AN ORDINANCE AMENDING THE CITY CODE, CHAPTER 4 ENTITLED: "ALCOHOLIC BEVERAGES," BY AMENDING SECTION 4-11, ENTITLED"EXCEPTIONS TO DISTANCE REQUIREMENTS," TO ADD EXCEPTIONS FOR LEGITIMATE LIQUOR ESTABLISHMENTS WHICH PRECEDE SCHOOLS OR CHURCHES; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend the Code of the City of Miami; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 4 of the Code of the City of Miami, Florida, as amended, is hereby amended as follows-.!/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. 11567 "CHAPTER 4 ALCOHOLIC BEVERAGES ARTICLE I. IN GENERAL Seca 4-14 Exceptions to distance requirements. h) It is herebv intended that. pursuant to Section 1101.5 of Zonin Ordinance 11000, legitimate alcoholic beverage establishments with a certificate of use and certificate of occupancy, which precede the establishment of a school or church, within the distance limitations set forth herein, shall not be deemed to have nonconforming status; therefore, the restrictions as to distance requirements between said establishments, and schools and churches shall not be required. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof. BACKGROUND The proposed modification seeks to add an exception clause to Chapter 4 of the City Code, as amended, entitled "Alcoholic Beverages". Article 1, Sec. 4-14 is amended to specify that alcoholic beverage establishments with a certificate of use and certificate of occupancy, which precede the establishment of a school or church, within the distance limitations established in the code, shall not be deemed to have non -conforming status; therefore, the restrictions as to distance requirements between said establishments, and schools and churches shall not be required. The amendment to Chapter 4 of the City Code along with the companion amendment to Article 11 of Zoning Ordinance 11000, would not deem alcoholic beverage establishments which precede a school or church to be non -conforming, with respects to distance requirements. This non -conforming status would preclude the alcoholic beverage establishment in question from expansions or certain modifications. This amendment is a matter of allowing these establishments to -not be penalized for something that happened nearby after they have followed all the pertinent regulations. 11567 WALTER J.
