RESOLUTION NO.9 7 - 164
A RESOLUTION AUTHORIZING PAYMENT TO THE DADE
COUNTY ASSOCIATION OF CHIEFS OF POLICE, FOR THE
COURT OVERTIME REDUCTION PROJECT, IN THE AMOUNT
OF $5,000.00; ALLOCATING FUNDS THEREFOR FROM THE
POLICE DEPARTMENT GENERAL OPERATING BUDGET,
ACCOUNT CODE 001000.290301.6.930.
WHEREAS, the Miami Police Department, as most police departments in Dade
County, faces rising court overtime costs; and
WHEREAS, the costs are significant and difficult to continue to absorb; and
WHEREAS, the Dade County Association of Chiefs of Police ("Association"), along
with the State Attorneys Office, have determined that a standby system ("system") will be
tested, on a pilot program basis, in one (1) division; and
WHEREAS, members of the Association must share in the cost as they will all benefit
from a reduction in court overtime costs;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.

Section 2. Payment to the Dade County Association of Chiefs of Police, for the Court
Overtime Reduction Project, in the amount of $5,000, is hereby authorized, with funds
therefor hereby allocated from the Police Department General Operating Budget,
Account 001000.290301.6.930.
Section 3. This Resolution shall become effective immediately upon its adoption.

It is respectfully recommended that a Resolution authorizing payment to the Dade County
Association of Chiefs of Police, for the Court Overtime Reduction Project, and allocating funds
therefor; in an amount not to exceed $5,000.00, be approved. Funding is to be provided from the
Police Department General Operating Fund, Account 001000.290301.6.930.
BACKGROUND:
The Miami Police Department, as most police departments in Dade County, faces rising court
overtime costs which are not easy to contain. There are several inherent problems arising from this
issue. On any given day, an officer can be subpoenaed but not actually needed in court. It is not
unusual for officers to be scheduled for court during the morning or early afternoon and remain
there until late in the afternoon. They then must report for their regular tour of duty that evening
thus creating safety concerns because of extended working hours. Finally, on -duty officers must
wait in court until required to testify when they could be patrolling the streets.
The Dade County Association of Chiefs of Police, along with the State Attorney's Office, have
been studying this problem. As a first step, they have determined that a standby system will be
instituted. The system uses a victim/witness coordinator to ascertain officers as well as victims
and witnesses availability, allowing the State Attorney's Office to plan accordingly. Officers will
be notified that they are being placed on a "standby" basis and will only be called when needed. A
pilot program will be tested for 60 to 90 days in exclusively one division. Should the test results
be favorable, the system will be phased into other divisions.
The Association, for the initial pilot program, has agreed to fund one (1) temporary victim/witness
coordinator. Members of the Association are being asked to share in the costs associated with the
pilot program. Ours is a minor expense, particularly in light of anticipated court overtime savings
which are estimated to be $28,500.00 per month during the pilot program.
