RESOLUTION NO. 9 7 — 208
A RESOLUTION, WITH ATTACHMENT(S), AUTHORIZING
THE CITY MANAGER TO ESTABLISH THE MINIMUM
SALES PRICE FOR THE REAL PROPERTIES LISTED IN
EXHIBIT "A" TAKING INTO CONSIDERATION THE
APPRAISED VALUE OF THE PROPERTIES AS
j ESTABLISHED BY THE RESULTS OF TWO INDEPENDENT
APPRAISALS AND THE ASSESSED VALUE OF THE
PROPERTIES AS DETERMINED BY THE COUNTY
PROPERTY APPRAISER.
WHEREAS, Section 3(f)(i) of the Charter of the City of
Miami, as amended, (the "Charter") empowers the City to sell or
otherwise dispose of any real property inside or outside the
City; and
WHEREAS, notwithstanding the authority granted in Section
3(f)(i) of the Charter, Section 29-B of the Charter prohibits the
City Commission from considering any sale or lease of City -owned
property unless there is a return to the City of "fair market
value" under such proposed lease or sale; and
WHEREAS, Section 18-80 of the Code of the City of Miami, as
amended, (the "Code") prohibits the City Manager from selling
City -owned real property for less than its "appraised value"
unless express authority is given by the City Commission; and
WHEREAS, for purposes of Section 18-80 of the Code
"appraised value" is determined by the results of at least two
independent appraisers and in the event the appraisers can not
agree on the "appraised value", then the higher value is deemed
the "appraised value"; and-

WHEREAS, the sales of City -owned properties listed in
Exhibit "A" (the "Properties") is an intergral part of the
Financial Recovery Plan; and
WHEREAS, establishing the minimum sales price based solely
on the "appraised value" as defined in Section 18-80 of the Code
may not be the most advantageous manner for the City to conduct
and consummate these property transactions; and
WHEREAS, it is in the best interest of the City to establish
the minimum sales price for the Properties listed in Exhibit "A"
based on "fair market value" as required by Section 29-B of the
Charter instead of the "appraised value" as defined in Section
18-80 of the Code; and
WHEREAS, pursuant to Chapter 192 of the Florida Statutes the
County property appraiser is charged with determining the "just
or fair market value" of all property within the County
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
section.
Section 2. The City Commission hereby authorizes the City
Manager to establish the minimum sales price for the Properties
listed in Exhibit "A" by taking into consideration the results of
two (2) independent appraisals to be conducted with respect to
each of the Properties and the "assessed value" of the Properties
as determined by the County property appraiser, and thereby

guaranteeing that the City will receive "fair market value" for
the Properties.
Section 3. This Resolution snali necome eLLUU..LVU
