HomeMy WebLinkAboutO-11545J-97-658 9/ 16/97 ORDINANCE NO. 11545 AN EMERGENCY ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED:"WAGES COALITION, REGION 23, DADE AND MONROE COUNTIES, STATE DEPARTMENT OF CHILDREN AND FAMILIES" AND APPROPRIATING FUNDS FOR THE OPERATION OF THE PROGRAM IN THE AMOUNT OF $1, 500, 000.00 FROM THE STATE OF FLORIDA WORK AND GAIN ECONOMIC SELF- SUFFICIENCY (WAGES) COALITION GRANT AWARD; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE FLORIDA STATE DEPARTMENT OF CHILDREN AND FAMILIES FOR THE ACCEPTANCE OF SAID GRANT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Congress of the United States adopted Public Law 104-193, the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, amending section 402 of the Social Security Act on August 22, 1996; and WHEREAS, the Legislature of the .State of Florida adopted Chapter 96-175, Laws of Florida, Work and Gain Economic Self -Sufficiency (WAGES) Act, creating Chapter 414 of the Florida Statutes and the WAGES Jobs and Benefits Program, establishing a program to convert federal long-term assistance to families with dependent children into Temporary Assistance to Needy Families (TANF) with a strong focus on job placement rather than economic subsidy and a work first approach, to strengthen the opportunities for self-sufficiency for families in need in Dade and Monroe Counties; and WHEREAS, the WAGES COALITION, REGION 23, DADE AND MONROE COUNTIES, STATE DEPARTMENT OF CHILDREN AND FAMILIES has awarded the City $1,500,000.00 under the PY'97 WAGES COALITION, REGION 23 for WAGES Participants to 11545 �I] train and provide job placement assistance for adults currently receiving Temporary Assistance for Needy Families ( TANF); NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following special revenue fund is hereby established and resources are hereby appropriated as described: FUND TITLE: "WAGES COALITION, REGION 23, DADE AND MONROE COUNTIES, STATE DEPARTMENT OF CHILDREN AND FAMILIES" RESOURCES: STATE OF FLORIDA WAGES COALITION THROUGH THE WAGES COALITION, REGION 23 DADE AND MONROE COUNTIES, DEPARTMENT OF CHILDREN AND FAMILIES $1,500,000 APPROPRIATION: WAGES COALITION, REGION 23, DADE AND MONROE COUNTIES, DEPARTMENT OF CHILDREN AND FAMILIES $1,500,000 Section 3. This appropriation is contingent upon funding by the Wages Coalition, Region 23, Dade and Monroe Counties, Department of Children and Families and the City Manager's acceptance thereof. Section 4. The City Manager is hereby authorized' to accept the grant and to execute the necessary agreements, in a form acceptable to the City Attorney, with the Wages Coalition, Region 23, Dade and Monroe Counties, Department of Children and Families. Section 5. The herein authorization shall remain valid and outstanding even if the anticipated grant award is reduced or increased. Section 6. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. 'The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2 11545 Section 7. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected Section 8. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 9. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 10. BACKGROUND The Community Development Department/Neighborhood Jobs Program has prepared legislation appropriating funds and establishing a special revenue fund as a result of a grant award from the Wages Coalition, Region 23, Dade and Monroe Counties, Department of Children and Families. The WAGES COALITION has awarded the City $1,500,000.00 to train and provide job placement assistance for adults currently receiving Temporary Assistance to Needy Families (TANF), which is the replacement legislation for Aid to Families with Dependent Children (AFDC). This is an Emergency Ordinance request to comply with the terms of the WAGES COALITION Contract process that begins October 15, 1997. This program represents the first major funding round under the 1996 Florida Welfare Reform legislation directed to bringing individuals off of the welfare rolls and into employment and self-sufficiency by October 1, 1998. This is emergency funding to assist TANF recipients with vocational training, job readiness training and job placement assistance. The WAGES Coalition has mandated that activity funded under this program commence October 15, 1997. 11515 1 0 0 This program will be operated by the Neighborhood Jobs Program. Adoption of the proposed legislation establishes the above referenced new special revenue fund and appropriates funds as outlined above. This legislation also authorizes the City Manager to accept the grant awards and execute the necessary agreements with the Wages Coalition, Region 23, Dade and Monroe Counties, Department of Children and Families. There are no City matching funds required for this program.
