HomeMy WebLinkAboutR-97-0183J-97-196 3/20/97 RESOLUTION NO.9 7 - 18 3 A RESOLUTION REQUIRING THAT ALL YOUTH SERVING ORGANIZATIONS (ORGANIZATIONS) OPERATING PROGRAMS IN CITY OF MIAMI PARKS CONDUCT A MINIMUM OF ONE (1) FUND RAISING SPECIAL EVENT, EITHER INDIVIDUALLY OR IN CONJUNCTION WITH OTHER ORGANIZATIONS, BY SEPTEMBER 30, 1997, WITH ALL PROCEEDS GOING TO THE CITY OF MIAMI IN LIEU OF PAYING PARK USER FEES AS THE CITY CONTINUES TO REVIEW THIS MATTER DURING THIS PERIOD; PROCEEDS FROM SAID FUND RAISER SHALL BE PLACED IN A TRUST ACCOUNT TO SUPPORT THE MAINTENANCE AND OPERATION OF CITY PARKS; FURTHER GIVING ORGANIZATIONS THE OPTION OF PAYING A FLAT CONCESSION FEE OF $5.00 PER DAY, PER FIELD, OR FACILITY WHERE THE SPECIAL EVENT(S) ARE PRESENTED, CONDITIONED UPON SAID ORGANIZATION CLEANING UP THE CONCESSION AREA(S) AS DEFINED BY THE PARKS AND RECREATION DEPARTMENT; FURTHER AUTHORIZING THE CITY MANAGER AND THE CITY ATTORNEY'S OFFICE TO PREPARE THE LEGAL DOCUMENTS REQUIRED FOR THIS PURPOSE, CONTINGENT UPON EACH ORGANIZATION SUBMITTING A FINANCIAL AUDIT TO THE CITY MANAGER NOT LATER THAN MAY 1, 1997, AND OBTAINING INSURANCE IN AN AMOUNT STIPULATED BY THE CITY MANAGER OR HIS DESIGNEE. WHEREAS, the City of Miami recognizes the importance of keeping our youth involved in positive and wholesome recreational opportunities; and WHEREAS, many youth serving organizations have been operating sporting and other youth activities in City of Miami parks for several years ; and Y CITY COMMISSION MEETING OF MAR 2 © 1997 Resolution No. 97- 183 WHEREAS, many youths who participate in these program are from low and moderate income families; and WHEREAS, historically, these youth serving organizations have not been charged a fee by the City of Miami for utilizing the parks; and WHEREAS, the City of Miami's recent financial difficulties have necessitated a review of its current policy regarding these youth serving organizations; and WHEREAS, additional time is required to study this matter further and to develop recommendations as to what fees, if any, to charge these groups in the future; and WHEREAS, it is anticipated that it will take until September 30, 1997 to develop a new policy regarding this matter; and WHEREAS, in the meantime, the City of Miami would like to impose a requirement that each youth serving organization currently operating in a City park conduct at least one special event by September 30, 1997, to raise funds to assist the City in the operation of the parks in lieu of imposing park user fees during the event; and and WHEREAS, this special event could be presented by one group or by several groups; WHEREAS, the City has set a goal of $15,000 to be realized from these efforts by September 30, 1997; and WHEREAS, all funds raised will be deposited in a separate trust fund for use in the maintenance and operation of its park facilities; and WHEREAS, the failure of any youth serving organization to show evidence that it held, or participated in, sponsoring a fund raising event by September 30, 1997, could result in the group being disqualified for future reduced fee considerations for such organizations operating in City parks; and L 2- 9'7 - 183 F -I WHEREAS, to raise revenues for the City of Miami and better control illegal vending activities in the parks, it would be optional on the part of the organization to choose to have concession rights during their activities for a flat fee of $5.00 per day, per field, or facility used with the proviso the organization clean up the concession area(s) as defined by the Parks and Recreation Department; and j WHEREAS, youth serving organizations will continue to be defined as organizations serving youths up to 17 years of age with fifty-one percent (51 %) of the participants residing in the City of Miami; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. All youth serving Organizations (Organizations) operating programs in City of Miami parks are hereby required to conduct a minimum of one (1) fund raising special event, either individually or in conjunction with other such groups, by September 30, 1997, in lieu of paying park user fees during the period of the event. Section 3. Proceeds from said fund raiser shall be placed in a trust account to support the maintenance and operation of City parks. Section 4. Organizations would have the option to have concession rights during the event for a flat rate of $5.00 per day, per field, or facility, with each organization responsible for clean-up around the concession area(s). Section 5. The City Manager is hereby authorized to work with the City Attorney's Office in preparing the legal documents required for this purpose, contingent upon each Organization submitting a financial audit to the City Manager not later than 3- L 97- 183 F May 1, 1997, and obtaining insurance in an amount stipulated by the City Manager or his designee.
