WHEREAS, the Miami Zoning Board at its meeting of i November 4, 1996, Item No. 2, duly adopted Resolution No. ZB 120-96 by a nine to zero (9-0) vote, recommending APPROVAL as set forth herein; and WHEREAS, the City Commission finds that it is in the best i interest of the general welfare of the City of Miami and its I i inhabitants, to grant the vacation and closure of a right of way, i being the alley running east to west from Southwest 42nd Avenue to 43rd Avenue between Southwest 7th Street and Southwest 8th Street, and deems it advisable to do so; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the ATTACHMENT (5) CONTAINED CITY COMMISSION MEETING OF MAR 2 7 1997 Resolution No. 9?— 216 Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The alley running east to west from Southwest 42"d Avenue to Southwest 43rd Avenue between th Southwest 7th Street and Southwest 8 Street, as set forth in i Exhibit "A" attached hereto and made a part hereof, is zoned C-2 Liberal -Commercial and R-1 Singly -Family Residential, is hereby closed, vacated, abandoned and discontinued for public use, said closure, vacation, abandonment and discontinuance being a condition for the approval of Tentative Plat No. 1424- A "ANTHONY ABRAHAM TRACT". Based on this review, it was the consensus of the Committee that the closure and vacation would enhance the public's safety and use of the area in question.
