HomeMy WebLinkAboutO-11514J-97-407 6/18/97 ORDINANCE NO. 1 4 AN EMERGENCY ORDINANCE AMENDING SECTION I OF ORDINANCE NO. 11337, AS AMENDED, ADOPTED JANUARY 25, 1996, THE CAPITAL IMPROVEMENTS APPROPRIATIONS ORDINANCE, THEREBY ESTABLISHING A NEW CAPITAL IMPROVEMENT PROJECT ENTITLED: "SAFETY INFRA -STRUCTURE REPAIRS", PROJECT NO. 311927, TO BEGIN DURING FISCAL YEAR 1996-1997; APPROPRIATING FUNDS FOR SAID PROJECT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 11337 on January 25,1996, to establish appropriations for Capital Improvements, continue previously approved Capital Improvement Projects, and establish new Capital Improvement Projects to begin during Fiscal Year 1996-97; and WHEREAS, The City of Miami wants to institute a Safety Project geared to reducing its potential liability , by providing funds to be used for the repair of parks playground equipment and unsafe sidewalks citywide. WHEREAS, it is urgent for the preservation of public property to establish the aforementioned capital project entitled " Safety Infra -Structure Repairs " Project No. 311927, in the amount of $660,000, scheduled to commence during fiscal year 1996- 1997; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11514 Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section I of Ordinance No. 11337, as amended, adopted January 25,1996, is hereby further amended in the following particulars:' "Section 1. The herein appropriations are hereby made for implementation of all municipal Capital Improvements of the City of Miami, including new Capital Improvement Projects scheduled to begin during fiscal year 1995-1996. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations with revenues therefor being set forth for seven program ( I - VII ) areas based upon use or functional category within said areas, as follows: Total Appropriations ($X000) I. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. All figures are rounded to the nearest hundred dollars. 2 11514 Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shallnot be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments and to generally carry out the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is he dispensed with by a vote of not less than four -fifths of the members of the commission. Section 7.
