AN EMERGENCY ORDINANCE AMENDING SECTION 1,
SUBSECTIONS V AND VI OF ORDINANCE NO. 11337,
AS AMENDED, ADOPTED JANUARY 25, 1996, THE
CAPITAL IMPROVEMENTS . APPROPRIATIONS
ORDINANCE, TO ESTABLISH TWO (2) NEW CAPITAL
IMPROVEMENT PROJECTS: "MIAMARINA DOCKMASTER'S
OFFICE RENOVATIONS", PROJECT NO. 413403 AND
"WATSON ISLAND AVIATION AND VISITORS CENTER",
PROJECT NO. 344101 AND APPROPRIATING FUNDS
FOR SAID PROJECTS; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission pursuant to Ordinance
No. 11337, adopted January 25, 1996, established appropriations
for Capital Improvements, and continued previously approved
Capital Improvement Projects to begin during Fiscal Year. 1995-96;
and
WHEREAS, it is necessary to provide adequate and useable
dockmaster space and bathroom and laundry facilities at Miamarina
at Bayside to support the increase in permanent and transient
vessels which will be docked at the new 104-slip pier scheduled
to open in the next few weeks at Miamarina; and
WHEREAS, said bathroom facilities must provide handicap
access in order to comply with current American Disability Act
("ADA") requirements; and

WHEREAS, the provision ,by the City of these facilities and
services are integral to the Agreement between the City of Miami
and Rouse -Miami Inc. to manage, operate and maintain Miamarina at
Bayside to a quality consistent with other first class marinas in
the Miami -Metro area and to a comparable level of quality
commensurate with Bayside Specialty Center; and
WHEREAS, the original proposed reconstruction plans included
construction of a 300-foot floating dock, which was not funded
by FEMA, and it has been determined that a 100-foot floating
dock is necessary to serve the boating public, to provide docking
space for smaller vessels and to generate additional revenues for
the City; and
WHEREAS, it is urgent for the preservation of public
property to establish the aforementioned capital project
entitled: `Miamarina Dockmaster's Office Renovations, Project
No. 413403", in the amount of $180,000 scheduled to commence
during Fiscal Year 1996-97; and
WHEREAS, pursuant to Resolution No. 96-129, the City has
accepted the second in a series of grants from the Florida
Department of Transportation ("FDOT") under a duly executed Joint
Participation Agreement for the planning and development of the
Watson Island Aviation and Visitors Center (the "Center"), said
grant in the amount of $352,500 to be paid on a reimbursement
basis; and

WHEREAS, the City Commission, pursuant to Resolution
No. 96-281, has additionally directed the Administration to
negotiate the required interlocal agreements with the Miami
Exhibition and Sports Authority, and related tenant, the Greater
Miami Convention and Visitors Bureau for the development,
occupancy, management and operation of the Aviation and Visitors
Center; and
WHEREAS, the Greater Miami Convention and Visitors Bureau
has pledged the required equal match to the FDOT grant for the
Center, which monies are the subject of a funding agreement
currently being negotiated; and
WHEREAS, additional funds in the amount of $10,500 are
available in a Special Revenue Fund, Project No. 110059, for the
Aviation and Visitors Center project; and
WHEREAS, pursuant to subsequent action of the City
Commission, Resolution Nos. 97-402 and 97-476, the City Manager
has conducted a competitive selection process to hire qualified
architectural and planning professionals to provide the required
design and feasibility planning for the Center, and we are now
prepared to enter into the necessary agreement for said services;
and
WHEREAS, it is now of utmost importance. that funds be
appropriated into a new Capital Improvement Project for the
current fiscal year so that we may begin the final planning and

design of the Center and meet stipulated deadlines of the funding
agencies;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section 1 of Ordinance No. 11337, as amended,
adopted January 25, 1996, is hereby amended in the following
particulars:'/
"Section 1. The herein appropriations are hereby
made for implementation ofall municipal Capital
Improvements of the City of Miami, including new Capital
Improvement Projects scheduled to begin during fiscal year
1995-1996. The herein appropriations which are hereby
designated by reference to descriptive project title and
number also include appropriations for previously approved
scheduled projects as well as reappropriat ions of prior
fund appropriations. The source of revenues to support
the herein appropriations is hereby identified by fund and
project with the project appropriations with revenues
therefor being set forth for seven program I - VII ) areas
based upon use or functional category within said areas,
as follows:

words and/or figures shall be added. The remaining provisions are now
in effect and remain unchanged. Asterisks indicate omitted and
unchanged material. All figures are rounded to the nearest hundred
dollars.

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with -the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.

Section S. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami and upon the further grounds of the necessity to make
the required and necessary purchases and payments and tc
generally carry out the function and duties of municipal affairs.
Section 6. The requirements of reading this Ordinance on
the two separate days is hereby dispensed with by a vote of not
less than four -fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the
attached Emergency Ordinance amending Ordinance No. 11337, the Capital
Improvement Appropriations Ordinance, by creating two (2) new projects
and appropriating funds for same, as follows: "Miamarina Dockmasters
Office Renovations_" (Project 413403) in the amount of $180,000, and
"Watson'Island.Aviation & Visitors Center" (Project No. 344101) in the
amount of $715,500.
BACKGROUND
The attached .legislation was initiated by the Department of
Conferences, Conventions and Public Facilities. and the Department of
Planning and Development.
Miamarina Dockmasters Office Project
The new piers at Miamarina at Bayside are scheduled to be completed
this month, and it is anticipated that the increase of 104 new slips
for larger vessels will generate a substantial increase in revenues,
and demand for services from both permanent and transient vessels.
This new piers project did not include renovation of the offices,
bathrooms and laundry facilities, which are necessary to support the
increased demand for services. The City must proceed immediately with
renovation of these facilities.
Additionally, the Department of Conferences, Conventions and Public
Facilities has determined that a 100-foot floating dock should be
included with these renovations. The Miamarina Master Plan called for
a floating dock facility to accommodate the smaller vessels that dock
at Miamarina at Bayside for only a few hours. This floating dock will
meet this need to provide docking space for smaller vessels, better
serve the boating public, and provide additional revenues to the City.
Watson Island Aviation & Visitors Center Project
Beginning in 1991 with discussions between the City, the Federal
Aviation Administration and the Florida Department of Transportation,
Miami has identified the need for a central aviation facility for
helicopters and seaplanes, the "Watson Island Aviation and Visitors
Center" (the "Center"). More recently, as authorized by Resolutions
115281
No. 97-402 and 97-476, the City Manager has conducted a competitive
selection process to hire qualified architectural and planning
professionals to provide the required design and feasibility planning
services for the Center. We are now prepared to enter into an
agreement for those services, in order to meet deadlines imposed by
the funding agencies.
Funding for the project is as follows. By Resolution No. 96-129 the
City accepted the second in a series of grants from the Florida
Department of Transportation ("FDOT") under a Joint Participation
Agreement for the planning and development of the Center. This latest
grant, in the amount of $352,500 will be paid to the City on a
reimbursement basis. Additionally the City Commission, via Resolution
No. 96-281, has directed the Administration to negotiate the required
interlocal agreements with the Miami Exhibition and Sports Authority,
and related tenant, the Greater Miami Convention and Visitors Bureau

Center. The Greater Miami Convention and Visitors Bureau has pledged

This Ordinance is being requested as an emergency so that funds are in
place to, begin construction on the Miamarina Dockmasters Office, and
so that design may begin on the Watson Island Aviation and Visitors
Center- to meet funding agency deadlines. This Ordinance is of
paramount importance on the grounds of 'urgent need for the
preservation of public health, safety, and property of the City of
Miami and upon the further grounds of the necessity to make the
required purchases and payments and to generally carry out the
functions and duties of municipal affairs..
