A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE ALL NECESSARY AGREEMENTS AND
AMENDMENTS THERETO, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, WITH SOUTH FLORIDA JAIL
MINISTRIES/AGAPE WOMEN'S CENTER, INC. (AGAPE) TO
PROVIDE HOUSING, DRUG REHABILITATION AND
COUNSELING TO LOW INCOME PERSONS LIVING WITH
HIV/AIDS, AND WITH CURE AIDS NOW, D/B/A FOOD FOR
LIFE NETWORK, TO PROVIDE NUTRITIONAL SERVICES
TO LOW INCOME PERSONS LIVING WITH HIV/AIDS;
ALLOCATING FUNDS THEREFOR FOR AGAPE, IN THE
AMOUNT OF $100,000, AND FOR CURE AIDS NOW, IN THE
AMOUNT OF $29,280, FROM FISCAL YEAR 1996 HOUSING
OPPORTUNITIES FOR PERSONS WITH AIDS (I-IOPWA)
PROGRAM GRANT FUNDS.
WHEREAS, the Housing Opportunities for Persons With AIDS (HOPWA) Program
was created under the AIDS Housing Opportunity Act, and revised under the Housing and
Community Development Act of 1992; and
WHEREAS, Section 606(d)(2) of the Housing and Community Development Act of
1992 stipulates that the City of Miami, being the most populous unit of general local government
in an eligible metropolitan statistical area (EMSA), not including county government, must be the
applicant for the HOPWA Grant and be allocated the related funding; and

WHEREAS, in March, 1996, the City of Miami submitted a Consolidated Plan to the
U.S. Department of Housing and Urban Development (HUD) for funding the Community
Development Block Grant (CDBG), Housing Opportunities for Persons With AIDS (HOPWA),

Home Investment Partnerships (HOME), and Emergency Shelter Grant (ESG) Programs from
Fiscal Year 1996 federal funding; and
WHEREAS, in April, 1996, the City Commission, pursuant to Ordinance No. 11355,
established a special revenue fund entitled "Housing Opportunities for Persons With AIDS
(HOPWA) Grant Program FY 1996," and appropriated eight million, three hundred fifty-nine
thousand dollars ($8,359,000) from U.S. HUD funding for the implementation and administration
of the 1996 HOPWA Program; and
WHEREAS, AGAPE, was specifically identified and recommended in the City's 1996
Consolidated Plan to receive funding in the amount of one hundred thousand dollars ($100,000)
from the City's 1996 HOPWA Grant to provide housing, drug rehabilitation and counseling to
low income persons living with HIV/AIDS; and
WHEREAS, Cure AIDS NOW, Inc., d/b/a Food for Life Network, was specifically
identified and recommended in the City's 1996 Consolidated Plan to receive funding in the
amount of twenty-nine thousand, two hundred eighty dollars ($29,280) from the City's 1996
HOPWA Grant to provide home delivered meals (nutritional services) to low income persons
living with HIV/AIDS;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section,

Section 2. The City Manager is hereby authorized" to execute an agreement and
any amendments thereto, with South Florida Jail Ministries/AGAPE Women's Center, Inc.
("AGAPE") for the provision of housing, drug rehabilitation and counseling services to low
income persons living with HIV/AIDS, with funds therefor hereby allocated, in the amount of
$100,000, from Fiscal Year 1996 Housing Opportunities for Persons with AIDS (HOPWA)
Program Grant funds.
Section 3. The City Manager is hereby authorized/ to execute an agreement and
any amendments thereto, with CURE AIDS NOW, Inc. d/b/a Food for Life Network, for the
provision of nutritional services (home delivered meals) to low income persons living with
HIV/AIDS, with funds therefor hereby allocated, in the amount of $29,280, from fiscal Year
1996 Housing Opportunities for Persons with AIDS (HOPWA) Program Grant funds.

Section 4. This Resolution shall become effective immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached resolution, allocating
$100,000 to South Florida Jail Ministries/AGAPE Women's Center, Inc. and $29,280 to CURE AIDS
NOW, Inc., from the City's Fiscal Year 1996 - 1997 Housing Opportunities For Persons With AIDS
(HOPWA) Grant Program, for the provision of housing, drug rehabilitation and nutritional services to
low income persons living with HIV/AIDS.
The attached resolution further authorizes the City Manager to execute a memorandum of agreement
and any amendments with the aforementioned local AIDS service providers, in a form acceptable to
the City Attorney.
BACKGROUND:
In March, 1996, through Resolution No. 96-208, the City Commission authorized the City Manager'to
submit the City's Fiscal Year 1996 - 1997 Consolidated Plan to the U.S. Department of Housing and
Urban Development for funding, under the Community Development Block Grant (CDBG) Program
($13,709,000); HOME Investment Partnership Program (HOME) ($4,038,000); Emergency Shelter
Grant (ESG) ($494,000); and the Housing Opportunities for Persons With AIDS Program (HOPWA)
($8,359,000). The said resolution further authorized the City Manager, upon approval of the City's
Consolidated Plan by U.S. HUD, to accept the aforementioned formula program grants and execute the
necessary implementing agreements, in a form acceptable to the City Attorney and subject to
applicable City Code provisions.

The Consolidated Plan included an Action Plan which reflected specific projects to be implemented by
the City of Miami through the Fiscal Year 1996 - 1997 Housing Opportunities For Persons With AIDS
Program Grant funding of $8,359,000 from U.S. HUD. The Action Plan recommended and identified
the following two (2) projects designed to provide services to low income persons living with
HIV/AIDS:
South Florida .Tail Ministries/AGAPE Women's Center, Inc —This agency is being
recommended for funding at a level of $100,000 to provide housing, drug
rehabilitation and counseling services to low income persons living with HIV/AIDS.
Cure AIDS NOW, Inc. —This agency is being recommended for funding at a level of
$29,280 to provide nutritional services (home delivered meals) to low income
persons living with HIV/AIDS.
The aforementioned local AIDS service providers are being recommended by both the 1996
HOPWA Advisory Board and the City Administration for 1996 HOPWA Program funds,
because of the critical need for housing assistance and related services by low income
persons with HIV/AIDS in the community.
The proposed resolution further effectuates the intent of the City's approved Consolidated
Plan by allocating $129,290 in Fiscal Year 1996 HOPWA Program funding to the
aforementioned previously approved agencies and further authorizes the City Manager to
execute the necessary agreements with the said agencies, in a form acceptable to the City
Attorney.
In an effort to expedite the provision of housing and related services to low income persons living with
HIV/AIDS, City Commission ratification of the attached resolution is recommended.
