AN EMERGENCY ORDINANCE ESTABLISHING A SPECIAL REVENUE FUND ENTITLED: "WEED AND SEED," AND APPROPRIATING FUNDS FOR THE OPERATION OF SAME, IN THE AMOUNT OF $152,140.00, CONSISTING OF GRANTS FROM THE MIAMI COALITION FOR A SAFE AND DRUG -FREE COMMUNITY, IN THE AMOUNT OF $52,140.00, AND THE DRUG ENFORCEMENT ADMINISTRATION ("DEA"), IN THE AMOUNT OF $100,000.00; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANTS AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THIS PURPOSE; CONTAINING A - REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City of Miami Police Department, in conjunction with The Miami Coalition for a Safe and Drug -Free Community, is committed to reducing the number of firearms and firearm related incidents, violent crime, drug trafficking and drug related crimes; and WHEREAS, the Miami Police Department has received grants from The Miami Coalition for a Safe and Drug -Free Community, in the amount of $152,140.00, and the Drug Enforcement Administration ("DEA"), in the amount of $100,000.00, which will be used for the payment of overtime, cameras, film, film developing and metal detectors; and WHEREAS, no matching funds are required from the City of Miami; and any purchases would have to comply with applicable city code purchasing requirements; and WHEREAS, this Ordinance is being presented as an emergency item, due to the urgent public need for the preservation of peace, health, safety, and property of the City of 1,1464 Miami, and upon the further grounds that the City of Miami has declared a financial emergency exists; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: WEED AND SEED RESOURCES: The Miami Coalition for a Safe and Drug -Free Community $ 52,140.00 Drug Enforcement Administration 100,000.00 APPROPRIATIONS: Necessary expenses for the operation of Weed and Seed $152,140.00 Section 3. The City Manager is hereby authorized' to accept said grants as set forth in the Preamble to this Ordinance and to execute the necessary document(s), in a form acceptable to the City Attorney, for acceptance of the aforesaid monies. Section 4. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable city Charter and code provisions. 11464 2 Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity of the City of Miami to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 7. The requirements of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 8. There are no matching funds required of the City of Miami. BACKGROUND: The Miami Police Department, in conjunction with The Miami Coalition for a Safe and Drug -Free Community, is committed to reducing the number of firearms, firearm related incidents, violent crimes, drug trafficking and drug related crimes within the Model City area. Firearm issues will be dealt with by using stepped up enforcement, educational programs, a resource hotline for the residents and students in the area to anonymously report weapons and the placing of two (2) metal detectors in each of the schools within the area. Crime and drug issues will be targeted utilizing investigations with the assistance of Federal and State agencies, arresting and incarcerating four of the top ten (10) identified violent offenders in the area, and aggressively pursuing the ten (10) existing properties that are magnets for drug involvement. To accomplish these goals the Department of Police has received a grant, in the amount of $152,140.00, from The Miami Coalition for a Safe and Drug -Free Community which will be used for the payment of overtime, cameras, film, film developing, metal detectors and other necessary expenses. No matching funds are required by the City of Miami. Additionally, this is unlike the traditional grants the Department receives as the money for this grant will be given to them in a lump sum instead of on a reimbursable basis.
