HomeMy WebLinkAboutO-11510J-97-338 5/27/97 ORDINANCE NO. 5 1 AN EMERGENCY ORDINANCE AMENDING CAPITAL IMPROVEMENTS ORDINANCE NO. 11337, AS AMENDED, ADOPTED JANUARY 25, 1996; CONTINUING AND REVISING PREVIOUSLY APPROVED SCHEDULED CAPITAL IMPROVEMENT PROJECT NO. 351283 ENTITLED: "WATSON ISLAND SANITARY SEWER"; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission pursuant to Ordinance No. 11337, adopted January 25,1996, established appropriations for capital improvements, and continued previously approved Capital Improvement Projects during Fiscal Year 1996-1997; and WHEREAS, the City of Miami has received additional funds from the sale of sanitary sewer bonds; and WHEREAS, it is urgent for the preservation of public property to include said additional appropriations for Capital Improvement Project 351283 "Watson Island Sanitary Sewer " scheduled to commence during Fiscal Year 1 996-97; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 11510 Section 2. Section VII of Ordinance No. 11337, as amended, adopted January 25,1996, is hereby amended in the following particulars:' "Section 1. The herein appropriations are hereby made for implementation of all municipal Capital Improvements of the City of Miami, including new Capital Improvement Projects scheduled to begin during fiscal year 1995-1996. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations with revenues therefor being set forth for seven program ( I - VII ) areas based upon use or functional category within said areas, as follows: Total Appropriations ($ x000) VII. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. _Asterisks indicate omitted and unchanged material. All figures are rounded to the nearest hundred dollars. 2 11510 U LJ Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments and to generally carry out the function and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on the two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the commission. Section 7. Background Anticipating the future development of Watson Island, the Public Works Department included the Watson Island Sanitary Sewer Project, C.I.P. # 351283 in the CIP Program in 1988. Since definitive plans for the island had not been developed, the original project description included only the pump station on Watson island and a subaqueous force main crossing of the bay to Bicentennial Park. in 1994, an appropriation of $2,000,000 was approved. In FY'96, the potential of the development of the island accelerated with the adoption of a master plan and voter approval of a major tenant to occupy the island. With the guidance of the master plan, a gravity sanitary system was included in the project to provide the necessary infrastructure on the island for individual sanitary sewer service. In FY'96, the total appropriation was increased to $3,000,000 with an additional $750,000 programmed for FY'97 to fund these improvements. With the potential development of Bicentennial Park into a major seaport expansion and Maritime Park, as well as with the future ownership of the park in question, the sanitary sewer force main was re-routed to Biscayne Island and then to the mainland parallel to Venetian Causeway. Environmental permitting further requiring new technology to be employed for the crossing of Biscayne Bay. The final plans for the sanitary sewer system will provide a more reliable system at Watson Island without disruption of services due to the redevelopment of Bicentennial Park. In order to provide sanitary sewer service to the Parrot Jungle in accordance with the City's lease agreement, the appropriation for this project must urgently be amended and increased to a total cost of $ 4,000,000 to fund all improvements for a complete and operating sanitary sewer system for all facilities contained in the Watson Island master plan. 11510i MIAMI DAILY BUSINESS REVIEW Published Daily except Saturday, Sunday and Legal Holidays Miami, Dade County, Florida.
