ORDINANCE NO. 11579
AN EMERGENCY ORDINANCE AMENDING CAPITAL
IMPROVEMENTS ORDINANCE NO. 11337, AS AMENDED,
ADOPTED JANUARY 25, 1996; CONTINUING, REVISING,
AND ESTABLISHING CAPITAL IMPROVEMENT
PROJECTS; PROVIDING CONDITIONS, AUTHORIZATIONS
AND DIRECTIONS TO THE CITY MANAGER AND CITY
CLERK; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the administration has designated certain projects proposed to
be undertaken in Fiscal Year 1996-1997 with General Obligation Bonds, Revenue
Bond Funds, Enterprise Funds, General Fund Revenue, and with some Federal and
State Funds and private contribution, pursuant to Sections 30 and 34 of the City
Charter, and has included them in this proposed amending ordinance; and
WHEREAS, the City Commission pursuant to Ordinance No. 11337, adopted
January 25, 1996, established appropriations for Capital Improvements, continued
previously approved Capital Improvement Projects, and established new Capital
Improvement Projects to begin during Fiscal Year 1996-97; and
WHEREAS, It is urgent for the preservation of public property to revise
these projects and establish new capital projects scheduled to commence during
Fiscal Year 1997-98; and

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Ordinance are hereby adopted by reference thereto and incorporated herein as if
fully set forth in this Section.

"Section 1. The herein appropriations are hereby made for
implementation of all municipal Capital Improvements of the City of Miami,
including new Capital Improvement Projects scheduled to begin during fiscal
year 1995-1996. The herein appropriations which are hereby designated by
reference to descriptive project title and number also include appropriations
for previously approved scheduled projects as well as reappropriations of prior
fund appropriations. The source of revenues to support the herein
appropriations is hereby identified by fund and project with the project
appropriations with revenues therefor being set forth for seven program ( I -
VII ) areas based upon use or functional category within said areas, as
follows:

inconsistent or in conflict with the provisions of this Ordinance are hereby repealed.
Section 4. If. any section, part of section, paragraph, clause, phrase or
word of this Ordinance is declared invalid, the remaining. provisions of this
Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for the preservation of peace, health,
safety, and property of the City of Miami and upon the further grounds of the
necessity to make the required and necessary purchases and payments and to
generally carry out the function and duties of municipal affairs.
Section 6. The requirements of reading this Ordinance on two separate
days is hereby dispensed with by a vote of not less than four -fifths of the members
of the commission.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt this
emergency ordinance amending Capital Improvement Ordinance No.
11337, adopted January 25, 1996, which established appropriations for
Capital Improvements, continued previously approved Capital
Improvement Projects to begin during Fiscal Year 1997-1998.
BACKGROUND
The City of Miami has received funding from Metropolitan Dade County
"Save Neighborhood Parks Bond Program" for the purpose of financing
Capital Improvement projects for certain parks, beaches, natural areas and
recreational facilities. The City of Miami has also received additional funds
from various grant sources, reappropriated funds from completed and
ongoing projects for the continuation and implementation of new and
established Capital Improvement Projects. Anticipated cash flow prior to
February necessitates that this be approved in one reading.
