AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO.
11365, ADOPTED MAY 23, 1996, WHICH ESTABLISHED
INITIAL RESOURCES AND INITIAL APPROPRIATIONS FOR A
SPECIAL REVENUE FUND ENTITLED: "HIDTA ASSET
FORFEITURE RESEARCH", THEREBY APPROPRIATING
ADDITIONAL FUNDS TO SAID ACCOUNT, IN THE AMOUNT
OF $20,000, CONSISTING OF A GRANT FROM THE MONROE
COUNTY SHERIFF'S OFFICE; AUTHORIZING THE CITY
MANAGER TO ACCEPT SAID GRANT AND TO EXECUTE THE
NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, FOR THIS PURPOSE; CONTAINING A
REPEALER PROVISION AND SEVERABILITY CLAUSE.
WHEREAS, the City of Miami Police Department continues to investigate narcotics
trafficking and money laundering; and
WHEREAS, there is a need to target specific geographical areas; and
WHEREAS, the Monroe County Sheriff's Office has approved an additional award in
the amount of $20,000.00, to be used for the continued operation of said program, with
no matching funds required from the City of Miami to accomplish these investigations; and
WHEREAS, any purchases would have to comply with applicable city code
purchasing requirements;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1 . The recitals and findings contained in the preamble to this Ordinance are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section 2 of Ordinance No. 11365, adopted May 23, 1996, is hereby
amended in the following particulars:'
"Section 2. The following Special Revenue Fund is hereby established and
resources are hereby appropriated as described herein:
FUND.TITLE: HIDTA ASSET FORFEITURE RESEARCH
RESOURCES: Monroe County Sheriff's Office $ A6,AA4 $66,000
APPROPRIATIONS: .32,99A
Necessary expenses for the continued operation
of the HIDTA Asset Forfeiture Research Program
in an amount not to exceed $66,000"
Section 3. The City Manager is hereby authorized to accept the grant as set forth
in the Preamble to this Ordinance and to execute the necessary documents, in a form
acceptable to the City Attorney, for acceptance of the aforesaid monies for the
compensation of personnel and other related costs.
Section 4. All Ordinances or parts of Ordinances insofar as they are inconsistent or
in conflict with the provisions of this Ordinance are hereby repealed.

The remaining provisions are now in effect and remain unchanged.
z The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.

Section 5. If any section, part of section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be
affected.
Section 6. This Ordinance is hereby declared to be an emergency measure on the
grounds of urgent public need for the preservation of peace, health, safety, and property of
the City of Miami, and upon the further grounds of the necessity of the City of Miami to
make the required and necessary payments to its employees and officers, payment of its
debts, necessary and required purchases of goods and supplies, and to generally carry on
the functions and duties of municipal affairs.
Section 7. The requirements of reading this Ordinance on two separate days is
hereby dispensed with by an affirmative vote of not less than four -fifths of the members of
the Commission.
Section 8. This Ordinance shall become effective immediately upon adoption.

ENCLOSURES:
It is respectfully recommended that an Ordinance amending Ordinance No. 11365, which
established initial resources and initial appropriations for a Special Revenue Fund entitled:
"HIDTA Asset Forfeiture Research," accepting an additional grant from the Monroe County
Sheriff's Office, in the amount of $20,000.00 and appropriating said funds for the operation of
same, be adopted.
BACKGROUND:
The Miami Police Department is continuing its efforts at combating narcotics trafficking and
money laundering, through High Intensity Drug Trafficking Area Grants (HIDTA). These grants
provide an additional incentive for the City of Miami Police Department to target organizations
involved in narcotics based on geographical location. This specific grant is being administered by
the Monroe County Sheriff's Office. The Miami Police Department's role will be to provide
public records research, perform public records searches, perform analytical investigations, and
assist in the analytical and forfeiture. process through public records research for all HIDTA
members in need of such information. The Monroe County Sheriff's Office has authorized an
additional $20,000.00 towards the continued operation of said program. No matching funds are
required by the City of Miami.
This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public
need for the preservation of peace, health, safety, and property of the City of Miami, and upon the
further grounds that the City of Miami has declared a financial emergency exists.
