A RESOLUTION DENYING THE APPEAL OF THE
DEPARTMENT OF COMMUNITY PLANNING AND
j REVITALIZATION AND AFFIRMING, WITH
MODIFICATIONS, THE DECISION OF THE HISTORIC
AND ENVIRONMENTAL PRESERVATION BOARD, WHICH
DENIED A CERTIFICATE OF APPROPRIATENESS FOR
THE INSTALLATION OF A MEDIAN AND GATES ACROSS
THE DRIVING LANES OF NORTHEAST 55TH TERRACE
AT THE EASTERLY RIGHT-OF-WAY LINE OF NORTH
BAYSHORE DRIVE, WITHIN THE MORNINGSIDE
HISTORIC DISTRICT, MIAMI, FLORIDA.
WHEREAS, the Historic and Environmental Preservation Board
(HEPB) at its meeting of December 9, 1996, following an
advertised public hearing, adopted Resolution No. HEPB 96-35,
which denied a Certificate of Appropriateness for the
installation of a median and gates across the driving lanes of
Northeast 55th Terrace at the easterly right-of-way line of North
Bayshore Drive, within the Morningside Historic District, Miami,
Florida; and
WHEREAS, pursuant to Section 23 .1-5 (b) (4) (e) of the Code of
the City of Miami, Florida, as amended, an appeal to the City
Commission has been taken by the Department of Community Planning
and Revitalization on the grounds stated in its Notice of Appeal,
filed December 23, 1996; and
WHEREAS, the City Commission after careful consideration of
this matter finds that the stated grounds for the appeal and the

facts presented in support thereof do not justify reversing the
decision of the Historic and Environmental Preservation Board;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Commission hereby affirms the
decision of the Historic and Environmental Preservation Board,
with the following modifications, and denies the appeal giving
rise to this hearing:
a. That the existing "boom -gates" shall remain until
the election on guard gates in the neighborhood has taken place,
at which time the issue of "boom -gates" at this location, and the
disposition of this appeal, may be revisited by the City
Commission.
Section 3. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission deny the appeal of the
Department of Community Planning and Revitalization and modify the decision of the
Historic and Environmental Preservation Board, which denied a Certificate of
Appropriateness for the installation of a median and gates across the driving lanes of N.E.
55°i Terrace at the easterly right-of-way line of North Bayshore Drive, within the
Morningside Historic District, as follows:
1. The existing "boom" gates shall be permitted to remain until such time as an
election for the purpose of installing guard gates is held.
2. If the guard gates are approved, the boom gates shall be removed when the
guard gates are installed; if the guard gates are denied, the existing boom gates
shall be revisited by the City Commission.
BACKGROUND:
Both the existing "boom" gates and a more elaborate version with a median and
landscaping, which is the subject of this appeal, were denied by the Historic and
Environmental Preservation Board. Both the Preservation Officer and the Board
determined that the median and gates are inconsistent with the historic and architectural
character of the Momingside Historic District and its relationship to Biscayne Bay and
that approval would set a dangerous precedent for the installation of gates at N.E. 57''
Street and N.E. 59" Street (see attached Fact Sheet). Although the design of the gates in
the subject application is more aesthetically pleasing that the existing gates, the design is
more of a concern from a historic preservation standpoint.
Because an election will soon take place to decide whether guard gates will be installed at
the perimeter of the neighborhood, however, it seems reasonable to allow the existing

gates to remain until the outcome of the election is known. If the guard gates are
approved, there would be no need for boom gates. If the guard gates are defeated, the
City Commission should revisit the appropriateness of retaining the boom gate.

decision of the Historic and Environmental Preservation Board, reached on December 9,
1996, which denied a Certificate of Appropriateness for the installation of a median and
gates across the driving lanes of N.E. 55`h Terrace at the easterly right-of-way line of
North Bayshore Drive.
Because this proposed project is located in the public right-of-way and is being sponsored
by the City of Miami, and because there is so much neighborhood interest in the project,
it is appropriate that the City be the appellant in order to allow the appeal process to
occur.

PROJECT DESCRIPTION Application for Certificate of Appropriateness for the installation
of a median and gates across the driving lanes of NE 551h
Terrace at the easterly right-of-way line of North Bayshore Drive.
ANALYSIS On October 26,1995, the City of Miami Commission approved
the installation of gates to prevent access to the end of N.E. 551
Terrace, and the gates were recently installed. This work was
accomplished without the review of the Historic and
Environmental Preservation Board, but this omission was
rectified on September 17, 1996, when the application was
presented to the Board. The Board denied the application after
finding that the gates were inconsistent with the historic and
architectural character of the Morningside Historic District. The
Board indicated that it would consider a revised proposal.
As indicated previously, two issues are involved in the review of
this revised application. The first is the appropriateness of
installing gates in this location. The second is the design of the
gates themselves.
Only three streets within the Morningside Historic District extend
eastward from North Bayshore Drive to Biscayne Bay: NE 551h
Terrace, NE 571h Street, and NE 591h Street. The installation of
gates which block access to the end of 551 Terrace and
Biscayne Bay sets a dangerous precedent for the installation of
gates at the other two streets. This is inconsistent with the
character of the historic district and its relationship to Biscayne
Bay.
If the concept of gates is found to be acceptable, however, the
design of said gates should be compatible with the character of
the historic district. Although the design proposed in the present
application is more aesthetically pleasing than the previous
gates, it is more of a concern from a historic standpoint.

One of the Secretary of the Interior's "Standards for
Rehabilitation" states that, "Each property shall be recognized as
a physical record of its time, place, and use. Changes that
create a false sense of historical development... shall not be
undertaken." The proposed median has a tendency to create a
false historical appearance because NE 551hTerrace, unlike the
streets to the north, was never designed with a median.
Installing a new median here, even a small one, .could lead
people to believe that the NE 55" Terrace was originally
designed with a median. The gates proposed in the original
application, although aesthetically inappropriate, are clearly a
new feature and are preferable to the median from a historic
preservation standpoint.
RECOMMENDATION The Preservation Officer recommends that the application for a
Certificate of Appropriateness be denied because the median is
inconsistent with the historic and architectural character of the
Morningside Historic District, based on the analysis above..
Furthermore, it does not comply with the Secretary of the
Interior's "Standards for Rehabilitation" because it creates a false
historical appearance.

In the past, three billboards have been placed on the property at 2720 South Dixie
Highway. At this time, there is a request for a permit to place a new billboard at the same
site. The construction firm requesting a permit to construct this new billboard has agreed
to grant free advertising space to the City of Miami. In the past, several merchants who
work along 27th Avenue have complained that there is no sign that announces the
entrance to Coconut Grove on U.S. 1 and 27th Avenue. This free advertising space will
address the concern of these merchants, in addition to providing the City of Miami with
an opportunity to utilize the space for additional necessities. Therefore, I propose a
motion instructing the City Attorney to amend Ordinance 11000, Article 4, RT 6
Guideway Rapid Transit System Development District, Section 33-121-23,
