ORDINANCE NO. 115.32
AN ORDINANCE AMENDING SECTION 2-33, OF THE
CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED: "ORDER OF BUSINESS AND
RULES OF PROCEDURE" TO: (1) LIMIT THE NUMBER
OF ITEMS THAT MAY BE SCHEDULED ON A REGULAR
-' CITY COMMISSION AGENDA TO NO MORE THAN 60
ITEMS, (2) FIX CERTAIN TIMES TO CONCLUDE
PUBLIC INPUT AND/OR AGENDA ITEM
CONSIDERATION, (3) LIMIT THE NUMBER OF
NONSCHEDULED ("POCKET") ITEMS THAT MAY BE
INTRODUCED TO ONE POCKET ITEM FOR EACH
COMMISSIONER AND TWO POCKET ITEMS FOR THE
CITY MANAGER; AND(4) ESTABLISH PROCEDURES FOR
THOSE ITEMS REMOVED FROM THE CONSENT AGENDA;
MORE PARTICULARLY BY ADDING NEW SUBPARAGRAPHS
(4) (5 ) AND ( 6 ) TO PARAGRAPH ( c) , AND AMENDING
PARAGRAPHS (e) and (i) OF SAID SECTION;
CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission wishes to limit the number of
nonscheduled agenda ("pocket") items to be taken up by the
Commission to no more than one (1) item for each Commissioner and
two (2) items for the City Manager; and
WHEREAS, the City Commission wishes to limit the number of
scheduled agenda items to no more than sixty (60) items; and
WHEREAS, .in order to streamline Commission meetings, the
City Commission also wishes to fix the times to conclude public
input and/or agenda item consideration when breaking for the
lunch recess or adjourning a meeting; and

WHEREAS, the City Commission wishes to establish a procedure
which shall automatically schedule any consent agenda item that
is removed from the agenda prior to its consideration as a
regular agenda item at the next City Commission meeting;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Chapter 2, Article II, Section 2-33, of the
Code of the City of Miami, Florida, as amended, is hereby amended
in the following particulars:1/

(c) After approval of the minutes of the previous
meeting(s), all business that shall come before the
city commission shall be taken up in the order as such
items of business appear on the city commission agenda
in accordance with the following provisions:
1� Words and/or figures stricken through shall be deleted.
Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain unchanged.
Asterisks indicate omitted and unchanged material.

(e) A copy of each resolution and ordinance shall
be furnished the members of the city commission
five days before meeting, to enable the heads
of departments affected to prepare necessary
memoranda, data or reports. In the event a
copy of each resolution or ordinance is not
furnished within the required five days, the
proposed resolution or ordinance.maybe heard by
the city commission provided that the city
commission unanimously deems such resolution or
ordinance to be of an emergency nature. The
number of nonscheduled ("pocket°) items is
limited to two one that each commissioner and
the mayor may introduce and two that the City
Manages may introduce for consideration by the
city commission at any city commission meeting,

conclusion of the regular scheduled agenda, =
at 8.00 P.m., whichever occurs first, is
designated as the time that such nonscheduled
items shall be introduced.

(i) Unless impractical to do so, all portions of
the agenda shall be scheduled to be heard at
9:00 a.m. on the date of the city commission
meeting. The agenda portion entitled "consent
agenda" shall be scheduled among the initial
items for commission consideration. ConG_n
agenda i tems that are removed from the agenda
prior to city commission consideration shall
automatically be s h dul d as a regular agen
item at the next regularly scheduled meeting of
the city commission.
Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.
