OVERLAY DISTRICTS": SUBSECTION 704.1.4,
"DEVIATIONS CONCERNING OFF-STREET PARKING,"
TO ALLOW VALET PARKING FOR PRIVATE CLUBS OR
LODGES; BY PROVIDING A NEW SUBSECTION 704.2.4
TO REQUIRE A SPECIAL EXCEPTION FOR PRIVATE
CLUBS OR LODGES, AND A NEW SUBSECTION
704.3(4) SETTING MINIMUM LOT SIZE AND HOURS
OF OPERATION FOR PRIVATE CLUBS OR LODGES IN
SUCH DISTRICTS; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of February 21, 1996, Item No. 2, following an advertised
hearing, adopted Resolution No. PAB 06-96, by a vote of
seven to zero (7-0), RECOMMENDING APPROVAL of amending Zoning
Ordinance No. 11000 as hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 11000 as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is hereby amended by
amending the text of said Ordinance as follows:l'
"ARTICLE 7. HP HISTORIC PRESERVATION OVERLAY DISTRICTS
Sec. 704. Conditional uses and deviations.
704.1. Types of conditional uses and deviations
permissible.
704.1.4 Deviations concerning off-street
parking. In cases where the size or
configuration of an HP district is such that
compliance. with off-street parking
requirements would destroy the historic
character of the property, the board may
authorize a reduction of up to one-third
(1/3) of the number of parking spaces that
would ordinarily be required for a new
structure of equivalent use and floor area.
For private clubs or lodges, up to seventy-
five percent (79%) of the required off-street
narking spaces may be provided by valet
parking, provided that an attendant shall
remain on duty during business hours and that
all valet activities shall be conducted on
private property_
704.2. Procedures for granting conditional uses and
deviations.

704.3. Standards.
In addition to guidelines for issuing certificates
of appropriateness as set forth in section 23.1-5(C) of
the Miami City Code, the board shall determine that the
following standards have been met before reaching a
decision to I grant a special certificate of
appropriateness.
(1). The conditional use or deviation shall
provide a public benefit and shall be the
minimum necessary to encourage or assure the
continued preservation of the historic
structure; and
(2). The conditional use or deviation shall be in
harmony with the general intent and purpose
of this article and shall not be injurious to
the neighborhood or otherwise detrimental to
the public welfare; and
(3). The project shall be designed and sited in a
manner that minimizes the impact on the
surrounding areas in terms of vehicular
ingress or egress, off-street parking,
pedestrian safety and convenience, public
utilities and services, lighting, noise, or
potential adverse impacts -.;_ and
(4) _ For private clubs or lodges, the mi n; mum 1 of
size shall be fifteen thousand (15,000)
sQuare feet. For private clubs, hours of
operation shall not extend beyond eleven
o'clock (11.00) p.m.
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.

Section 4. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

On January 13, 1997, the City of Miami transmitted to DCA the 1996 Package of Proposed Amendments
to the Miami Comprehensive Neighborhood Plan 1989-2000 (MCNP). On January 22, 1997, we received
a letter from D. Ray Eubanks, Planning Manager, DCA, finding our package incomplete because it does
not include all of the required information.
Pursuant to rule 9J-11, 006(1)(a)(3), Florida Administrative Code, the City of Miami, in this submittal does
not request formal review and an ORC report.

parking for private clubs or lodges; by providing a new Section 704.2.4 to require
a Special Exception for private clubs or lodges; and by providing'a new Section
704.3(4) to set forth standards for private clubs or lodges.
PLANNING Approval.
RECOMMENDATION
BACKGROUND AND In order to promote the adaptive use of Miami's historic sites, the Zoning
ANALYSIS Ordinance provides for historic preservation overlay districts, which allow certain
uses that would otherwise not be permitted in residential neighborhoods. One such
use is private clubs or lodges. This proposed amendment to the text of the Zoning
Ordinance would provide certain restrictions and limitations on this use in order
to lessen the potential impact on the surrounding neighborhood. The amendment
would require that proposals for private clubs or lodges be subject to.a Special
Exception with City Commission approval. The use would require a minimum lot size
of 15,000 square feet and limit the hours of operation to 11:00 p.m., thus
conforming with the noise ordinance. In order to lessen the impact of parking on
the historic site, the amendment would permit up to 75% of the required parking
spaces be provided on site by valet parking.
