HomeMy WebLinkAboutO-11572J-97-682 9/26/97 ORDINANCE NO. 11572 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 11395, ADOPTED AUGUST 23, 1996, WHICH ESTABLISHED INITIAL RESOURCES AND INITIAL APPROPRIATIONS FOR A SPECIAL REVENUE FUND ENTITLED "VICTIMS OF CRIME ACT", THEREBY INCREASING SAID APPROPRIATION, IN THE AMOUNT OF $7,980.08, CONSISTING OF A GRANT FROM THE STATE OF FLORIDA, OFFICE OF THE ATTORNEY GENERAL; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THIS PURPOSE; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Miami Police Department responds to approximately 100,000 calls per year where there is a victim of a crime; and WHEREAS, these victims, as well as the Police Department, would greatly benefit from having the services of in-house Victim Assistance Counselors; and WHEREAS, the State of Florida, Office of the Attorney General, has approved an award, in the amount of $7,980.08, to be used for the payment of salaries for counselors; and WHEREAS, any purchases would have to comply with applicable City Code purchasing requirements; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: r4. . 11572 C] • Section 1. The recitals and findings contained in the preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 2 of Ordinance No. 11395, adopted August. 23rd, 1996, is hereby amended in the following particulars:' "Section 2. Additional grant funds are hereby appropriated to the "Victims of Crime Act" special revenue fund as follows: FUND TITLE: Victims of Crime Act RESOURCES: State of Florida, Office of the Attorney General Grant APPROPRIATIONS: Victims of Crime Act Salaries Reporting Training $31,661 $39,641.08 $30,441 $38,421.08 $ 1,000 $ 250" Section 3. The City Manager is hereby authorized2, to accept the grant as set forth in the Preamble to this Ordinance and to enter into the necessary contract(s) and/or agreements(s), in a form acceptable to the City Attorney, for acceptance of the aforesaid monies. Section 4. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. ' Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. z The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 11572 E Section 6. The Grant period is from July 1st, 1997 to September 30th, 1997. It is, therefore, necessary to enact an Emergency Ordinance so that the Grant may be accepted and utilized to its full potential. Section 7. The requirements of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 8. The date of adoption of Ordinance No. 11395 was September 12, 1996 therefore the reference to its adoption date in Ordinance No. l 1637 ought to be corrected as a scriveners' error. 2. BACKGROUND: Ordinance No. 11395, established resources and appropriations for the "Victims of Crime Act" (VOCA) Grant in the amount of $31,661.00. The Office of the Attorney General granted an extension of the grant through September 30"', 1997, with additional funds totaling $7,980.08. On July 80', 1997, the Department of Police was notified by the Office of the Attorney General of a grant extension through September 30t', 1997, to be funded with an additional $7,980.08. These additional monies would be applied towards the salary of the Victim's Assistance Counselors. Due in part to the untimely notice of the extension and due to the fact that there would be No Regular Commission Meeting until September 9", 1997, an emergency authorization was requested and obtained to enable the Department of Police to continue with their Victim's Advocate Program, and continue the services of the Victim's Assistance Counselors.
