A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ISSUE A REVOCABLE LICENSE, IN A. FORM
ACCEPTABLE TO THE CITY ATTORNEY, TO SOUTHEAST
MARINE REPAIR, INC., ("SOUTHEAST,,), THEREBY
AUTHORIZING SOUTHEAST TO OCCUPY ON A MONTH TO
MONTH BASIS, FOR THREE MONTHS, A CERTAIN AREA
AT THE MARINE STADIUM MARINA, LOCATED AT 3501
RICKENBACKER CAUSEWAY, MIAMI, FLORIDA, FOR
PURPOSES OF PROVIDING MARINE RELATED REPAIRS;
SAID LICENSE CONTINGENT UPON SOUTHEAST PAYING
THREE MONTHS RENTAL, IN ADVANCE, TO THE CITY
IN THE AMOUNT OF $4,500 AND COMPLYING WITH
THE CITY'S STANDARD INSURANCE AND
INDEMNIFICATION REQUIREMENTS.
WHEREAS, the City owns and operates a marina known as the
Marine Stadium Marina located at 3501 Rickenbacker Causeway,
Miami, Florida (the "Marina"); and
WHEREAS, from time to time the customers of the Marina
require the marine related repair services for their vessels; and
WHEREAS, presently there is space available wherein such
services may be conducted;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. The City Manager is hereby authorizedl/ to
issue a revocable license, in form acceptable to the City
Attorney, to Southeast Marine Repair, Inc., ("Southeast"),
thereby authorizing Southeast to occupy on a month to month
basis, for three months, a certain area at the Marine Stadium
Marina located at 3501 Rickenbacker Causeway, Miami, Florida, for
purposes of providing marine related repairs, said license
contingent upon Southeast paying three months rental, in advance,
to the City in the amount of $4,500 and complying with the City's
standard insurance and indemnification requirements.
Section 3. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Resolution
authorizing the City Manager to enter into a Revocable License Agreement, in a form acceptable
to the City Attorney, with Southeast Marine Repair, Inc. to occupy a portion of office space at
Marine Stadium Marina, 3501 Rickenbacher Causeway, Miami, Florida.
BACKGROUND
The City is the owner of real property located at 3501 Rickenbacker Causeway, Miami, Florida,
known as the Marine Stadium Marina. The Department of Conferences, Conventions and Public
Facilities has determined that a portion of the available space located at such property is not
required for use by the City at this time. The department recommends that the City Manager be
authorized to enter into a Revocable License Agreement with Southeast Marine Repair, Inc. to
occupy and use approximately 1,700 sq. ft., of which 1,200 sq. ft. is open garage space. The
license agreement is to be on a month to month basis, and require a monthly payment of $1500.
The projected annual revenues will be $18,000. The rents charged to marine repair shops at
comparable marinas has been researched and we find the proposed rate to be fair market value.

It is that you authorize for the next City Commission Meeting the inclusion of a
resolution authorizing the City Manager to enter into a revocable License Agreement with
Southeast Marine Repair, Inc. to occupy 1700 sq. ft., of which 1,200 sq ft. is open garage space.
The- license agreement is to be on a month to month basis, and require a monthly payment of
$1500. The projected annual revenues will be $18,000. We have researched the rents charged to
marine repair shops at comparable marinas and found the proposed rate to be fair market value.
Southeast Marine Repair, Inc. has been operating at the Marine Stadium Marine since prior to the
City of Miami's take over of the property in December, 1995. The operation consists primarily
of boat repairs and marine related merchandise sales. The company has an established clientele
and a very good reputation with the clients of the marina.
It is my understanding that Southeast Marine Repair, Inc. has been occupying the existing space
with a verbal agreement with my predecessor. The agreement required Southeast Marine to
repair any damages caused by the forklift operators in exchange for rent Our research has
determined that damages which have been caused by the forklift operators are few and relatively
inexpensive. We recommend that the City enter into a License Agreement and that rent be
collected immediately for the amount proposed.
