~ ORDINANCE NO. 11489
AN EMERGENCY ORDINANCE ESTABLISHING A SPECIAL
REVENUE FUND ACCOUNT ENTITLED: "SOCIAL
PROGRAM NEEDS/WELFARE REFORM" FOR THE RECEIPT
OF FUNDS TO BE ACCEPTED BY THE CITY AS
DONATIONS FROM THE PRIVATE SECTOR AND OTHER
EXTERNAL SOURCES TO PROVIDE ASSISTANCE TO
THOSE INDIVIDUALS NEGATIVELY IMPACTED BY THE
NEWLY ENACTED FEDERAL WELFARE REFORM ACT;
AUTHORIZING THE CITY MANAGER TO: (1) ACCEPT
AND DEPOSIT ANY AND ALL DONATIONS RECEIVED BY
THE CITY TO SAID ACCOUNT; (2) ACCEPT AND
DEPOSIT CITY FUNDS TRANSFERRED TO SAID
ACCOUNT; (3) SOLICIT FOR DONATIONS; (4)
EXECUTE ANY DOCUMENTS, IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, IF NECESSARY, TO
IMPLEMENT ACCEPTANCE OF SAID DONATIONS; AND
(5) ALLOCATE SAID DONATED AND TRANSFERRED
FUNDS AS DEEMED APPROPRIATE BY THE CITY
COMMISSION AND/OR THE CITY MANAGER IN AN
AMOUNT NOT TO EXCEED THE TOTAL MONIES
DEPOSITED INTO SAID ACCOUNT; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the newly enacted Federal Welfare Reform Act will
negatively impact many of the residents of the City of Miami by
cutting back the benefits received by individuals enrolled in
various welfare programs; and
WHEREAS, certain individuals from the private sector have
expressed a desire to assist those citizens who may be affected;
and
WHEREAS, the City Commission also wishes to solicit for
donations from the community and to deposit same, along with

funds transferred from other sources, into a special revenue
f and;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The following new Special Revenue Fund is
hereby established and resources are hereby appropriated as
described herein:
FUND TITLE: SOCIAL PROGRAM NEEDS/
WELFARE REFORM
RESOURCES: DONATIONS FROM THE PRIVATE
SECTOR
APPROPRIATION: SOCIAL PROGRAM NEEDS/
WELFARE REFORM
Section 3. The City Manager is hereby authorized1/ to:
(1) accept and deposit in the herein established Special Revenue
Fund any and all donations received by the City from the
private sector and other external sources to provide
assistance to those individuals negatively impacted by the
newly enacted Federal Welfare Reform Act;
(2) accept and deposit City funds transferred to said Special
Revenue Fund Account;
(3) solicit for donations;

with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by
,applicable City Charter and Code provisions.

(4) execute the necessary documents, in a form acceptable to the
City Attorney, if necessary, to implement acceptance of said
donations; and
(5) allocate said donated and transferred funds as deemed
appropriate by the City Commission and/or the City Manager
in an amount not to exceed the total monies deposited into
said account.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies and to generally carry on the functions and
duties of municipal affairs.
Section. 7. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 8. This Ordinance shall become effective
immediately upon its adoption.

the impact of immigration and welfare reform.
