HomeMy WebLinkAboutO-11505J-97-392 6/6/97 ORDINANCE NO. 11505 AN EMERGENCY ORDINANCE ESTABLISHING THREE (3) SPECIAL REVENUE FUNDS ENTITLED: "JTPA TITLE II -A f ECONOMICALLY DISADVANTAGED ADULTS (PY '97)", "JTPA TITLE II-C / ECONOMICALLY DISADVANTAGED YOUTH (PY '97", AND "JTPA TITLE III / DISLOCATED WORKERS (PY '97)", AND APPROPRIATING FUNDS FOR OPERATION, OF EACH COMPONENT IN THE RESPECTIVE AMOUNTS OF $344,655, $101,200 AND $381,800, FROM U.S. DEPARTMENT OF LABOR GRANT AWARDS; AUTHORIZING THE - CITY MANAGER TO EXECUTE THE NECESSARY AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE SOUTH FLORIDA EMPLOYMENT AND TRAINING CONSORTIUM (SFETC) FOR THE ACCEPTANCE OF SAID GRANTS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Congress of the United States adopted Public Law 97-300, the 1 Job Training Partnership Act (JTPA) on October 13, 1982 to establish programs. to prepare youth and unskilled adults for entry into the labor force and to afford job training to economically disadvantaged persons and other individuals facing serious barriers to employment, who are in special need of such training to obtain productive employment; and WHEREAS, the City is operating the Neighborhood Jobs Program in PY '97 to meet the mandate of the aforementioned Public Law; and 11505 E • WHEREAS, the South Florida Employment and Training Consortium has awarded the City $344,655 under Title II -A to retrain economically disadvantaged adults from the general population, ex -offenders, recipients of temporary assistance for needy families (TANF) and handicapped persons; and WHEREAS, the South Florida Employment and Training Consortium has awarded the City $101,200 under Title II-C to provide employment and training assistance to economically disadvantaged and at -risk youth; and WHEREAS, the South Florida Employment and Training Consortium has awarded the City $381,800 under Title III to provide retraining for dislocated workers and laid off individuals; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Funds are hereby established and resources are hereby appropriated as described: FUND TITLE: JTPA TITLE II-A/ECONOMICALLY DISADVANTAGED ADULTS (PY' 97) RESOURCES: U.S. DEPARTMENT OF LABOR THROUGH THE SOUTH FLORIDA EMPLOYMENT AND TRAINING CONSORTIUM APPROPRIATION: JTPA TITLE H-A/ECONOMICALLY DISADVANTAGED ADULTS (PY '97) $344,655 S344,655 2 11505 FUND TITLE: JTPA TITLE II-C/ECONOMICALLY DISADVANTAGED YOUTH (PY /97) RESOURCES: U.S. DEPARTMENT OF LABOR THROUGH THE SOUTH FLORIDA EMPLOYMENT AND TRAINING CONSORTIUM $101,200 APPROPRIATION: JTPA TITLE II-C/ECONOMICALLY DISADVANTAGED YOUTH (PY '97) $101,200 FUND TITLE: JTPA TITLE III/DISLOCATED WORKERS (PY' 97) RESOURCES: U.S. DEPARTMENT OF LABOR THROUGH THE SOUTH FLORIDA EMPLOYMENT AND TRAINING CONSORTIUM $381,800 APPROPRIATION: JTPA TITLE HI/DISLOCATED WORKERS (PY' 97) $381,800 Section 3. These appropriations are contingent upon funding by the South Florida Employment and Training Consortium and the City Manager's acceptance thereof. Section 4. The City Manager is hereby authorized 1/ to accept the grants and to execute the necessary agreements, in a form acceptable to the City Attorney, with the South Florida Employment and Training Consortium. Section 5. The herein authorization shall remain valid and outstanding even if the anticipated grant award is reduced or increased. Section 6. All ordinances or parts of ordinances insofar as they are in conflict with the provisions of this Ordinance are hereby repealed. Section 7. If any section, part of section, paragraph clause, phrase, or work of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. 1/ The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 3 11505 • Section 8. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 9. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 10.
