ORDINANCE NO. 115,13
AN EMERGENCY ORDINANCE AMENDING CAPITAL
IMPROVEMENT ORDINANCE NO. 11337, AS AMENDED,
ADOPTED JANUARY 25, 1996, THEREBY ESTABLISHING A
NEW CAPITAL IMPROVEMENT PROJECT NO. 322055,
ENTITLED "ART IN PUBLIC PLACES - MIAMI DESIGN
DISTRICT" AND APPROPRIATING $250,000 FOR SAID
PROJECT, CONSISTING OF A GRANT IN SAID AMOUNT
FROM THE MIAMI SPORTS & EXHIBITION AUTHORITY
("MSEA"); AUTHORIZING THE CITY MANAGER TO EXECUTE
THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, WITH MSEA TO ACCEPT SAID
GRANT; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, at its May 21, 1997 meeting, the Miami Sports & Exhibition Authority
(MSEA) agreed to award the City of Miami a grant, in the total amount of $250,000, for
implementation of an Art in Public Places Program (the "Program") to be located in the
Miami Design District (the "District"); and
WHEREAS, said grant is to be awarded in phases, with an initial amount of
$35,000 to be used for planning consultant services to provide an Art in Public Places
Overlay Plan for the District; and
WHEREAS, the remaining $215,000 would subsequently be awarded for the
acquisition and construction costs of selected works of art to be displayed within the
public rights -of -way throughout the District; and
WHEREAS, it is appropriate to establish a new Capital Improvement Project for the
implementation of the Program and to appropriate said MSEA grant funds;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section III of Ordinance No. 11337, as amended, adopted January
25, 1996, is hereby amended in the following particulars:''-/
"Section 1. The herein appropriations are hereby made for
implementation of all municipal Capital Improvements of the City of Miami,
including new Capital Improvement Projects scheduled to begin during fiscal
year 1996-1997. The herein appropriations which are hereby designated by
reference to descriptive project title and number also include appropriations
for previously approved scheduled projects as well as reappropriations of
prior fund appropriations. The source of revenues to support the herein
appropriations with revenues therefor being set forth for seven program (I-
VIII) areas based upon use or functional category within said areas, as
follows:

Section 3. All ordinances or parts of ordinances insofar as they are inconsistent
or in conflict with the provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or word of
this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be
affected.
Section 5. This Ordinance is hereby declared to be an emergency measure on
the grounds of urgent public need for the preservation of peace, health, safety, and
property of the City of Miami.
Section 6. The requirement of reading this Ordinance on two separate days is
hereby dispensed with by an affirmative vote of not less than four -fifths of the members of
the Commission.
Section 7. This Ordinance shall become effective immediately upon its adoption.
