ORDINANCE NO. i 1475
AN EMERGENCY ORDINANCE AMENDING THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ,AS
AMENDED, BY AMENDING ARTICLE 9, "GENERAL AND
SUPPLEMENTARY REGULATIONS", SUBSECTION
906.9(c), "ACCESSORY USES AND STRUCTURES;
TEMPORARY SPECIAL EVENTS; SPECIAL PERMITS",
TO PROVIDE FOR A WAIVER OF THE LIMITATION OF
TWO (2) SPECIAL EVENTS ON PRIVATE PROPERTY
PER SITE PER YEAR TO PERMIT NOT MORE THAN A
TOTAL OF FOUR (4) TEMPORARY SPECIAL EVENTS ON
PRIVATE PROPERTY PER SITE PER YEAR BY AN
AFFIRMATIVE 4/5TH VOTE OF THE CITY
COMMISSION; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE; AND PROVIDING FOR
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, as amended, is hereby
amended by amending the text of said Ordinance as follows:1'
"ZONING ORDINANCE
•ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS
906.9. Temporary special events; special permits.
1' Words and/or figures stricken through shall be deleted.
Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain unchanged.
Asterisks indicate omitted and unchanged material.

Where a temporary carnival, festival, fair or
similar type event is permissible on privately owned or
city -owned land by a Class I Special Permit, the
following conditions and limitations apply:
(c) No more than two (2) temporary events shall
be permitted, per site, each for a maximum of
two (2) weeks, on private property per year;
no more than ten (10) temporary events shall
be permitted, per site, each for a maximum of
two (2) weeks, on public property per year,
unless approved by the city commission.
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami.
Section 5. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 6. This Ordinance shall become effective
immediately upon its adoption.

Here following is a pocket item I intend to move during the March 27, 1997 City
Commission Meeting:
EMERGENCY ORDINANCE BY 4/5 VOTE OF THE CITY COMMISSION
NOW THEREFORE BE IT ORDAINED THAT SECTION 906.9 (C) OF
THE ZONING CODE OF THE CITY OF MIAMI CONCERNING
CLASS I SPECIAL PERMITS FOR TEMPORARY SPECIAL EVENTS
BE AMENDED TO CREATE A WAIVER PROVISION FOR THOSE
EVENTS ON PRIVATE PROPERTY BY 4/5 VOTE OF THE CITY
COMMISSION; THAT SAID WAIVER ALLOW FOR UP TO AN
ADDITIONAL TWO EVENTS (TOTAL OF FOUR) BY CLASS I
SPECIAL PERMIT, LASTING A MAXDAUM OF TWO WEEKS
EACH, PER YEAR.
RESOLUTION REOUIRING 4/5 VOTE OF THE CITY COMMISSION
NOW THEREFORE BE IT RESOLVED THAT THE CITY
COMMISSION WAIVES PURSUANT TO SECTION 906.9 (C) OF THE
ZONING CODE OF THE CITY OF MIAMI TO PERMIT TWO
ADDITIONAL (FOR A TOTAL OF FOUR) TEMPORARY SPECIAL
EVENTS BY CLASS I SPECIAL PERMIT DURING 1997 ON THE
PROPERTY OF THE STREETS OF MAYFAIR; FURTHER WAIVING
SECTION 54-171 (B) 5 OF THE CITY CODE WHICH REQUIRES A
MINIMUM OF 120 DAYS NOTICE FOR SPECIAL EVENTS WITHIN
THE COCONUT GROVE SPECIAL EVENTS DISTRICT FOR THE
ABOVE -SPECIFIED EVENTS.

Re: Request for Additional Special Event Class II Permits
near Mayor Carollo:
I havo prcpared the attached Motion for your consideration in connection with the request
by the Streets of Mayfair to have ten (10) additional special event class II permits.
As I advired, the City Zoning Ordinance only allows two (2) special event class II
permits in any given year on private property (the City is pemutted ten (10) on public property).
The Mayfair used two (2) this ycar when it hosted the orchid festival and the reception for Planet
Hollywood.
We would request that the Commission permit ten (10) additional special event permits
this year. You suggested two (2) additional ones now (out-of-pocket) and the additional request
to be put on a future agenda for consideradon. This is also acceptable to Mayfair.
The permits are for the grand opening of the Streets of Mayfair which will be on May 2,
3, and 4. In addition to that, we will be hosting other food, music and art festivals, as well as
private functions.
