HomeMy WebLinkAboutO-11539• J-97-631 9/8/97 ORDINANCE NO. - 1 39 AN EMERGENCY ORDINANCE AMENDING SECTION 42-8 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED: "SPECIAL DEPARTMENTAL SERVICES; FEES", THEREBY ESTABLISHING A LOWER INSPECTION FEE FOR INSPECTIONS OF ANTIQUE DEALERS BY THE PAWN SHOP DETAIL"; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, antique dealers are considered "secondhand dealers" pursuant to Chapter 538, Florida Statutes, if they purchase previously owned property other than at antique or collectible shows, from another secondhand dealer or in a trade-in transaction; and WHEREAS, Section 538.04, Florida Statutes imposes statutory requirements on secondhand dealers, including the submission of. a transaction form to the police department; and WHEREAS, Section 538.05, Florida Statutes, provides that the records of secondhand dealers are subject to inspection by the police department; and WHEREAS, the Miami Police Department Pawn Shop Detail conducts inspections of second hand dealers submitting the requisite forms to the police department; and WHEREAS, antique dealers engage in fewer transactions than pawn shops, jewelry stores and other secondhand dealers as they historically deal with or sell works of art, furniture, decorative objects and other items having special value because of its age, and WHEREAS, inspections at antique dealers are less time consuming in that they entail the examination of fewer transaction forms and less inventory than at pawn shops, jewelry stores, and other secondhand dealers; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 1153.9 • • Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 42-8 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:''-' " Sec. 42-8 Special departmental services; fees (h) Administrative fee for police conducted inspections and for processing transaction forms by the Pawn Shop Detail. Each pawnshop/secondhand dealer, except antique dealers (secondhand dealers who sell works of art, furniture, decorative objects, and other items having special value because of its age), conducting business within the City of Miami, shall pay a yearly fee of two -hundred fifty dollars ($250.00) for police inspections of pawnshops/secondhand dealers and other related functions by the Police Department's Pawn Shop Detail. Antique dealers shall pay a yearly inspection fee of one hundred dollars ($100.00). In addition thereto, each pawn shop epwato; /secondhand dealer, including antique dealers, will pay a $1.50 fee per pawR transaction form submitted to the Police Department for the review and processing of all forms submitted by the Pawn Shop Detail. The finance department is hereby authorized, empowered and directed to establish the proper procedure for the handling of all monies collected." Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section,. paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. 1 Words and/or figures stricken through shall be deleted. However, antique dealers differ from pawnshops due to the nature and volume of their business transactions.
