A RESOLUTION OF THE MIAMI CITY COMMISSION REQUESTING THE TRANSFER OF THE JURISDICTION OF FLAGLER STREET IN DOWNTOWN MIAMI FROM THE STATE OF FLORIDA TO THE CITY OF MIAMI TO ACCOMPLISH STREETSCAPE IMPROVEMENTS FOR THE FLAGLER MARKETPLACE PROJECT. WHEREAS, Flagler Street between Biscayne Boulevard and the Miami River is currently a State of Florida roadway; and WHEREAS, the City of Miami Public Works Department currently maintains this portion of Flagler Street by formal agreement between the City of Miami and the State of Florida; and WHEREAS, the Flagler Marketplace Project changes the classification of Flagler Street, in Downtown Miami from an arterial to a local roadway; and WHEREAS, the transfer of jurisdiction of this portion of Flagler Street from the State of Florida to the City of Miami is necessary to accomplish streetscape improvements for the Flagler Marketplace Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. �C'ITY comassIOPP MEETING OF FEB 2 7 1997 Resolution No. 97- 122 a Section 2. The Miami City Commission hereby requests the transfer of the jurisdiction of Flagler Street in Downtown Miami from the State of Florida to the City of Miami to accomplish streetscape improvements for the Flagler Marketplace Project. Background The City of Miami Public Works Department currently maintains this portion of Flagler Street by formal agreement between the City of Miami and the State of Florida. Stierheim City Manager I have received your July 2, 1996 letter. concerning the transfer of the jurisdiction• of Flagler Street in downtown Miami from the State of Florida to the City in order to accomplish the Flagler Marketplace project and have the following comments. The City of Miami Public Works Department currently maintains Flagler Street between West 2r�d Avenue and Biscayne Boulevard by formal agreement between the City and State. Metropolitan Dade County and the Florida Department of Transportation currently have jurisdiction for the traffic operations on this roadway. The Public Works Department has no objection to the transfer of the jurisdiction of Flagler Street from the State to the City. In accordance with the Dade County Code, the jurisdiction for the traffic operations shall remain with the County after the transfer of the roadway jurisdiction.
