ENTITLED: "SOUTHEAST OVERTOWN/PARK WEST REDEVELOPMENT DISTRICT AND COMMUNITY REDEVELOPMENT AGENCY" ("CRA"), OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, THEREBY DESIGNATING THE DIRECTOR OF THE DEPARTMENT OF PLANNING AND DEVELOPMENT AS THE CHIEF EXECUTIVE OFFICER OF THE CRA AND PROVIDING ADDITIONAL STAFF SUPPORT TO THE CRA; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Section 14-285 entitled "Employees generally" of Article V entitled "Southeast Overtown/Park West Redevelopment District and Community Redevelopment Agency,',' of the Code of the City of Miami, Florida, as amended, the City Commission in its capacity as the governing body ("Board") of the Southeast Overtown/Park West Community Redevelopment Agency ("CRA') employed and fixed the compensation of the chief executive officer and the staff of the CRA, who served at the pleasure of the Board; and WHEREAS, it is the intent of the City Commission to make the most efficient use of its powers, resources, authority and capabilities as the Board of the CRA by designating the Director of the City's Department of Planning and Development ("Department") as the chief executive officer of the CRA and transferring the staff of the CRA to the Department; REPEALED By ORD11NpNt� i161 • • NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 14-285 entitled "Employees generally" of Article V entitled "Southeast Overtown/Park West Redevelopment District and Community Redevelopment Agency", of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:' "ARTICLE V. SOUTHEAST OVERTOWN/PARK WEST REDEVELOPMENT DISTRICT AND COMMUNITY REDEVELOPMENT AGENCY Section 14-285. Employees generally. The board city manager shall employ and fix the compensation of the following, who shall seFve at the pleasure a be assigned to work with the board: (1) Director of Department of Planning and Development. A The Director of the Department of Planning and Development who shall act as the chief executive officer of the agency. Subject to the policy directives of the agency, the director shall have general supervision over and be responsible for the operation and-, maintenance of all agency properties, activities, and facilities. The director shall attend all meetings of the board, shall furnish the board with such information or reports with respect to the operation, maintenance and financial condition of the agency as the board may from time to time require. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less that four -fifths of the members of the Commission. Section 7. Background On May 5, 1997, the Five -Year Plan, as amended, was approved by the City Commission and subsequently approved by the State Financial Oversight Board. A critical component of the Five -Year Plan is a reorganization plan that provides for certain City organizational structure enhancements. Among the changes provided for in the plan is the merging of the CRA and the Office of Asset Management into the former Department of Community Planning and Revitalization, thereby creating the new Department of Planning and Development. The Office of Asset Management merger has been completed and this ordinance seeks your approval to merge the CRA.
