,o and incorporated herein as if
fully set, forth in this Section.
Section 2. A credit, in t;he amount, of .$450 per month, ret;roact;ive to
March, 1.996, for Tony Molina, Inc.'s provision of ,janit,orial services for 1;he public
rest;rooms wit;hln t,ho Miami Springs Golf Course Clubhouse is hereby approved; said
credit. Lo be provided against, monthly rent, l'or the respective month in which the
services are provided.
Soct;ion 3. A payment, plan providing for a monthly payment,. of one
thousand five hundred dollars (g1,500) per month t;o be pai(1 by Tony Molina, Inc.
commencing chine 1, 1997 as repayment of the relit, all(] taxes owed Co the City in all
amount, not t,o exceed $8,839.7G is hereby approved, subject t;o 'bony Molina, Inc.
continuing to pay monthly the greater of the minimum annual payment, of $20,000
as pro -rated monthly or 12%, of gross revenues for the restaurant; area, plus 12% of
gross reccipt;s for the banquet, f�acilit,(es, as required by the Lease and Permit,
i respectively, for use of t;he promises. This payment; plan is further subject t;o Tony
Molina, individual, providing a personal guarantee for the monies owecl.
Section 4. This Resolution shall become effective immediately upon its
adoption.

I can pay the past due amount on my concession. I also need to
continue getting the monthly allowance of $450.00 for the
maintenance of the bathrooms and the common areas and also to be

Tony Molina, Inc. has requested a personal appearance before the City Commission to
discuss the following issues:
a) rent credit in the amount of $450 per month for cleaning of the Miami Springs
Clubhouse restrooms retroactive to March, 1996; and
b) request for a payment plan for past due rents.
At this time, Tony Molina, Inc. owes the City rent and use taxes in a total amount of
$14,239.76. The Department of Planning and Development, Asset Management
Division has reviewed Tony Molina's requests and hereby recommends the following:
1) Approval of a $450 monthly credit retroactive to March, 1996. Mr. Molina has been
cleaning the restrooms since that date, which is a City responsibility. Approval of
this credit will provide a balance due of $-8,839.76.
2) Approval of payment plan to provide for payment to the City of $1,500 per month
with the first payment due on June 1, 1997 and an equal payment of $1,500 on the
first day of each month thereafter until all amounts due are paid in full. This
approval is subject to Mr. Molina providing a personal guarantee for the monies due
and continuing to pay monthly the greater of the minimum annual payment of
$20,000 as pro -rated monthly or 12% of gross revenues for the restaurant area, plus
12% of gross receipts for the banquet facilities, as required by his lease agreement
and revocable permit for use of the premises.
