HomeMy WebLinkAboutO-11532J-97-399 7/24/97 ORDINANCE NO. 115.32 AN ORDINANCE AMENDING SECTION 2-33, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED: "ORDER OF BUSINESS AND RULES OF PROCEDURE" TO: (1) LIMIT THE NUMBER OF ITEMS THAT MAY BE SCHEDULED ON A REGULAR -' CITY COMMISSION AGENDA TO NO MORE THAN 60 ITEMS, (2) FIX CERTAIN TIMES TO CONCLUDE PUBLIC INPUT AND/OR AGENDA ITEM CONSIDERATION, (3) LIMIT THE NUMBER OF NONSCHEDULED ("POCKET") ITEMS THAT MAY BE INTRODUCED TO ONE POCKET ITEM FOR EACH COMMISSIONER AND TWO POCKET ITEMS FOR THE CITY MANAGER; AND(4) ESTABLISH PROCEDURES FOR THOSE ITEMS REMOVED FROM THE CONSENT AGENDA; MORE PARTICULARLY BY ADDING NEW SUBPARAGRAPHS (4) (5 ) AND ( 6 ) TO PARAGRAPH ( c) , AND AMENDING PARAGRAPHS (e) and (i) OF SAID SECTION; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission wishes to limit the number of nonscheduled agenda ("pocket") items to be taken up by the Commission to no more than one (1) item for each Commissioner and two (2) items for the City Manager; and WHEREAS, the City Commission wishes to limit the number of scheduled agenda items to no more than sixty (60) items; and WHEREAS, .in order to streamline Commission meetings, the City Commission also wishes to fix the times to conclude public input and/or agenda item consideration when breaking for the lunch recess or adjourning a meeting; and 11532 • 0 WHEREAS, the City Commission wishes to establish a procedure which shall automatically schedule any consent agenda item that is removed from the agenda prior to its consideration as a regular agenda item at the next City Commission meeting; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 2, Article II, Section 2-33, of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:1/ "CHAPTER 2 ADMINISTRATION ARTICLE II. City Commission Sec. 2-33. Order of procedure. business and rules of (c) After approval of the minutes of the previous meeting(s), all business that shall come before the city commission shall be taken up in the order as such items of business appear on the city commission agenda in accordance with the following provisions: 1� Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. (e) A copy of each resolution and ordinance shall be furnished the members of the city commission five days before meeting, to enable the heads of departments affected to prepare necessary memoranda, data or reports. In the event a copy of each resolution or ordinance is not furnished within the required five days, the proposed resolution or ordinance.maybe heard by the city commission provided that the city commission unanimously deems such resolution or ordinance to be of an emergency nature. The number of nonscheduled ("pocket°) items is limited to two one that each commissioner and the mayor may introduce and two that the City Manages may introduce for consideration by the city commission at any city commission meeting, unl PGG the City o mi Dion waives said limitation by a four- fiftrs (4/5t sl vote of its members. The conclusion of the regular scheduled agenda, = at 8.00 P.m., whichever occurs first, is designated as the time that such nonscheduled items shall be introduced. - 3 - A 2 (i) Unless impractical to do so, all portions of the agenda shall be scheduled to be heard at 9:00 a.m. on the date of the city commission meeting. The agenda portion entitled "consent agenda" shall be scheduled among the initial items for commission consideration. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5.
