HomeMy WebLinkAboutR-97-0072J-97-57 1 /13/97 RESOLUTION NO. g 7 — 7 A RESOLUTION ACCEPTING THE BID OF CLUB CAR, INC., FOR THE LEASING OF SEVENTY (70) ELECTRIC GOLF CARTS AND FOUR (4) UTILITY TRUCKS ON A FIVE (5) YEAR LEASE CONTRACT BASIS, FOR THE DEPARTMENT OF PUBLIC WORKS, AT A TOTAL PROPOSED ANNUAL COST OF $52,539.84; CONDITIONING SAID ACCEPTANCE UPON THE CITY HAVING THE RIGHT TO CANCEL SAID LEASE, WITHOUT PENALTY, UPON GIVING A THIRTY (30) DAY NOTICE OF SUCH; ALLOCATING FUNDS THEREFOR FROM THE DEPARTMENT OF PUBLIC WORKS, ACCOUNT CODE NO. 417000.311501.6330.61039; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR THIS PURPOSE. WHEREAS, pursuant to public notice, sealed bids were received December 23, 1996 for the leasing of seventy (70) golf carts and four (4) utility trucks for use at the Miami Springs Golf Course for the Department of Public Works; and WHEREAS, invitations for Bid No. 96-97-022 were mailed to twenty one (21) potential bidders and three (3 ) bids were received; and WHEREAS, funds for this service are available from the Department of Public Works FY' 96-97 Account Code No. 417000.31 1501.6330.61039; and WHEREAS, the City may terminate the lease, with no penalty or cost to the City, upon giving a thirty (30) day notice of such, in the event funds are not available for all lease payments due during a fiscal period; and CITY COyWEETiXG OF ggISSI0.N OF A N n ,� 397 t?esolution No. 72 ,9:. WHEREAS, the City Manager and the Assistant City Manager of the Department of Public Works recommend that the Sid received from Club Car, Inc. be accepted as the lowest and most responsible and responsive bid; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The December 23, 1996 bid submitted by Club Car, Inc., for the leasing of approximately seventy (70) electric golf carts and four (4) utility trucks on a lease contract basis for five (5) years, at a total proposed annual cost of $52,539.84, for the Department of Public Works, conditioning said acceptance upon the City having the right to cancel said lease, without penalty, upon giving a thirty (30) day notice of such, is hereby accepted, with funds therefor hereby allocated from the Department of Public Works FY' 96-97 Account Code No. 417000.31 1501.6330.61039. Section 3. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for this purpose. Section 4. Funds are available from the Department of Public works Account Code NO.41700-311501-610. This is a five (5) year lease/contract, however, pursuant to Bid No. 96-97-022 "in the event no funds or insufficient funds are appropriated and budgeted or are otherwise unavailable in any fiscal period for lease payments due under the lease, then lessee, upon written notice to lessor or his assignee of such occurrence shall have the unqualified right to terminate the lease on the last day of the fiscal period for which appropriations have been received or made, without any penalty of expense to lessee". BACKGROUND The Department of Public Works has analyzed the bids received pursuant to Bid No. 96-97-022 for the leasing of seventy (70) golf carts and four (4) utility vehicles to be used at the Miami Springs Golf Course. Twenty one (21) invitations for bids were mailed and three responses were received. While Yamaha Golf cars was the apparent low bidder on one of the three items, they did not bid on all three items as requested by the Special Conditions of Bid No. 96-97-022; therefore, Yamaha Golf Cars' bid was deemed non -responsive. All items on this bid are integral and necessary for the operation of the Golf Course, therefore, Club Car, Inc. meets all the Department's requirements and offers the lowest most responsible and responsive bid. Further, it is noted that Club Car, Inc. will accept this contract in its entirety and not a portion of it. Club Car's extremely aggressive proposal was presented for the total bid package, and not just a portion of the package. in addition, please note that Club Car is the only manufacturer that is 1001/16 compliant with the City of Miami's equipment bid specifications. For example, Yamaha is non- compliant regarding the requirements for the suspension, steering mechanism and maximum Clearance circle features that are mandatory for Miami Spring's golf car fleet.
