ORDINANCE NO. 11524
AN EMERGENCY ORDINANCE AMENDING SECTION III OF
ORDINANCE NO. 11337, ADOPTED JANUARY 25, 1996 AS
AMENDED, THE CAPITAL IMPROVEMENTS
APPROPRIATIONS ORDINANCE, THEREBY INCREASING
APPROPRIATIONS TO EXISTING CAPITAL IMPROVEMENT
PROJECT NO. 322061 ENTITLED: "TOWER THEATER
REHABILITATION" FROM $1,906,800 TO $2,276,800, AN
AMOUNT OF $370,000, FROM 23RD YEAR CDBG PROGRAM
FUNDS; FURTHER, ESTABLISHING A NEW CAPITAL
IMPROVEMENT PROJECT NO. 322056 ENTITLED. "MIAMI
DESIGN DISTRICT - SIGNAGE PROGRAM", AND
APPROPRIATING FUNDS, IN THE AMOUNT OF $25,000 FOR
SAID PROJECT, FROM 23RD YEAR CDBG PROGRAM FUNDS;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City Commission, pursuant to Ordinance No. 11337, adopted January
25, 1996, as amended, established appropriations for Capital Improvements, continue previously
approved Capital Improvement Projects, to begin during Fiscal Year 1996-97; and
WHEREAS, the City of Miami has received additional funds from the Twenty -Third
(23`d) Year Community Development Block Grant (CDBG) Program funds for Capital
Improvement Project No. 322061 entitled "Tower Theater Rehabilitation"; and

WHEREAS, the City of Miami has received funds from the Twenty -Third (23`d) Year
CDBG Program funds to establish Capital Improvement Project No. 322056 entitled "Miami
Design District - Signage Program"; and
WHEREAS, it is urgent for the preservation of public property to include said additional
appropriations in an amount not to exceed $370,000 for the Tower Theater Rehabilitation Capital
Project and $25,000 for the Miami Design District - Signage Program scheduled to commence
during Fiscal Year 1996-97;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. Section III. of Ordinance No. 11337, adopted January 25, 1996, as
amended, is hereby amended in the following particulars:'
"Section 1. The herein appropriations are hereby made for
implementation of all municipal Capital Improvements of the City of Miami,
including new Capital Improvement Projects scheduled to begin during fiscal year
1996-1997. The herein appropriations which are hereby designated by reference to
descriptive project title and number also include appropriations for previously
approved scheduled projects as well as reappropriations of prior fund
appropriations. The source of revenues to support the herein appropriations is
hereby identified by fund and project with the project appropriations with revenues
therefor being set forth for seven program (I - VII) areas based upon use or
functional category within said areas, as follows:

Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in
conflict with the provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.

Section 5. This Ordinance is hereby declared to be an emergency measure on the
grounds of urgent public need for the preservation of peace, health, safety, and property of the
City of Miami and upon the further grounds of the necessity to make the required and necessary
purchases and payments and to generally carry out the function and duties of municipal affairs.
Section 6. . The requirements of reading this Ordinance on two separate days is hereby
dispensed with by a vote of not less than four -fifths of the members of the Commission.
Section 7. This Ordinance shall become effective immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the attached Emergency
Ordinance amending Capital Improvement Ordinance No. 11337 by increasing appropriations
for Project No. 322061, Tower Theater Rehabilitation in the amount of $370,000 allocated
from the Twenty -Third (23❑d) Year Community Development Block Grant (CDBG) Program
funds. Additionally; the legislation would allocate $25,000 from the 23rd Year CDBG
Program funds to establish a new Capital Improvement Project No. 322056 entitled the
"Miami Design District - Signage Program."
BACKGROUND
In conjunction with the Department of Planning and. Development, the Office of Capital
Improvements has prepared this Ordinance amending Capital Improvement Ordinance No.
11337, adopted January 25, 1996. This amendment is critical to the continuation of the Tower
Rehabilitation Project (No. 322061), since it would appropriate funds needed for the award of
the construction contract in late July.
The Tower Theater is a City -owned, public facility located on the corner of S.W. 8' Street and
S.W. 15" Avenue anchoring the Latin Quarter Specialty Center in the City of Miami. The,.
total rehabilitation project cost as estimated by the architects is over two million dollars.
Funds available at the present time for the project are $1,906,834 which includes a $352,834
grant from the State of Florida Historical Resources, $500,000 grant from the State of Florida
Cultural Affairs, and $1,054,000 from. prior year CDBG. The Historical Resources grant
expires in September 1997, and the Cultural Affairs grant expires on July 31, 1997. The
receipt of the state grants are contingent on securing the additional funds to begin construction
and awarding a construction contract before the grant expiration dates. The City Commission
has already allocated $370,000 from 23`d year CDBG funds which is the balance required for
award of the construction contract. This appropriations Ordinance puts the monies into the
Capital Improvement Program for proper accounting of the project.

Tower Theater and Design District Emergency Ordinance
The Ordinance would also create a new Capital Improvement Project, "Miami Design District
- Signage Program" which is also expected to begin this summer in conjunction with other
comprehensive planning efforts for this District. Funds in the amount of $25,000 have been
made available from 23`a Year CDBG monies for this program.
This Ordinance is being requested as an emergency measure so that funds are
immediately in place for the award of a construction contract for the Tower Theater
Rehabilitation Project, expected in late July, which will further preserve grant funds
already committed to the project.
