ORDINANCE NO. 115 2 1
AN EMERGENCY ORDINANCE ESTABLISHING A NEW
SPECIAL REVENUE FUND ENTITLED% "BUILDING
CLOSING REVOLVING FUND" AND APPROPRIATING
FUNDS, IN THE AMOUNT OF $100,000, FOR THE
PURPOSE OF EXPEDITING DEMOLITION OR SECURING
OF UNSAFE STRUCTURES; AUTHORIZING A LOAN FROM
THE GENERAL FUND, IN AN AMOUNT NOT TO EXCEED
$100,000, TO SAID SPECIAL REVENUE FUND;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, at present, there are increased numbers of unsafe
and unsecured structures existing in the City of Miami; and
WHEREAS, said structures often become open, unsecured,
vandalized, or used for illicit purposes by trespassers,
resulting in conditions that are unhealthy, unsafe, and a blight
upon the neighborhood and the community at -large; and
WHEREAS, demolition or securing of said structures will
safeguard the public health, safety, morals and welfare of the
neighborhood and community at -large; and
WHEREAS, the creation of the special revenue fund will
enhance and increase the City of Miami's responsiveness to these
unsafe and dangerous conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The following new Special Revenue Fund is
hereby established and resources are hereby appropriated as
described herein:
FUND TITLE: BUILDING CLOSING REVOLVING
FUND
RESOURCES: LOAN FROM THE GENERAL FUND $100,000
APPROPRIATION: BUILDING CLOSING REVOLVING $100,000
FUND
Section 3. A loan from the General Fund, in the amount
of $100,000, for the hereinabove appropriation is hereby
authorized.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases

of goods and supplies and to generally carry on the functions and
duties of municipal affairs.
Section 7. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 8. This Ordinance shall become effective
immediately upon its adoption.
PASSED AND ADOPTED BY TITLE ONLY this loth day of
July 1997.

Subject: Creation of a Special Revenue Fund to Expedite the Closing and
Demolition of Derelict Buildings
This Ordinance creates a new Special Revenue Fund entitled the "Building Closing
Revolving Fund". This fund will provide the resources for the City to secure and/or
demolish derelict buildings. By creating this pool or resources, the City will be able to
move to take action on these properties without searching for the funds to make the
necessary expenditures. The funds expended would be returned to the City through liens
placed on these properties. The status of these building closing liens is the same as tax
liens, superior to any other liens.
