ORDINANCE NO. 11530
AN EMERGENCY ORDINANCE AMENDING SECTION 2-32
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED: "TIME AND PLACE OF
MEETING," THEREBY CHANGING THE REGULAR
MEETING DAYS OF THE CITY COMMISSION TO THE
SECOND AND FOURTH TUESDAYS OF EACH MONTH;
FURTHER,, PROVIDING THAT ALL LAND USE
ORDINANCES' PUBLIC HEARINGS, WITH CERTAIN.
EXCEPTIONS, ARE PERMANENTLY SCHEDULED FOR
PUBLIC HEARING PRIOR TO 5:00 p.m.; CONTAINING
A REPEALER PROVISION AND A SEVERABILITY
CLAUSE; AND PROVIDING FOR .AN EFFECTIVE DATE.
WHEREAS, §166.041(3)(c)2.a., Fla. Stat. (1995), provides
that a local governing body may, by a majority vote plus one,
elect to conduct, before 5:00 P.M. on a week -day, both required
public hearings on proposed ordinances which change the actual
list of permitted, conditional, or prohibited uses within a
zoning category, or change the actual zoning map designation of a
parcel or parcels of land involving 10 contiguous acres or more;
and
WHEREAS, It is the purpose, inter alia, of the herein
legislation that the public be apprised that it is the intent and
desire of the City of Miami to schedule all public hearings,
including the aforementioned, for a time prior to 5:00 P.M.;
FLORIDA:
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,

Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section 2-32 of the'Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars:I/
"Chapter 2
ADMINISTRATION
ARTICLE II. CITY COMMISSION
Sec. 2-32. Time and place of meeting.
(b) Regular meetings of the city commission
shall be held on the second and fourth 'Thursday^
'T_u sdaya of each month except during the month of
August and unless otherwise provided by city
commission action. All regular meetings of the
city commission shall convene promptly at 9:00
a.m. At the first meeting of the month, matters
to be considered shall be generally limited to
those matters not arising from or under the
provisions of Ordinance Number 11000, as amended,
the comprehensive zoning ordinance for the City of
Miami. At the second. monthly meeting, matters to
be considered shall be generally limited to those
matters arising from or under the provisions of
Ordinance Number 11000. Further, all public
bearings on land use ordinances, including those
involving ten (10) r a or more, may be held
before 5.00 r_m_ unless the City Commission, state

words and/or figures shall be added. The remaining provisions are now
in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.

law or administrative ride specifically provide
otherwise. Nothing herein shall preclude
consideration of any matter at any meeting whether
or not such matter arises from or under the
provisions of said Ordinance Number 11000.
Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency, measure on the grounds of urgent public need for the
preservations of peace, health, safety, and property of the City
of Miami.
Section 6. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption.
PASSED AND ADOPTED BY TITLE ONLY this 24th day of

changes Section 2-32 of the code, as amended, to provide for the following:
1. Change the regular meeting day of the City Commission from Thursdays to
Tuesdays;
2. All public hearings on land use ordinances may be held before 5:00 p.m., unless
otherwise provided.
