HomeMy WebLinkAboutR-97-0283J-97-157 3/12/97 \ RESOLUTION NO. 9 7` 283 A RESOLUTION, WITH ATTACHMENTS, AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION, IN SUBSTANTIALLY THE ATTACHED FORM, TO THE FLORIDA INLAND NAVIGATION DISTRICT ("FIND") UNDER SAID AGENCY'S WATERWAYS ASSISTANCE PROGRAM FOR GRANT FUNDING IN THE ESTIMATED AMOUNT OF $100,000 FOR THE PEACOCK PARK SHORELINE EDUCATIONAL ENHANCEMENT PROJECT; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THIS PURPOSE. WHEREAS, the City of Miami is committed to the improvement of neighborhood parks such as Peacock Park by their inclusion in its Capital Improvement Program (Capital Improvement Project No. 331359, "Peacock Park Improvements"); and WHEREAS, on September 8, 1994, Resolution No. 94-619, adopted by the City of Miami Commission, accepted a grant in the amount of $100,000 from the State of Florida Department of Environmental Protection under the Florida Recreation Development Assistance Program (FRDAP) for improvements to Peacock Park including the construction of a bay walk; and WHEREAS, pursuant to cost estimates prepared during the design and permitting phase, the proposed shoreline enhancements for Peacock Park necessitates additional funding for construction; and IATTACHMENT (S)I CONTAINED CITY COMMISSION MEETING OF APR 1 n 1997 Resolution No. 97- 283 WHEREAS, the Florida Legislature has made funding available to municipalities for such projects under the Florida Inland Navigation District's ("FIND") Waterways Assistance Program on a 50-50 cost share basis; and WHEREAS, the proposed shoreline enhancements at Peacock Park located bt 2820 McFarlane Road in the Coconut Grove neighborhood, Miami, Florida, satisfies the criteria for grant funding under the FIND program; and WHEREAS, the City's matching share of the project cost, in the estimated amount of $100,000 is available from the FRDAP grant and the newly adopted 1996 Safe Neighborhood Park Bond Referendum; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized to submit an application, in substantially the attached form, to the Florida Inland Navigation District ("FIND") for grant funding under the FIND Waterways Assistance Program, in the estimated amount of $100,000.00, for the Peacock Park Shoreline Educational Enhancement Project. Section 3. The City Manager is hereby authorized' to execute the necessary documents, in a form acceptable to the City Attorney, for application of said grant subject to the following provisions: a. The City will accept the terms and conditions set for in FIND Rule 16T-2 F.A.C. ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2 97-- 283 b. The City is in complete accord with the grant proposal and will carry out the project in the manner described in said proposal, and any plans and specifications attached thereto, unless prior approval for any change has been received from FIND. c. The City has the ability and intention to finance its share of the cost of said project from available grant/bond funds and the project site will be operated and maintained at the expense of the City for public use. d. The City will not discriminate against any person on the basis of race, color, creed, national origin, sex or handicap in the use of any property or facility acquired or developed pursuant to the grant proposal and will comply with the terms and intent of Title VI of the Civil Rights Act of 1964, P.L. 88-352 (1964) and will design and construct accessibility by handicapped persons as well as other federal state and local laws, rules and requirements. e. The City will maintain adequate financial records on said project to substantiate claims for reimbursement. f. The City will make available to FIND, if requested, a post -audit of expenses incurred on said project prior to or in conjunction with its request for the final 10% of the grant funding provided by FIND. Section 4. This Resolution shall become effective immediately upon its adoption. PROGRAM APPLICATION EVALUATION AND RATING TORl'vI The applicant is to complete this form by entering the project title, applicant name and answers to the applicable questions. All applicants will answer the first part of the form which includes questions 1 through 11. Each applicant will then complete the questions in one attachment according to the applicant's project type. The applicant should determine his project type (if the project incorporates more than one project type) by detenining which project type is dominate in terms of project cost. The attachments that are not applicable to an applicant's project should not be included'in. the submitted application. APPLICATION TITLE: Peacock Park Shoreline Educational Enhancement Project APPLICANT: city of Miami Department of Parks and Recreation CATEGORY RATING EVALUATION CRITERIA & RATING POINTS POINTS AVAILABLE PRIORITY LIST (1-5 paints) (1) Where does the project rank on this years approved project priority list? (Applicant should refer to Attachment C in the application to determine project priority list ranking. The application may only be of one type based upon the dominate cost of the elements of the project.) The Peacock Park Shoreline Educational Enhancement Project, (the "Project"), is ranked 9 and 11 on the 1997-98 Waterways Assistance Program, Project Priority list. 97- 283 WATERWAY RELATIONSHIP (1-3.5 points) (2) How does the project directly relate to District waterways? The Project's proposed boardwalk, educational signage, and removal of exotic vegetation along the Peacock Park shoreline will provide the public increase use, visual access, awareness and enjoyment of natural resources such as Biscayne Bay and the Atlantic Intracoastal Waterway. (1-3.5 points) (3) Does the project benefit public navigation? Yes, the Project does benefit public navigation because it stabilizes the existing shoreline. PUBLIC USAGE & BENEFIT (1-3 points) (4) Is the public usage of this project clearly quantified? Yes, the public use of the Project is clearly quantifiable because it is located in one of the most heavily used parks of the Coconut Grove neighborhood in -Miami, Florida. Coconut Grove is a dynamic, picturesque, cosmopolitan city -village where numerous visitors and residents enjoy a variety of art galleries, theaters, . restaurants, sidewalk cafes, boutiques and unique festivals such as the "Goombay" and the "Coconut Grove Art -Festival", drawing over one (1) million visitors. (1-4.5 points) (5) Can the project be reasonably used by residents from other counties of the District? Yes, the Project can be well used by local residents, visitors from other counties and -tourists alike in this already famous neighborhood who -will be drawn to the enhance visual access of Biscayne Bay and the looped boardwalk, seating area and observation deck along the Peacock par]: shoreline. 97 - 283 TIMELINESS (1-5 points) (6) Has the applicant presented a reasonable timeline for the completion of the projectT Yes, all environmental permit applications have been submitted as of the date of this applichtion. Permits will be issued by August 1997. Project construction drawings and specifications will be completed within 3 months of grant agreement execution. Construction bidding and award of construction contract will follow in the next 3 months. Construction will be completed in 6 to 8 months. COST- EFFECTIVENESS (1-2.5 paints) (7) Does the project provide a reasonable public service for the money requested? Yes, the Project provides a unique public service in this popular municipal Park in the following manner: it creates a recreational, and educational ammenity along the Biscayne Bay shoreline; it increases the visual access to the Bay by the removal of exotic plant species and aids the preservation of existing mangroves; and it increases park security by encouraging increased pedestrian traffic through a portion of the site which is currently underutilized. (1-2.5 paints) (9) To what degree does the project demonstrate cost sharing or funding from other sources? The Project's costs are shared 50-50 by the City of Miami which has obtained additional funding from the Florida Recreational Development Assistance Program (FRDAP). VIABILITY (1-2 points) (9) To what extent does the project duplicate existing efforts? The Project does not duplicate existing efforts for this area because there are no other projects -of this nature proposed by the City or other govenmental agency. 97— 283 (1-2 points) (10) How will the project continue to be maintained after District funding ceases? 2_ The maintenance of the Project will not rely on District funding as there is an existent maintenance program and budget for Peacock Park, as a municipal property. (1-3.5 points) (11) Will the program result in significant and lasting benefits? Yes, the Project will result in significant and lasting benefits for the Biscayne Bay shoreline at Peacock Park by increasing visual access to the Bay, improving the natural environment by removing exotic vegetation and assisting in the preservation of mangroves, creating a recreational and educational ammenity along the shoreline and encouraging pedestrian traffic in an area of the park which is currently underutilized. The Resolution further authorizes the City Manager to execute the necessary documents, in a form acceptable to the City Attorney, for this purpose. BACKGROUND The City of Miami Department of Parks and Recreation working with residents, community associations, the N.E.T. office and the Chamber of Commerce of the Coconut Grove neighborhood have developed throughout the years a commitment to the needs of the area including the preservation and improvement of Peacock Park as an important focal point for passive recreation and major community events. The City of Miami Capital Improvement Program (Project No. 331359) includes Peacock Park as a recipient of funds from the 1972 Park and Recreation General Obligation Bond, the State of Florida Recreation Development Assistance Program (FRDAP) and the just recently voter approved Safe Neighborhood Parks Bond Referendum. A portion of these funds have been used to fund major improvements such as site lighting, recreation building renovations, ball field relocation, new playground, site furnishings and landscaping. Remaining grant funds and a portion of future bonds funds, if necessary, will be used to fund the construction of a pedestrian bay walk, enhance the shoreline, provide visual access to Biscayne Bay and increase passive recreational opportunities. Pursuant to cost estimates prepared during the design and permitting phase of the bay walk and shoreline enhancement at Peacock Park, the project necessitates additional funding for construction in an estimated amount of $100,000. The Florida Legislature has made funding available to municipalities for such projects under the FIND Waterways Assistance Program on a 50-50 cost share basis. The proposed shoreline enhancement project at Peacock Park satisfies the criteria for grant funding under the FIND program, and the City's required matching share is available from the above mentioned FRDAP grant and if necessary, the recently approved 1996 Safe Neighborhood Park Bond Referendum."
