ORDINANCE NO.
AN ORDINANCE AMENDING THE ZONING
ORDINANCE BY AMENDING ARTICLE 5, SECTION
505, TO ADD PROVISIONS PERTAINING TO
SETBACK REQUIREMENTS FOR COMMERCIAL
AND RESIDENTIAL PLANNED UNIT
DEVELOPMENTS; CONTAINING A REPEALER
PROVISION AND SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting of
January 22, 1997, Item No. 5, following an advertised hearing, adopted
Resolution No. PAB 09-97 by a vote of seven to zero (7-0), RECOMMENDING
APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of this matter
deems it advisable and in the best interest of the general welfare of the City of
Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set
forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA-

Section 1. The recitals and findings contained in the Preamble to this
Ordinance are hereby adopted by reference thereto and incorporated herein as
if fully set forth in this Section.
Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance
of the City of Miami, Florida, is hereby amended by amending the text of said
Ordinance as follows:'
"ARTICLE 5. PLANNED UNIT DEVELOMENT
Sec. 505. Setback provisions.
505.1. Setbacks requirements for commercial PUD.
When a PUD is located within a resiciential commercial
district, minimum yard requirements shall be that those of the
underlying district.
505.2 Setbacks requirements for residential PUD.
When a PUD is locate_ d within a residential district, minimum
and requirements shall be those of the underlying district.
505.3 Reduction in setbacks requirements for residential PUD
Reduction of generally applicable setback requirements in for
Planned Unit Development housing proiects for low income families
and individuals or for the elderly, may be allowed by Special
Exception only to an amount not more than one half ('/2) of the
required setback as specified in section 505.2 above. The
following requirements and limitations shall apply:

Underscored words and/or figures shall be added. The remaining
provisions are now in effect and remain unchanged. Asterisks
indicate omitted and unchanged material.

(a) The proiect shall otherwise conform to the requirements of
state and or federal programs for this purpose.
b) The zoning boardin its consideration of the application for
Special Exception, shall determine and make finding that the
reduction of required setbacks is justified in view of the
nature and type of prospective occupancy as well as the
economic circumstances involved.
(c) If approved, the setback reduction shall only be
implemented in those side -yards directly abutting a right-of-
way or other open space such as parks, rivers, an the like
and not in those side -yards abutting another property
whether developed or vacant.
Section 3. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this Ordinance are hereby
repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or
word of this Ordinance., is declared invalid, the remaining provisions of this
Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty (30) days after
final reading and adoption thereof.

Section 505., in order to add a new provision which would allow
for a . reduction of up to Fifty (50%) percent in setback
requirements for Planned Unit Development housing projects for
low income families and individuals or for the elderly, by Special
Exception Permit only.

RECOMMENDATION
BACKGROUND AND It is the explicit aim of the Planned Unit Development process to

encouraging design creativity as well achieving an improved
environment through appropriate and harmonious variety in
physical development.
In addition it is often. the case that the economic viability of
affordable Planned Unit Development hinges on the optimal
�, utilization of the assembled land to which the required peripheral
i Y yards are often an obstacle.
Given, finally, that the maximization of interior open/communal
space often makes for an improved residential setting; it is hereby
proposed that the option be made available to permit the reduction
of peripheral setbacks upon finding that the project as proposed
merits it and makes appropriate use of the interior space gained.
