ORDINANCE NO. 115 0 O
AN ORDINANCE AMENDING THE ZONING ATLAS OF THE
CITY OF MIAMI, FLORIDA, FOR THE PROPERTY
LOCATED AT 1548 BRICKELL AVENUE BY ADDING THE
HP HISTORIC PRESERVATION OVERLAY DISTRICT;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Miami Zoning Board, at its meeting of
June 21, 1997, Item No. 4, following an advertised hearing,
adopted Resolution No. ZB 83-97, by a seven to zero (7-0) vote,
RECOMMENDING APPROVAL. of a modification of the zoning
classification, as hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this zoning classification modification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 11000, the
Zoning Ordinance of the City of Miami, Florida, is hereby amended
by adding the HP Historic Preservation Overlay District to the

property located at 1548 Brickell Avenue, Miami, Florida, more
particularly described as Lots 37 and 38, Block 55, of FLAGLER
SUBDIVISION, according to the Plat thereof, as recorded in Plat
Book 5 at Page 44, of the Public Records of Dade County, Florida.
Section 2. It is hereby found that this zoning
classification change:
(a) is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) is not contrary to the established land use pattern;
(c) will not create an isolated district unrelated to
adjacent and nearby districts;
(d) is not out of scale with the needs of the neighborhood
or the City;
(e) will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) is necessary due to changed or changing conditions;
(g) will not adversely influence living conditions in the
neighborhood;
(h) will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) will not create a drainage problem;
(j) will not seriously reduce light and air to adjacent
area;
(k) will not adversely affect property value in the
adjacent area;

(1) will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations; and
(m) will not constitute a grant of special privilege to an
individual owner so as to compromise the protection of
the public welfare.
Section 3. Page Nos. 34 and 37 of the Zoning Atlas, made
a part of Ordinance No. 11000, as amended, by reference and
description of said Ordinance, is hereby amended to reflect the
changes made necessary by this Amendment.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph',
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective after
final reading and adoption thereof pursuant to Section 163.3189,
Florida Statutes.

ANALYSIS FOR ZONING CHANGE
1548 Brickell Avenue
CASE NO.: 97-0036
Pursuant to Article 4, Section 401 and Article 7, Section 701 of Ordinance No. 11000, as
amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal for an
amendment to the Zoning Atlas has been reviewed as follows:
The request is to change the Zoning designation as follows:
The George E. Nolan House, (complete legal description on file with the Office of
Hearing Boards) from "R-3 Multifamily Medium -Density Residential to R-3
Multifamily Medium Density Residential and HP Historic Preservation Overlay
Districts."
The following findings have been made:
• It is found that subject property has been designated as a historic site pursuant to
Section 23-4 of the Miami City Code and is therefore eligible to apply for the HP
Historic Preservation Overlay District.
• It is found that the potential value of the property, if developed to its highest and best
use, so far exceeds its value as a single family residence that it would be an undue
economic hardship for a new owner to retain the historic building for its present or
permitted use.
• It is found that it is neither architecturally nor economically feasible to convert the
historic building to a multifamily use.
• It is found that the only means of assuring the preservation of the historic building is
to allow an adaptive use. Without such a use, the building will surely be demolished.
• It is found that the historic preservation overlay district was applied to the adjacent
historic site (Petit Douy) at 1500 Brickell Avenue in 1982, that this property has been
successfully operating as a professional office since that time, that no complaints have
been received about said use, and that no adverse effects on the neighborhood have

• It is found that the proposed use of the subject property as professional offices will
run with the preservation of the historic building, not with the land, and that if the

building is destroyed, the use will no longer be permissible. Said use is permissible
only within the historic building.
• It is found that because the application of the HP overlay is tied completely to the
preservation of a historic building, the approval of said overlay will in no way set a
precedent for the approval of similar uses on Brickell Avenue.
• It is found that the proposed use of the subject property offices will provide a public
benefit by preserving the heritage of the City of Miami, will not have an adverse
effect on the neighborhood, and will, in fact, generate less traffic and noise than the
permitted use of the property.
• It is found that if the HP overlay is approved, all plans to implement the new use
would require a public hearing before the Historic and Environmental Preservation
Board.
Based on these findings, the Department of Planning and Development recommends
approval of the application as presented.

9) Statement explaiLing why present zoning designation is inappropriate.
Our house is located on Brickell Avenue in an area that has a present zoning of R-3 (multi -family
dwellings). The area is rapidly being developed with apartments and condominiums. The
current structure on the property is a single-family mansion built in 1925 that has been given a
Historic Designation by the City of Miami's Historic and Environmental Preservation Board (we
are also looking into being listed on the National Register of Historic Places). The costs of
maintaining the house (not to mention restoration costs) are beyond our means. Though the
house has been on the market for many years, no one was interested in purchasing and renovating
the house with its present zoning designation. Because the value of the land is worth more than
the value of a single-family house, it will not be economically feasible to retain the house as a
single family residence when we sell the property.
The house, in its present zoning designation, is in eminent danger of demolition. If demolished,
our beautiful historic home would be lost .for all times. A developer has purchased the property
adjacent to the ours and would like to tear down our home and build an apartment building on
the two pieces of property. This would be the highest and best use of the property in its present
zoning designation, but not in the best interest of the City of Miami. Miami would lose one of
the last remnants of "Millionaire's Row" and of a bygone era.
10) Statement as to why proposed zoning designation is appropriate.
We are seeking an HP overlay district classification for our property. We are seeking the historic
overlay in order to encourage and assure the preservation of our historically designated home.
The house was given a Historic Designation by the City of Miami's Historic and Environmental
Preservation Board (we are also looking into applying to be listed on the National Register of
Historic Places). As we have limited means, in order to renovate the house following the
Department of the Interior's guidelines and meeting all of the City of Miami's Historic and
Environmental Preservation Ordinance criteria and regulations, we would need to attract a
someone willing to expend large amounts of money.
The law firm of Salussolia & Associates, embracing the home's unique architectural character
and historic significance, has placed a purchase offer on the house contingent upon the ability to
use the house for professional offices. With an eye toward recapturing the home's splendor, the
firm plans to renovate to the standards listed above. This would give Brickell Avenue and all of
South Florida an elegant, visual reminder of another era.
Petit Douy (1931), a former single family home at 1500 Brickell Avenue, received a HP zoning
overlay in 1982 and has been a professional office since that date. It has maintained its single-
family feeling and is considered a successful use of HP zoning overlay in order to preserve one
of the last estate homes on Brickell Avenue. In order to preserve our historically designated
home from eminent demolition, we also need an HP overlay district classification for the
property.

Dear Mr. Foeman:
This correspondence is written on behalf of Tory Jacobs,
individually, and the Brickell Homeowners Association (the
"Homeowners"). The purpose of this correspondence is to voice a
strong objection to the above -referenced item. It is respectfully
requested that this letter be made a part of the record of said
item and distributed to the City Commissioners as they consider it.
The Homeowners shall appear at the second reading on this items and
reiterate their objections in person. In this regard, it is
respectfully requested that the second reading be scheduled for a
time certain after 5:00 p.m. in order to allow the affected
residents to attend.
The Homeowners' objection is not based on opposition to
historical preservation. To the contrary, the objection is based on
the fact that this application represents yet another commercial
intrusion into residential Brickell Avenue. It unfortunately
follows in the wake of the plastic surgeon's application for a
professional office at 1900 Brickell. It is feared that the
Commission's approval of that item despite the overwhelming
objections and legal arguments of the Brickell Avenue residents has
clearly paved the way for the commercialization of residential
Brickell Avenue.
