HomeMy WebLinkAboutO-11563J-97-752 10/21/97 ORDINANCE NO. 11563 AN EMERGENCY ORDINANCE, WITH ATTACHMENT (S), AMENDING THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TO PERMIT THE SALE, DISPENSING, POSSESSION, AND CONSUMPTION OF ALCOHOLIC BEVERAGES AT THE FEC PROPERTY, MIAMI, FLORIDA, LEGALLY DESCRIBED ON ATTACHMENT ;;!'A", ATTACHED HERETO AND MADE A PART HEREOF; MORE PARTICULARLY BY AMENDING SECTIONS 38-69 AND 38-70 OF SAID CODE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City is 'the fee simple owner of a parcel of waterfront land commonly known as the FEC Tract ("the Property") which is not needed at this time for municipal purposes; and WHEREAS, Metropolitan Dade County (the "County") and the City have entered into an Interlocal Cooperation Agreement for Sale and Purchase ("the Agreement") providing for the purchase by the County of a portion of the Property; and WHEREAS, pursuant to the terms of the Agreement, prior to, closing, the City is required to remove any restriction on the sale or consumption of alcoholic beverages on any portion of the property being°conveyed to the County; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend the Code of the City of Miami; 11563 • • NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Sections 38-69 and 38-70 of the Code of the City of Miami, Florida, as amended, are hereby amended in the following particulars:''' "Sec. 38-69. Alcoholic beverages; intoxicated persons. (a) (b) Notwithstanding any provision in the city Code of the City of Miami, Florida; to the contrary, the city manager or his/her designee, on special occasions and for special events or programs, is hereby authorized upon execution of the application/permit form as attached (note: the form is not set out in this Code), to permit the sale or dispensing of wine or beer in soft containers in the following city parks: (1) Bayf ront Park. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 4. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 5. It should be noted that the adoption of this legislation is a condition of the purchase and sale agreement for the FEC Property with Metropolitan Dade County. BACKGROUND The City and Metropolitan Dade County have negotiated the terms and conditions for the sale of the City property known as the FEC Property. As a condition of said sale, the City must modify its current prohibition against alcoholic beverages in parks, specifically removing this prohibition for the FEC Property.
